About this file

This is a Conflict of Interest Affidavit form effective July 2024, required for submission with bids or proposals to the State of Maryland for the DVMF-CEM-CH26-EXPANSION Land Clearing project. The affidavit requires all offerors, contractors, consultants, subcontractors, and their employees or agents with authority to control or supervise contract work to disclose any conflicts of interest that could impair their objectivity or render impartial assistance to the State. The form defines conflict of interest as situations where an entity's other activities or relationships could prevent impartial performance, impair objectivity, or provide unfair competitive advantage. Offerors must warrant that no relevant facts or circumstances exist that would create conflicts of interest, except as specifically disclosed in the designated section of the affidavit.

The affidavit further requires offerors to provide immediate written disclosure to the procurement officer if any actual or potential conflict of interest arises after the affidavit date, including detailed descriptions of actions taken or proposed to avoid, mitigate, or neutralize the conflict. Contractors must continue performance until directed otherwise by the procurement officer. The affidavit must be executed under penalty of perjury by an authorized representative and submitted with the bid or proposal. This document is referenced in COMAR 21.05.08.08 and represents a standard compliance requirement for Maryland state and local contracting.
