1. The Offeror’s or Bidder’s attention is called to the “Equal Opportunity Clause” and the “Standard Federal Equal Employment Opportunity Construction Contract Specifications” set forth herein.
2. The goals and timetables for minority and female participation, expressed in percentage terms for the Contractor’s aggregate workforce in each trade on all construction work in the covered area, are as follows:
Timetables Goals for minority participation for each trade: 4.1% (Applied to Lewis and Clark County) Goals for female participation in each trade: 6.9%
These goals are applicable to all of the Contractor’s construction work (whether or not it is Federal or federally assisted) performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, it shall apply the goals established for such geographical area where the work is actually performed. With regard to this second area, the Contractor also is subject to the goals for both its federally involved and nonfederally involved construction.
The Contractor’s compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a) and its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor’s goals shall be a violation of the contract, the Executive Order and the regulations in 41 CFR Part 60-4.

INFORMATION FOR BIDDERS PAGE 3
7. WORKERS’ COMPENSATION INSURANCE
The Contractor's attention is called to the Workers’ Compensation laws in force in Montana (MCA Title 39, Chapter 71) and to the responsibility of the Owner for the collection of premiums thereunder.
Compliance with said laws is required and shall relieve the Owner of any responsibility for the payment of premiums thereunder. The Contractor shall furnish the Owner with proof of coverage and satisfactory evidence showing that all premiums arising from this Contract have been paid before payment is made on the final estimate.
8. PREFERENCE OF MONTANA LABOR AND MINIMUM WAGE RATES
This federal aid funded project is exempt from Montana labor preference and other portions of MCA 18- 2-403 that conflict with federal statute.
9. PAYMENT TO CONTRACTORS
This AIP project involves payment to Contractors not only from funds the Owner has on hand for this purpose but also grant funds from the FAA. The Contractor is hereby advised that the Owner and the Engineer will expedite partial and final payments to the Contractor as much as possible but since FAA grant funds must be obtained to make these payments, the Contractor should anticipate and allow time for obtaining these grant funds before expecting partial or final payments under this Contract.
Notice of Alternate Billing Cycle This contract allows the Owner to require the submission of payment requests in billing cycles other than once a month. Payment requests for this contract must be submitted after:
a) Crack sealing, paint removal, seal coating, friction testing, coal tar, & temporary marking are complete, and
b) Construction work and Closeout Documents are complete.
Approval of Payment Request Provision In accordance with MCA 28-2-2103 a contractor’s request for payment is considered approved by the Owner 21 days after receipt, unless acted on prior to that time.
Notice of Extended Payment Provision This contract allows the Owner to make payment no later than twenty-one (21) days after approval of the payments.
Partial and Final Payments: Following is the procedure that will be used in making partial and final payments to the Contractor. At the preconstruction conference the Engineer and Contractor(s) shall agree on a date each month when work will be cut off for that month's estimate. No later than ten (10) calendar days after said cut-off date the Contractor shall prepare (using Engineer's provided forms) an estimate for payment and Federal Aid Application for FAA grant payment, which application will be reviewed by the Engineer and forwarded to Owner within a seven (7) day period.
a. No later than seven (7) days after receipt of the Federal Grant payment from the U.S. Treasury, the Owner will process and pay the claim.
Note that processing the request for reimbursement from FAA for the final payment of the
Contractor takes considerably more time than is required for the request involving only partial payments because the final payment involves procedures that are time consuming.
b. Retainage will not be withheld on this project. No retainage will be withheld by the Owner from progress payments due the prime Contractor. Retainage by the prime or subcontractors is prohibited, and no retainage will be held by the prime from progress due subcontractors.
PAGE 4 INFORMATION FOR BIDDERS
c. The Contractor may not be paid the final payment of their contract price until a final FAA inspection has been held. There may be considerable delay in receiving final payment.
d. Final payment shall not be due until the Contractor has provided the Owner with an “Affidavit on
Behalf of Contractor”, “Compliance Letter”, “Affidavit of Amounts Paid DBE Participants”, “Consent of Surety Company to Final Payment”, “Unconditional Waiver and Release on Payment” from all subcontractors and suppliers per General Provision 90-06, “Contractor’s Certificate of Completion”, and “Certificate of Substantial Completion” forms. These forms are included in these Contract Documents in the section titled “Miscellaneous Forms.”
e. The making of final payment will not relieve the Contractor from claims arising from the failure of the work to comply with the requirements of the Contract Document.
