Performance Work Statement (PWS) Commercial Trucking Solution Contract Vision Statement

The purpose of this solution is to create a unified approach to fulfilling the diverse freight transportation needs for of United States Government throughout Japan.

1 Introduction The Commercial Trucking Solution Contract (CTSC) provides for timely and equitable transportation services throughout Japan (not including Okinawa). CTSC will service multiple transportation offices. Each transportation office has a distinct mission and may operate independent of other transportation offices. Service execution under CTSC will be decentralized, maintained, and operated by various transportation offices. Contract management under CTSC will be centralized and held by the 374th Contracting Squadron at Yokota AB, in Tokyo Japan, unless specific authorities are delegated in writing by the Contracting Officer. Ultimate contractual authority under this contract is held with the Contracting Officer at the 374th Contracting Squadron.

1.1 Background

CTSC represents a broad array of trucking services. Work has historically included General Trucking Services, Reefer Trucking Services, Transportation of ISO Containers, Freight Trucking, Transport of Engines by Air-ride Vehicles, Lowbed Trucking, and Oversize/Overweight Trucking by semitrailers. Previously, this portfolio was not considered in a holistic manner and was therefore fulfilled across a variety of separate contracts and blanket purchase agreements with varying processes and procedures. CTSC is a follow-on acquisition that represents a strategic and unified approach to fulfilling this diverse requirement portfolio. Additionally, as a result of the diverse and independent missions this acquisition historically services, exact times and quantities of future deliveries cannot be known at the time of contract award.

1.2 Scope

CTSC will provide for transportation of freight throughout all of the country of Japan (excluding Okinawa) utilizing fitting commercial trucking solutions to both known point-to-point routes and routes established by transportation offices during contract performance. The scope of this contract can be described by identifying the typical nature of the freight transported and the typical types of trucking used to transport freight.

1.2.1 Nature of Freight

Freight will be generally be described as "dangerous", "hazardous", or "sensitive". When these descriptors are not used, the freight will be described as "general" freight.

1.2.1.1 Sensitive Freight

Consists of any freight which requires a high degree of protection while in transit as designated by the ordering officer. Sensitive freight may include explosives which do not require the GOJ clearance under the GOJ Explosives Control Law (Law No. 149, 4 May 1950, with revisions thereto).

1.2.1.2 Dangerous Freight

Consists of items which are applicable to the following Government of Japan (GOJ) Laws and ordinances must be transported in accordance with such laws and ordinances:

- Fire Defense Law (Law No. 186, 24 July 1948, with revisions thereto)

- Poisonous and Deleterious Substances Control Law (Law No. 303, 28 December 1950, with revisions thereto)

- High Pressure Gas Safety Law (Law No. 204, 7 Jun 1951, with revisions thereto)

- other related laws or ordinances

1.2.1.3 Hazardous Freight

Consists of low explosive, high explosive, or such other materials of explosives listed under the following GOJ laws or ordinances, These items must be transported in accordance with such laws/ordinances:

- Explosives Control Law (Law No. 149, 4 May 1950, with revisions thereto)

- other related laws/ordinances.

1.2.1.4 General Freight

Consists of all types and descriptions other than dangerous, hazardous, or sensitive freight.

1.2.2 Types of Transportation

Freight has historically been transported utilizing the following types of transportation.

1.2.2.1 Flatbed

Flatbed trucks utilized by the Contractor will typically transport loads between 1,000kg and 12,000kg.

1.2.2.2 Van or Wing-Type

Van or Wing-Type trucks utilized by the Contractor will typically transport loads between 1,000kg and 12,000kg.

1.2.2.3 Temperature-controlled (Reefer)

Temperature-controlled trucks, also known as Reefer Trucks, utilized by the Contractor will typically transport loads between 1,000kg and 10,000kg that require specific temperature environments during transport.

1.2.2.4 Low-bed Semitrailer

Low-bed Semitrailers utilized by the Contractor will typically transport loads between 12,000kg and 36,000kg.

1.2.2.5 Multimodal Transportation

Multimodal Transportation occurs when multiple modes of transportation are used to accomplish transport.

