About this file

This is a Vendor Preference Certificate issued by the State of West Virginia Department of Purchasing for use in competitive bidding processes. The document establishes the framework for qualifying vendors to request preference consideration based on residency status and other criteria at the time of bid submission, in accordance with West Virginia Code 5A-3-37. The Purchasing Division is responsible for determining vendor preference eligibility and applying any approved preference only as an evaluation method to the cost bid submitted. Vendors may apply for preference in multiple categories, and preference determinations are made at the time of bid evaluation rather than at contract award.

The certificate outlines seven distinct preference categories with varying preference percentages ranging from 2.5 percent to 5 percent for residency-based and employment-based qualifications, and 3.5 percent for veteran-owned vendors meeting specified criteria. Vendors applying for preference must certify that they meet specific requirements, including four-year continuous residency in West Virginia for individuals or principal place of business for entities, employment of minimum numbers of state residents, and in some cases, commitments that at least 75 percent of project employees will be West Virginia residents. Additionally, non-resident small, women-, and minority-owned businesses certified under West Virginia Code 5A-3-59 may apply for preference consideration. Vendors certifying for preference must understand that failure to maintain eligibility requirements during contract performance may result in contract rescission or penalties up to 5 percent of the bid amount, and must immediately notify the Purchasing Division of any changes to their certified status.
