The organizational conflict of interest risk mitigation plan shall be submitted no later than Monday, September 11, 2017, Noon, Eastern Time. See Section L.13.4(4)(e) (L.14, Volume III – Administrative Volume – Contractor Responsibility Determination, Tab 3 – Organizational Conflict of Interest Plan).

The offeror shall discuss in detail their conflict of interest risk mitigation processes/policies including an organizational conflict of interest risk mitigation plan; refer to Sections H.4 and H.5, including mitigation approach. The plan must include names of individuals who have accessed systems or in any manner worked on any requirements for the Military Community and Family Policy (MC&FP) office. The plan must also include names of individuals who worked on this proposal who may also have accessed systems or in any manner worked on any requirements for the MC&FP office. The timeframe, outside of which, the names are not required to be listed is prior to January 1, 2012 (not more than five years).

The organizational conflict of interest risk management plan must be in-depth and thorough, clearly describing how the offeror is mitigating all organizational conflicts of interest. To simply state for example that a “firewall” has been established is not acceptable. The plan must detail procedures as well as physical and electronic barriers, and describe how the offeror mitigates access to unequal access to information, or otherwise prevent other organizational conflicts of interest. Failure to mitigate organizational conflicts of interest may preclude award.

Organizational Conflict of Interest - On Demand and Camp Assignment System Access:

The Government has identified several contractors that have provided support for the MFLC Resource Request System (RRS) which includes information that could give rise to an organizational conflict of interest based on unequal access to information (FAR 9.505-4). The Government maintains a list of all prime contractors, subcontractor and their respective employees that have current access and have had access in the past to RRS. Any offeror that has current access to RRS or is partnering, teaming, or in a prime/subcontractor relationship with other firms that have current access to RRS must provide an Organizational Conflict of Interest Mitigation plan for evaluation prior to the submission of proposals by the specified due date. The mitigation plan must specifically describe efforts to restrict access to information available from or within those firms who have current access to RRS. Any offeror failing to successfully mitigate the information above may be deemed ineligible for award.

Offerors must also provide a list of each and every individual that has participated in the preparation of the proposal as well as each individual’s employer, title and a description of the role the individual played in developing the proposal. This list must be provided from every offeror even if the offeror is not currently partnering, teaming, or in a prime/subcontractor relationship with firms that have current access to RRS. The Government intends on checking the provided list against the Government maintained list to identify any individuals that have potentially provided non-public competitively advantageous information in preparation of the proposal. If such individual is identified, the Government may request additional information to ascertain whether a conflict of interest exists.

It is the offerors’ responsibility to determine if any of its teaming partners, subcontractors, consultants and/or employees have had or currently have access to RRS prior to the submission of the proposal.

An offeror may be excluded from consideration for award if the Contracting Officer deems it is necessary to avoid an organizational conflict of interest. The Contracting Officer’s decision as to the existence or nonexistence of an actual or potential organizational conflict of interest shall be final. If an organizational conflict of interest pertaining to this provision IS NOT in existence, the offeror must provide the following disclosure with their proposal:

Organizational Conflict of Interest - Certification Statement

As a representative of my organization, I hereby certify that, to the best of my knowledge and belief, no facts exist relevant to any past, present or currently planned interest or activity that relate to the proposed work and bear on whether I, the organization, or anyone employed by the organization, has a possible conflict of interest with respect to being given an unfair competitive advantage.