Rail: This service consists of truckage from the point of origin to a Japan Freight Rail Company (JFRC) container handling station, railway movement from the origin JFRC container handling station to the destination JFRC container handling station, and truckage from JFRC container handling station to the destination.

Ferry: There may be instances where transport occurs from point that are geographically separated by bodies of water. In these cases, the contractor shall utilize applicable Ferry systems to complete transport.

1.2.3 Transportation of Containers

Truck-tractors with container chassis have historically been utilized to transport various types of containers.

1.2.3.1 ISO Containers

ISO Containers are an enclosed, permanent, reusable, non-disposable, weather-tight shipping conveyance, measuring approximately 8ft x 8ft x 20ft or 8ft x 8ft x 40ft, fitted with at least one door, which can be handled in transit as a unit, or can be mounted and secured on marine, rail or highway transport.

1.2.3.2 Flatrack (platform) Containers

< This section contained symbol(s) that did not export. > Flatrack (platform) Containers are a non-weatherproof platform having neither sides nor a top, but having collapsible ends. The flatrack can be end loaded or top or side loaded. Flatrack containers are convertible to a "knock-down condition (i.e., the ends are collapsed so that the container is flattened in appearance) for delivery purposes. Up to a total of three such flattened or knock-down containers may be stacked together, so that a single chassis may hold a total of from one to three knock-down containers.

1.2.3.3 Government Containers and MILVANs

Government Containers and MILVANs are containers conforming to United States and ISO standards, measuring approximately 8ft x 8ft x 20ft.

1.2.4 Humanitarian Assistance and Disaster Relief

The scope of this contract includes services to respond to requirements in a contingency environment including humanitarian assistance and disaster relief.

2 General Requirements General requirements are issues that are not specifically related to performance outcomes but have an impact on the success of the mission.

2.1 Non-Personal Services

The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.

2.2 Business Relations

The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

2.3 Government Contract Management

2.3.1 Contracting Officer (CO) Operates out of 374th CONS at Yokota Air Base, Japan. The CO will designate personnel authorized to order services. The CO is responsible for ensuring performance of all necessary actions for effective contracting, ensuring compliance with the terms of the contract. The CO is approved for all actions under this contract to the extent of the authority delegated in their Contracting Officer's warrant.

2.3.2 Transportation Officer (TO) authorized personnel to request transportation services. A current list of TOs will be submitted to the Contractor prior to the contract performance start date.

2.3.2 Contractor Contract Management

< This section contained symbol(s) that did not export. > The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. At a minimum, the Contractor shall provide a contract manager (CM) who shall be responsible for managing the performance of work under this contract. The name of this individual and alternate(s) who shall act for the Contractor when the CM is absent shall be designated in writing to the CO. The CM or alternate(s) shall have full authority to act on behalf of the Contractor on all contractual matters relating to the daily operations of the work performed under this contract. The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The CM or alternate(s) shall not perform any other services under this PWS without coordination through the Contracting Officer or designated representative. The CM shall report any problems that are encountered in any work locations.

Third Country Nationals (TCN): The Security Forces on each base control entry to the base. Under certain circumstances, the TCN might be denied entry. It is the Contractors responsibility to coordinate with Security Forces at each base when there is a question about particular circumstance.

2.3.2.1 English Capability

The Contractor shall ensure that the CM and CM alternate(s) possesses good communication skills in English. The CM and CM alternate(s) must be able to communicate verbally and in writing in English. When a non- native English speaker is appointed as a CM or CM alternate, one of the following English certifications is preferable:

1. TOEFL (PBT: score 550 or above, CBT: score 213 or above)

2. TOEIC (score 730 or above)

3. STEP Test (provided only in Japan) (Level semi-1 or above)

2.3.2.2 Removal of Contractor Employees

The Contractor shall utilize only experienced, responsible and capable employees in the performance of this contract. The PCO may require that the Contractor remove from the Government job any of his/her employees who endanger persons or property, or whose continued employment under this contract is inconsistent with the interests of military security.

2.3.3 Subcontract Management

The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement.

