About this file

This contract terms document outlines the conditions governing the Maine Military Authority's purchase of M109A5 Parts to support vehicle and equipment refurbishment and maintenance operations. The contract establishes procedures for order placement through Delivery Order (DO) documents sent via email to the contractor's primary contact, with each order assigned a distinct order number. MMA reserves the right to release multiple orders simultaneously with varying delivery dates. Shipments will only be accepted up to two weeks ahead of stated delivery dates, and orders arriving too far in advance without prior approval are subject to refusal. The State Purchasing Director reserves the right to extend the contract beyond its indicated expiration date with contractor consent and may cancel the contract with thirty days' written notice.

Bid prices must be submitted as net F.O.B. destination, with all transportation and delivery charges fully prepaid by the contractor. Prices remain fixed throughout the contract period unless periodic price adjustments are agreed to in writing. MMA will provide a preliminary shipment schedule representing its best estimate of needs, though actual delivery orders may vary based on operational requirements at the time of order. The State of Maine reserves payment flexibility through multiple methods, including check, electronic funds transfer (EFT), and procurement card. Pursuant to Maine statute 9-A MRSA 8-303(2), contractors are prohibited from imposing surcharges on credit or debit card purchases. Orders not delivered as scheduled are subject to modification or cancellation at MMA's discretion.
