Questions 2 through 9 – Subject: Organizational Conflict of Interest Risk Mitigation Plan

The Plan is due Noon Eastern Time, Monday, September 11, 2017

As the responses to questions submitted under Solicitation D17PS00077 impact an offeror’s submission regarding the Organizational Conflict of Interest Risk Mitigation Plan under Section L, Item L.6.1, the

Government is posting a response to those questions prior to the posting of all questions and answers.

Therefore, listed below are the questions with the Government’s response:

2. Question: Do operational staff that utilize the RRS system in their day-to-day fulfillment and supervision of the on demand and camp assignments need to be entirely excluded from proposal development or is it acceptable for them to work on other aspects of the proposal excluding discussion of the RRS system?

Answer: An offeror’s operational staff that utilize the MFLC RRS in the day-to-day fulfillment and supervision of the on-demand and camp assignments do not need to be entirely excluded from proposal development as the offeror has only access to that offeror’s information in the MFLC RRS System. Government security measures within RRS do not allow one Contractor to access another Contractor’s information in the instance described.

3. Question: RFP Section L.6.1 states that “The Government has identified several contractors that have provided support for the MFLC Resource Request System (RRS) which includes information that could give rise to an organizational conflict of interest based on unequal access to information (FAR 9.505-4).” We have not provided support to the RRS, which is what this section refers to, but we have several employees who have access to the system and utilize it in their day-to-day fulfillment and supervision of the on demand and camp assignments. We do not believe that this level of access rises to the level that would constitute “support for the MFLC Resource Request System (RRS),” and thereby we do not believe that an OCI Mitigation Plan is required, nor do we believe that they need to be excluded from proposal development according to this description. Can the Government confirm that this is the case?

Answer: The Government defines “support” as that in which the Contractor has provided maintenance or some other means which requires access to all information within the MFLC RRS system for a requirement in support of the MFLC RRS System. An offeror who has accessed the MFLC RRS System to provide day-to-day fulfillment and supervision of the on-demand and camp assignments is not “support” for the MFLC RRS. In such a situation, unequal access to information shall not have occurred and thus, an OCI Mitigation Plan for these facts is not required and for these reasons, the offeror does not need to exclude the employees from proposal development.

4. Question: Several of our employees have an ECA certificate but have never accessed the RRS system. Their use of the ECA certificate has been to access/respond to CPARs, not to access the RRS system. We do not believe that this would require the implementation of an OCI Mitigation Plan. Does the Government agree with this interpretation?

Answer: If the ECA certificate would only allow the user to provide day-to-day fulfillment and supervision of the on-demand and camp assignments, an OCI mitigation plan would not be required.

5. Question: Can the government clarify whether there are different levels of contractor access of

RRS, and if so, can the Government describe the different level(s) and which, if any, would require the development of an OCI Mitigation Plan?

Answer: There are different levels of contractor access to the MFLC RRS, contractors who utilize RRS to provide day-to-day fulfillment and supervision of the on-demand and camp assignments have access restricted to only that contractor’s information. A second level of access provides maintenance to the MFLC RRS, which allows the maintenance contractor to access information that would constitute an Organizational Conflict of Interest.

6. Question: Can the government clarify whether there are contractors who have access to RRS and its content beyond being able to view requests that DoD has specifically asked an individual contractor to support?

Answer: There are contractors who have access to perform maintenance on the MFLC RRS System.

7. Question: If the Government determines that any of our employees with access to RRS rises to the level of “providing support” to the RRS, is it acceptable for them to work on other aspects of the proposal excluding discussion of the RRS?

Answer: The Government contractors providing “support” are not those who have access to the MFLC RRS System to provide day-to-day fulfillment and supervision of the on-demand and camp assignment as this access is only to information of that same Contractor. Thus, it is acceptable for that potential offeror to work on all aspects of the offeror’s proposal.

8. Question: Is the Organizational Conflict of Interest Risk Mitigation Plan to be submitted via email, as an attachment, or is the Organizational Conflict of Interest Risk Mitigation Plan to be submitted via “Original and 7 hardcopies and 7 softcopies” as referenced in L.6.1, Paragraph 1: Section L.13.4(4)(e) (L.14, Volume III – Administrative Volume – Contractor Responsibility Determination, Tab 3 – Organizational Conflict of Interest Plan)?

Answer: The Organizational Conflict of Interest Risk Mitigation Plan as referenced in Section L.13.4(4)(e) of Volume III – Administration is the only part (Tab 3) of this volume due at Noon, on Monday, September 11, 2017. The Plan can be submitted as one (1) copy via email as an attachment to d17ps00077@ibc.doi.gov. The required hardcopies, as instructed in the solicitation, must be submitted with the complete proposal submission.

9. Question: Reference Section L, Paragraph L.6.1 Organizational Conflict of Interest Risk Mitigation Plan.

Please confirm that electronic submission of the organizational conflict of interest risk mitigation plan via e-mail to d17ps00077@ibc.doi.gov, is sufficient and that hardcopies and softcopies are not expected.

Answer: Electronic submission of the Organizational Conflict of Interest Risk Mitigation Plan via email to d17ps00077@ibc.doi.gov is acceptable. Tab 3 – Organizational Conflict of Interest Risk mailto:d17ps00077@ibc.doi.gov mailto:d17ps00077@ibc.doi.gov

Mitigation Plan of Volume III – Administrative is the part of that volume that is due by Noon on Monday, September 11, 2017. The required hardcopies, as instructed in the solicitation, must be submitted with the complete proposal submission.