2.4 Point-to-Point Distance Calculations

< This section contained symbol(s) that did not export. > The Military Traffic Management Bulletin (MTMB) No. 2, entitled "Official Table of Highway Distances, Japan establishes the kilometer distance between the main gates of loading and unloading installations. For transportation of freight between points not indicated in the MTMB No.2, the Movements Management Branch, Transportation Division, Logistics Readiness Center Honshu, 403rd Army Field Support Brigade, will measure new distance(s) upon request from the shipping Transportation Office, and provide the distance(s) to the requesting Transportation Office and the Contractor for computation of transportation charges.

2.5 U.S. Federal Holidays

2.6 Liabilities

< This section contained symbol(s) that did not export. > The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractors employees and agents in performing under this contract, and the Government shall be indemnified and saved harmless against claims for damage or injury in such cases.

Except when loss and/or damage arises out of causes beyond the control and without the fault or negligence of the Contractor, the Contractor shall assume full liability for any and all goods lost and/or damaged in support of this contract.

2.6.1 Report of Damage, Destruction, Injury or Death:

< This section contained symbol(s) that did not export. > The Contractor shall report all incidents of damage or destruction to property, or personal injury or death to any person, arising out of and during the performance of this contract. For the purposes of this paragraph, the term "property includes equipment, freight, or property of any type whether Government owned or not and the term "Contractor includes the Contractor, its agents, or employees.

Preliminary Report shall be made as soon as practicable after the time the incident occurs. The report may be either verbal or by electronic means.

Final Report shall be submitted, in writing, no later than 96 hours after occurrence of the incident.

3 Performance Requirements The following section specifies the Performance Objectives and Performance Elements for the contract.

3.1 Coordinate and Deliver Freight for United States Forces Japan (USFJ) requesting activities (RA) throughout Japan.

Performance Standards

a) Standard: Completes actions within specified deadlines AQL: Documented non-compliance instances shall not exceed x per month, per ordering officer

b) Standard: Compliant with applicable standards for sensitive/dangerous/hazardous freight requirements AQL: Documented non-compliance instances shall not exceed x per month, per ordering officer

c) Standard: Meets technical specifications for proper trucks/equipment as ordered AQL: Documented non-compliance instances shall not exceed x per month, per ordering officer

d) Standard: No more than (X) validated complaints per Transportation Office AQL: Documented non-compliance instances shall not exceed x per month, per ordering officer

e) Standard: Supports up to XX events per day

f) Standard: Ensures proper stowage of freight AQL: Documented non-compliance instances shall not exceed x per month, per ordering officer

3.2 Ordering

The Contractor shall transport freight as ordered by the ordering officer to meet the established loading and unloading dates and times. An order can be given orally or electronically and confirmed by means of a properly executed Bill of Lading. The ordering officer has broad discretion in determining the level of detail and specificity of individual transportation actions to meet the unique needs of their mission. When an order for services is placed with the Contractor, the ordering officer will typically specify the:

- loading and unloading points

- reporting time and date at loading and unloading points

- size and type of truck or container

- nature of the freight

- estimated weight

- estimated cubic measurement, including quantity

- route requirements, if any

- ferry service requirements, if any

- unique transportation hours (example: 10:00 PM and 6:00 AM)

- use of specific routes

- advanced delivery of Contractor-owned container chassis requirements

3.2.1 Advanced Notification

< This section contained symbol(s) that did not export. > The ordering officer will place an order for service with the Contractor prior to the time frame set forth below. The term "business days used herein covers Monday through Friday excluding United States Federal holidays.

3.2.1.1 One Business Day Advanced Notification

Notice of at least one (1) working day preceding the day service is required is necessary for General, Sensitive, and Dangerous Freight, excluding:

- transport to and from Hokkaido

- intra-prefectural transport under the jurisdiction of one Prefectural Public Safety Commission

3.2.1.2 Three Business Day Advanced Notification

Notice of at least three (3) business days preceding the day service is required is necessary for:

- Hazardous Freight, excluding freight to or from Hokkaido

- Intra-prefectural shipment under jurisdiction of one Prefectural Public Safety Commission

3.2.1.3 Four Business Day Advanced Notification

Notice of at least four (4) business days preceding the day service is required is necessary for:

- Inter-prefectural transport under jurisdiction of more than one Prefectural Public Safety Commission:

- General and Sensitive freight to and from Hokkaido

3.2.1.4 Ten Business Day Advanced Notification

Notice of at least ten (10) business days preceding the day service is required is necessary for:

- Hazardous freight, dangerous freight, and sensitive freight with explosives to and from Hokkaido.

