About this file
This is a Confidential Information Designation Form (Version 1, dated 12/25) issued by Collier County, Florida, Procurement Services Division, for use in the Security Modernization contract opportunity. The form provides proposers and bidders with instructions and procedures to designate specific portions of their submissions as confidential or exempt from public disclosure under Florida law. The document outlines the process for requesting exemptions by completing the form and clearly marking pages or sections containing confidential or trade secret information. No specific response dates, due dates, site visits, bidders' meetings, award dates, or contract terms are referenced in this form.
The form identifies three primary bases for confidentiality designations: Trade Secrets under Florida Statute 688.002 (for information deriving independent economic value from not being generally known), Financial Information under Florida Statute 119.071(1)(c) (for financial statements or information verifying bidder financial adequacy for public works projects, subject to repeal on October 2, 2029), and Proprietary Information under Florida Statute 119.071(1)(f) (for sensitive agency-produced data processing software). The document requires authorized agents to sign an acknowledgment certifying that designated information meets statutory criteria for exemption, with a warning that failure to properly mark or justify exemptions may result in public release of the information. The form does not contain pricing terms, set-asides, incumbent information, or funding details related to the underlying solicitation.
