Cultural Stipulations:

Violation of these stipulation may result in the operator being subject to the penalties and actions contained in the 43CFR7 Regulations, which are on file at all BLM offices.

1. CULTURAL RESOURCES, SITE AVOIDANCE. The fence route crosses the Rawlins to Fort Washakie Stage Trail, a significant historical resource. To protect the physical remains and the setting of Trail, all of the fencing visible from the Trail must be installed immediately adjacent to existing two-track roads. All equipment and vehicles used for fence installation and removal must use the existing two-track roads for access. No new ground disturbance will be allowed except for the installation of the temporary fiberglass fence posts and gate posts.

2. To protect the physical remains and the setting of Trail, all of the fencing visible from the Trail must be temporary electric fence and only be in place when necessary to control livestock movement in the area. The temporary fence must be put up immediately prior to livestock entering the area, and removed immediately following livestock leaving the area. The temporary electric fence will be in place no more than 5 months every year, from May 1 to October 1.

All fence posts and gates must be removed each season. The fence wire may be laid down immediately adjacent to the existing two-track road.

3.To protect the physical remains and the setting of Trail, all of the fencing visible from the Trail must be constructed of fiberglass posts that are colored to visually integrate into the landscape (e.g.

Covert Green [18-0617 TPX]).

4. To protect the physical remains and the setting of Trail, all of the fencing visible from the Trail must be constructed using non-reflective wire that is of a dull luster and a color that will blend in with the natural vegetation growing around the Trail crossing area.

5. To protect the physical remains and the setting of Trail, the temporary gate crossing the Trail must be specially designed to be small, as visually non-impacting as possible, and removable. The gate posts must be fiberglass posts that are colored to visually integrate into the landscape (e.g. Covert Green [18-0617 TPX]).

6.To protect the physical remains and the setting of Trail, the charging system for the electric fence, including any solar panels, batteries, or other necessary facilities, must be installed where it is not visible from the Trail.

7. CULTURAL AND PALEONTOLOGICAL RESOURCES

STIPULATION. The operator must immediately report to the authorized officer any cultural and/or paleontological resource (historic or prehistoric site or object or fossil) discovered on public or Federal land by the operator, or any person working on their behalf.

The operator must suspend all operations in the immediate area of such discovery until written authorization to proceed is issued by the authorized officer. An evaluation of the discovery will be made by the authorized officer to determine appropriate actions to prevent the loss of significant cultural or scientific values. The operator is responsible for the cost of evaluation. The authorized officer will make any decision as to proper mitigation measures after consulting with the operator. For Official Use Only:

Disclosure of Site Locations Prohibited (43 CFR 7.18)
