JUSTIFICATION FOR AN EXCEPTION To FAIR OPPORTUNITY

Revised 12/7/2017

In accordance with the requirements of FAR 16.SOS(b)(2), an Exception to Fair Opportunity is justified by the following facts and rationale:

1. Identification of the agency and the contracting activity.

Contracting Activity Processing the Requirement:

Name of Organization Originating the Requirement: CP/CPO

Identification Number (purchase request/solicitation number):

2. The nature and/or description of the action being approved:

CPO is requesting funding for a National Youth Summit Campaign, which will allow students, teachers, and parents in key cities to view the movie "IF Only," produced by Mark Wahlberg Youth Foundation. The movie along with substantive presentations and discussions is a powerful way to educate youth to the harmful and deadly effects of prescription opioid misuse. The Gavin Foundation with its partnership with the Mark Wahlberg Youth Foundation shall create and produce a series of six youth summits in target communities that align with the DEA 360 Strategy cities. This Summit Tour would be comprised of six cities total, with the events to be produced over a one year period, starting in May 2018 and concluding in May 2019.

3. A description of the supplies or services required to meet the agency's needs:

One of the demographic groups most vulnerable to opioid abuse is youth. To best address this target audience the Drug Enforcement Administration (DEA) shall work with the Gavin Foundation with it's partnership with the Mark Wahlberg Youth Foundation to create, organize, and produce a series of half day Summits with the objective of educating and dissuading middle school (7th and 8th Grade) and high school students from misusing prescription pills. Additionally, the vendor shall create a companion website enabling local parents and teachers to view the event program and download valuable information on the subject.

The Summit program shall consist of four separate and distinct segments:

1) The viewing of the Mark Wahlberg Youth Foundation produced short film on the dangers of opioid abuse "If Only." This critically-acclaimed short film was created to initiate a dialogue on opioids between adults - specifically parents and teachers - and young people.

2) Engaging and targeting presentations from speakers; from parents who have lost a child, to a local DEA Special Agents who is on the front lines, to professional athletes that lost everything to addiction;

3) Remarks from prominent elected officials which address the epidemic and their commitment to address it; and

4) A town hall meeting style discussion on the issue of opioid addiction (featuring a public health representative, family members who have lost someone to opioid addiction, youth recovering from opioid addiction, and a medical professional that deals with patients who have misused prescription opioids.)

Locations:

A Youth Summit shall be hosted in the following six cities and comprise this national tour:

JUSTIFICATION FOR AN EXCEPTION To FAIR OPPORTUNITY

1-Salt Lake City, Utah 2-Philadelphia, Pennsylvania 3-Charleston, West Virginia 4-Louisville, Kentucky 5-Dayton, Ohio 6-Baltimore, Maryland

The order of the Summits shall be determined by the vendor in coordination with DEA Community Outreach and the local DEA field division.

Period of performance or

Total estimated value: final delivery date: May 2018 - May 2019

4. Identification of the exception to fair opportunity: (Check the justification for fair opportunity and provide a narrative explanation for why the justification applies)

a. An exception to fair opportunity is justified because:

D The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

IZ] Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

D The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

D It is necessary to place an order to satisfy a minimum guarantee.

D For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

D In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3).

b. Provide a narrative explanation for why the justification applies:

The Gavin Foundation is the only vendor that is able through its partnership with the Mark Wahlberg Youth Foundation to supply the proprietary video "If Only" and a connected network of parents who have lost loved ones to prescription opiod misuse, which makes these summits possible. Through their partnership they are able to supply DEA the necessary speakers that will make these summits a success. They are the only vendor DEA can contract with that can produce the needed deliverables in the desired timeframe.

5. In accordance with FAR 15.404-l(b)(2) the anticipated cost to the Government is determined to be fair and reasonable for the following reasons:

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

CPO believes the quote submitted to DEA for the National Youth Summit Campaign is fair and reasonable . CPO did research into the proposed budget that included reaching out to one of FDA's meeting planners to have the proposal reviewed by an expert. CP through its research and expertise in putting on community events strongly supports that the anticipated costs by this vendor are fair and adequate for fulfilling the statement of work.

6. Any other facts supporting th is justification :

The Gavin Foundation is the only organization capable of providing the services required at the level of quality required because the services are highly unique.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made:

With the Gavin Foundation being the only vendor to bring the needed video to make these summits possible, no other vendor will be able to compete or bring any complaint against the Agency.
