About this file

This is a Justification Review Document for a Federal Acquisition Regulation (FAR) Part 6 justification supporting other than full and open competition procurement.

The U.S. Army Mission and Installation Contracting Command (MICC) at Fort Sam Houston, Texas seeks approval to execute a non-competitive ceiling increase modification to contract W9124J-23-D-0016, awarded to JLL-RER Solutions, LLC. The modification increases the contract ceiling by $109.3 million, raising the total contract value from $91.3 million to $200.6 million, with a performance period from August 12, 2026 to September 24, 2028. The requirement provides continued independent housing inspections, habitability assessments, mold evaluations, and indoor air quality (IAQ) testing across the Army's privatized, government-owned, government-controlled, and leased housing portfolio, covering approximately 7,000 buildings. Services include structural, HVAC, plumbing, and electrical evaluations; visual mold assessments; IAQ testing; environmental sampling; and reporting and data integration. The procurement authority is Title 10 U.S.C. Section 3204(a)(2), implemented through FAR 6.103-2 (Unusual and Compelling Urgency). The justification cites urgent need driven by July 2026 displacement of 5,200 Initial Entry Trainees from Army Barracks at Joint Base San Antonio and lack of up-to-date barracks inspections affecting servicemember readiness and safety. The incumbent contractor is the only viable source due to existing infrastructure, independent inspector network, mobilization readiness, and environmental testing capability. The Government conducted market research under the base IDIQ award, evaluating four offerors (Tetra Tech, JLL-RER, ISN, and Jacobs), determining the incumbent provides best overall value. Future competitive actions are planned once the urgent need is resolved.

2) Use in-house personnel. The Government does not possess the number of personnel on staff with the requisite knowledge to perform the sheer number of inspections in the short timeframe required. A commercial solution is the only viable option.

3) Continuing without the ability to assess the state of condition of barracks/dorms unduly places servicemembers at a potential lower level of operational readiness.

c. Impact if Justification Is Not Approved. Failure to approve this ceiling increase will leave potential barracks deficiencies and safety risks unabated, and without mitigation contribute negatively to operational readiness of servicemembers and military units.

7. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.101.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable. This is a ceiling increase to an existing IDIQ.

b. Subcontracting Competition: The incumbent contractor maintains a network of independent inspectors and environmental-testing subcontractors. Throughout the life of the contract, to date, the contractor and their subcontractors have performed exceptionally. Performance has been documented in the monthly COR reports and CPARs as applicable. The contractor maintains their ability to continue providing exceptional performance under this added work. The incumbent is required to submit a revised subcontracting plan for the increase in work and value of the contract.

8. Actions to Increase Competition: Although this ceiling increase is being executed via a sole-source modification to the existing IDIQ contract to prevent a critical gap in services for inspections, the Government is taking active steps to foster future competition if continued services are mandated by Congress.

9. Market Research: Market research for this requirement has already been completed under the base IDIQ award and subsequent ordering actions. The Government previously evaluated the supplier base and determined that only the incumbent contractor demonstrated the capability, mobilization readiness, environmental testing infrastructure, and independent inspector network required to meet statutory housing inspection mandates.

Market research is an ongoing process. Although the urgent nature of this modification prevents a competitive action, thorough market research will be conducted throughout the remaining Period of Performance to ensure a robust and competitive action is executed for any follow-on contracts.

Approval

Based on the foregoing justification, I hereby approve the procurement of a ceiling increase to the independent housing inspections single award indefinite-delivery / indefinite-quantity contract on an other than full and open competition basis pursuant to the authority of Title 10 United States Code Section 3204(a)(2) as implemented in Federal Acquisition Regulation 6.103-2 - unusual and compelling urgency. The estimated value of the contract modification is $10 .3 million and the period of performance will occur during the remainder of the ordering period that will end 24 September 2028. The approval is subject to the availability of funds, and provided that the services or supplies herein described have otherwise been authorized for acquisition.