10. BUY AMERICAN PREFERENCES
The Contractor must comply with “Buy American” 49 U.S.C. Section 50101 and assure compliance by their subcontractors and material suppliers. Materials submittals shall include proof of country of origin, reference to an item’s national waiver or status as an excluded material. Components of unknown origin are considered to have been produced or manufactured outside the United States. Materials will be rejected if their submittals do not correspond with the Buy American certification statement completed in the Proposal.
Resources available to the Bidder at www.faa.gov/airports/aip/buy_american/ include:
a. Nationwide Buy American Waivers Issued (as of XX/XX/XXX) (PDF) – this is a list of specific non-100% US-produced products that do not need further appeal or justification for use on this project.
b. Final Assembly Questionnaire (Form 5100-137) – used when requesting a Type 3 waiver.
c. Construction Project Content Percentage Worksheet (Form 5100-143) – used when requesting a
Type 3 waiver. Requires submission of entire project content percentages.
EXCLUDED COMMON MATERIALS
Some common items that are excluded from the Buy America preference are: cement, concrete (but NOT rebar), and petroleum products (asphalt, tack, prime, seal coat, etc.). These items are not included in calculations of Buy America compliance, nor do their submittals require documentation of the country of origin. The AIP-Handbook order 5100.38D, Change 1, Appendix X.

CONSTRUCTION SAFETY AND PHASING PLAN PAGE 1
CONSTRUCTION SAFETY AND PHASING PLAN
This document supplements the Plans and Specifications and other Contract Documents prepared for the Lincoln Airport Improvement Project, AIP 3-30-0050-014-2025 & -015-2025. This document aids in identifying all aspects of the construction project that pose a potential safety hazard to airport operations and outlines respective mitigation procedures for each hazard. It provides all information necessary for the Airport Operations department to conduct airfield inspections and expeditiously identify and correct unsafe conditions during construction. The requirements outlined in this Construction Safety and Phasing Plan (CSPP) are developed from Advisory Circular 150/5370-2G.
1. Coordination
Safety Plan Compliance Document (SPCD): Prior to the Pre-Construction meeting, the Contractor will be required to submit a SPCD, as required by the Contract Documents, to the Engineer and Airport Operator, describing how they will comply with the requirements in the CSPP and supply any details that could not be determined before contract award. The SPCD outline is attached in Appendix A.
Notice: The Contractor shall provide a minimum of 48 hours’ notice to the Engineer of his desire to perform construction within each area and shall begin operations within these areas only upon receipt of authorization from the Engineer.
Closures: Once work is commenced, Contractor shall steadily and diligently work on the project to ensure completion within specified contract time, or Liquidated Damages will be applied as described in this document.
Prior to beginning construction operations in any areas, all barricades and "temporary" closed markings shall be installed as shown in the Plans or designated by the Engineer.
Airport Operations During Construction: It is the intention of the Owner to complete construction of the improvements within a minimum time period. The Owner will notify the necessary agencies as to the closure of affected operations at the Airport. The Contractor shall notify the Engineer 48 hours in advance of any requested closure, so that the required Notice to Air Missions (NOTAM) can be arranged.
a. Contractor Progress Meetings
The Contractor and all affected parties will be required to meet a minimum of once per week during each week the Contractor is working on site, prior to any closure phasing change, and as necessary to discuss safety operations and changes in phase elements. These meetings will help assure all construction personnel know of any applicable airport procedures and of any changes to those procedures that may affect their work.
b. Scope or Schedule Changes
Prior to any scope or schedule changes a safety meeting will be held, as necessary, with the Contractor and all affected parties to discuss any safety phase changes or other changes that may affect their work. Any scope or schedule changes that necessitate revisions to the CSPP will require review and approval by the airport operator and the FAA.
c. FAA ATO Coordination
FAA Air Traffic Organization (ATO) will be notified of all conditions that may adversely affect the operational safety of the airport via Notices to Air Mission (NOTAM) and other methods, as
PAGE 2 CONSTRUCTION SAFETY AND PHASING PLAN
appropriate. There are no anticipated improvements that will require a reimbursable agreement or flight inspection as part of this project.
A National NAS Strategic Interruptions Service Level Agreement form will be submitted with anticipated runway or airport closure dates lasting more than 24 hours during the project advertising for bids phase (45 days prior to construction).
