About this file
This contract terms and conditions document outlines the procurement requirements for the ChemPro 100i Handheld Chemical Detector for the Maine Emergency Management Agency (MEMA) and participating Maine municipalities and political subdivisions. MEMA intends to establish a commodity contract with an estimated first-year value of $70,000 to purchase approximately 4 units initially, with plans for an additional 2-4 units in subsequent years. The contract will be awarded no later than mid-February and will have an initial one-year term with two possible one-year extensions. Bulk purchases are expected to occur annually, and all deliveries must be made in first-class condition to the specified destination in a timely manner in accordance with good commercial practice.
Pricing must remain firm throughout the contract duration and include all transaction charges with F.O.B. Destination delivery terms. The State of Maine requires vendors to accept the State Procurement Card as a payment method without surcharges or additional compensation, with no exceptions unless expressly approved. Delivery orders of $5,000 or less will be emailed directly to the vendor as PDF files, while larger orders will be processed through the Division of Purchases for approval and encumbrance before transmission. Invoices must reference both the Delivery Order number and Contract number to ensure timely payment processing. The State is exempt from federal excise taxes and state sales taxes. The Division of Purchases reserves the right to cancel the contract with thirty days' written notice or immediately if the contractor fails to conform to contract terms and conditions. Contractors may be required to provide detailed purchase summaries to the Director of Purchases on a yearly or more frequent basis as requested.