2. Phasing
Plan: The construction phasing plan has been developed to mitigate the adverse impacts of construction on aeronautical operations and to improve safety. Strict adherence to the provisions of the construction operations phasing plan by all personnel assigned to or visiting the construction site is mandatory for all construction projects. In the event contractor activities are not in conformance with the provisions of the construction operations plan, the Contractor shall immediately cease those operations violating provisions of the construction operations plan and conduct a safety meeting. The construction operations plan is open to input at safety meetings, but the Resident Project Representative (RPR) and/or Owner have the final determination of safe operations. The Resident Project Representative may direct the Contractor, in writing, to immediately cease those operations involved in the violation of the provisions of this Construction Safety and Phasing Plan. The Contractor shall not resume construction operations until an appropriate action is taken as determined by the Resident Project Representative.
Although aircraft emergencies are quite rare, should one occur during the project, it is expected that lifesaving measures will take precedence over the convenience and expense of the Contractor. On-going operations shall be kept neat, and cleaning shall be continuous, so any required clean-up for use by an aircraft in distress will be minimal. Any costs for Contractor delays or inconvenience will be considered incidental costs of the project with no additional compensation by the Owner.

6. Wildlife Management
a. Trash
All trash, including food scraps, will be collected and deposited in an enclosed trash bin(s) in order to prevent wildlife attraction.
b. Standing Water
Large areas of standing water that may attract wildlife will not be permitted on the airport property, unless otherwise authorized by the Engineer.
c. Tall Grass and Seeds
Reclamation, including seeding, fertilizing, and mulching, of any significantly disturbed areas will occur after construction is completed. All seed will comply with the guidance in AC 150/5370-10, Standards for Specifying Construction of Airport, Item T-901, Seeding.
d. Poorly Maintained Fencing and Gates
All fencing and gates will be maintained during construction unless otherwise authorized by the Engineer and approved by the FAA. As necessary/required, temporary gates and fencing will be installed. All gates will be left closed and locked when not in use to help ensure no unauthorized use occurs.
e. Disruption of Existing Wildlife Habitat
If any wildlife is observed by any contractor’s personnel, they shall immediately contact the Resident Project Representative and appropriate actions will be taken. Typical avian and rodent sighting may not be reported, but any sighting that are deemed to be abnormal or of increased numbers shall also be reported.
The Contractor shall take no action as part of their operations that attract or habituate wildlife to the airport property. Best practices shall be followed to remove food sources (trash, food scraps, loose seed, etc.), attractants (standing water, etc.), and/or breaks in perimeter fencing (maintain fences/gates, provide temporary fence/gates, vigilantly close gates, etc.).
7. Foreign Object Debris (FOD) Management
Waste and Loose Material: Waste and loose material capable of causing damage to aircraft landing gears or propellers shall not be placed on active aircraft movement areas. Material tracked on these areas shall be removed continuously during all phases of the project.

9. Notification of Construction Activities
a. Maintenance of a List of Responsible Representatives / Points of Contact
A list of responsible representatives and points of contact are included in Appendix B. This list will be provided to the FAA, Contractor, Subcontractors, and affected parties. Previous to award of the construction bid, the successful bidder will be required to complete this list of all responsible personnel for the Prime Contractor and all Subcontractors.
b. Notices to Air Missions (NOTAM)
The Contractor shall contact the Engineer with all closure requests a minimum of 48-hours in advance of their proposed action. The Engineer will coordinate the issuance, maintenance, and cancellations of all NOTAMs with the Owner/airport operator.
c. Emergency Notification Procedures
The emergency notification contacts for medical, firefighting, and police response are included in the Appendix B emergency contact sheet.
d. Coordination of ARFF Personnel
Not applicable for this project as the airport operator does not own an ARFF vehicle. The Local Fire Department will be the point of contact for any emergency situations.
e. Notification to the FAA
The Engineer will keep the FAA ADO up-to-date on construction activities through weekly progress reports and other periodic contacts.
10. Inspection Requirements
a. Daily Inspections
The Resident Project Representative and Contractor will conduct daily inspections, and more frequently as needed, to ensure construction personnel comply with the CSPP and SPCD and that there are no altered construction activities that could create potential safety hazards. The checklist included in Appendix C will be used, at a minimum, to aid in verifying conformance.
b. Final Inspections
A final inspection will be held prior to reopening of any air operations area (AOA). The FAA will be invited to attend all final inspections conducted. No air carrier service is provided at this airport, so no coordination with the FAA Airport Certification Safety Inspector (ACSI) is required.
PAGE 6 CONSTRUCTION SAFETY AND PHASING PLAN
11. Underground Utilities
In any location the contractor breaks ground to a depth of 1 foot or more as part of the project, they will be responsible for checking with the owners of underground utilities regarding the location of their underground lines. The Contractor will be required to fully coordinate his work with the agencies and to keep them informed of his construction activities so that these vital installations are fully protected at all times. The Contractor shall be solely responsible for any damage done to these installations due to failure to locate or to properly protect them when their location is known.
12. Penalties
In the event contractor activities are not in conformance with the provisions of the CSPP, the Contractor shall immediately cease those operations involved in the violation of the provisions of the CSPP and conduct a safety meeting. The Resident Project Representative or Owner may direct the Contractor, in writing, to immediately cease those operations involved in the violation of the provisions of the CSPP. The Contractor shall not resume construction operations until an appropriate action is taken as determined by the Resident Project Representative. Penalties will be as determined by the Engineer and may include such items as rescission of driving privileges, installation of additional closure marking/signing, and/or denial of access to the AOA.
13. Special Conditions
Not applicable to this project.
14. Runway and Taxiway Visual Aids.
a. General
The construction area will be clearly and visibly separated from the areas where aircraft will be operating by closure markings, as shown on the Construction Safety and Phasing Plan drawing included in the Construction Plans.
b. Markings
All marking will be in compliance with the standards of AC 150/5340-1, Standards for Airport Markings. All “temporarily” closed runways will be marked with a yellow X on or near the runway designation numbers. All “temporarily” closed taxiways and aprons will have barricades (candles, cones, and/or low-level barricades) placed at all access points (outside of the connecting taxiway/ runway object free areas). See also the Construction Safety and Phasing Plan drawing in the Construction Plans.
c. Lighting and Visual NAVAIDs
Temporary taxiway closure barricades remaining in place overnight will be lighted with red flashing lights. Runways remaining closed during nighttime, or any low-visibility conditions, will have their lighting systems shutdown and locked out during all closure periods, including runway lights and associated approach lighting.
d. Signs
At any time a sign does not serve its normal function, it will be covered to prevent misdirecting pilots. Information signs will not be covered, as they will still serve their intended purpose.

15. Marking and Signs for Access Routes
16. Hazard Marking and Lighting
Hazard marking and lighting prevents pilots from entering areas closed to aircraft and prevents construction personnel from entering areas open to aircraft. The spacing of barricades must be such that a breach is physically prevented, barring a deliberate act. If temporary taxiway closure barricades remain in place overnight, they will be lighted with red flashing lights, spaced no more than 4 feet apart. Runways remaining closed during nighttime, or any low-visibility conditions, will have their lighting systems shutdown and locked out during all closure periods. Hazard marking and lighting will also be placed to aid in identifying any open manholes, small areas under repair, stockpiled material, waste areas, and areas subject to jet blast, where applicable.
The Contractor will be required to have a person on call 24 hours a day for emergency maintenance of airport hazard lighting and barricades. The Contractor must file the contact person’s information with the airport operator and Engineer. Lighting will be checked for proper operation at least once per day.
17. Work Zone Lighting for Nighttime Construction
18. Protection
a. Runway Safety Area (RSA)
No construction will occur within a runway safety area while the runway is open for aircraft operations. Neither open trenches nor excavations will be permitted within the RSA while the runway is open. Any disturbances of the runway shoulders due to construction must be returned to standard conditions prior to returning the construction zone to airport operations.
b. Runway Object Free Area (ROFA)
Minimum Parking Distance: When not in use, equipment and materials will be parked or located a minimum of 500 feet from all runway centerlines or in the areas designated in the Plans.
Minimum Evacuation Distance: The Contractor will evacuate all equipment and personnel from the vicinity of the applicable runway a minimum distance of 250 feet from the runway centerline during landing and takeoff of aircraft.
Open Excavation and Barricades: Open trenches or excavations exceeding 3 inches in depth and 3 inches in width or stockpiled materials will not be permitted within 250 feet of centerline of any active runway. Coverings for open trenches or excavations shall be of sufficient strength to support the weight of the heaviest aircraft operating on the runway or taxiway. Lightweight barricades and/or flagging shall be used to identify the limits of construction near open trenches or excavations. The Contractor shall also light any open trenches or excavations with red lights during hours of restricted visibility or darkness.