3.2.2 Cancellation

< This section contained symbol(s) that did not export. > Cancellation charges shall be applied when service is scheduled and the requirement is cancelled, rescheduled or postponed on the day of the performance, whether or not the Contractors truck has been placed at the freight loading point. In the case when the truck is held after the expiration of the free time, the Contractor shall not be paid the demurrage charge in addition to the cancellation charge.

In the event the service is scheduled and the requirement is cancelled after the Contractor has obtained all clearances for transportation of hazardous freight from the Public Safety Commission(s) of GOJ, the Contractor shall be entitled to cancellation charge by submitting evidence to the ordering officer. This "hazardous freight cancellation charge is in addition to the cancellation charge payable under the provisions of Paragraph 11.1 of this PWS. However, the cancellation charge shall not accrue when the transport is rescheduled or postponed due to military necessity within the allowable period of the clearance certificate.

3.2.3 Tolls and Paid Parking

The ordering officer may specify usage of certain routes that include toll roads and paid parking lots.

3.3 Loading and Unloading

All freight shall be loaded and unloaded by the Government. However, the Contractor shall not be relieved from the responsibility for the proper stowage and securing of freight against loss, damage, or spoilage while freight is in transit.

3.3.1 Stuffing, Unstuffing, Mounting and Dismounting of Containers < This section contained symbol(s) that did not export. > Stuffing, unstuffing, mounting, and dismounting of containers shall be performed by the Government. However, the Contractor shall not be relieved from the responsibility for the proper stowage and securing of freight against loss or damage while in transit. As required, the Government reserves the right to reposition the Contractors chassis while performing stuffing, unstuffing, mounting or dismounting on a Government Installation.

3.3.2 Loading and Unloading Time

The Contractor shall provide no less than three (3) hours for loading and no less than three (3) hours for unloading of freight at no additional cost to the Government. Loading and unloading time begins at the time transport arrives or is placed by the Contractor at the freight loading or unloading point within each installation and notice is given to and acknowledged by the ordering officer or designated representative. Pre-cooling for loading shall not be included in the free time for Reefer Trucking Services.

3.3.2.1 Loading and Unloading Time for Containers

The Contractor shall provide a twenty-four (24) hour period for loading and unloading of containers at no additional cost to the Government. Loading and Unloading time begins from the time a container chassis is detached from truck-tractor and placed at a freight loading or unloading point and notice is given to and acknowledged by the ordering officer or designated representative.

3.3.2.1.1 Delayed Loading and Unloading for Containers

If stuffing or unstuffing cannot be completed within the allowable time, at the discretion of the ordering officer, the container may be off-loaded from the truck and left at the Government installation, and the truck will be released. In this case, stuffing and unstuffing shall normally be completed within two (2) calendar days of the date of transport (including date of the delivery).

3.3.3 Demurrage

< This section contained symbol(s) that did not export. > If through no fault of the Contractor, transport is not dispatched or discharged and released after the allowable loading time has expired, the Contractor shall be entitled to demurrage for detention of transport beyond the allowable time allotted to the Government. The Contractor shall submit a request for demurrage to the ordering officer within thirty (30) calendar days following date of demurrage. In the event the Contractor fails to submit a timely request for demurrage, the Government shall be relieved from all responsibility unless the Contractors delay in submitting its request is due to circumstances beyond the Contractors control, as determined by the Contracting Officer.

3.4 Bill of Lading

An order can be given orally/electronically and confirmed by means of a properly executed Bill of Lading. The ordering officer shall provide an original BL to the Contractor in exchange for the signed receipt of transport documents (e.g., DD Form 1384, Transportation Control and Movement Document/Supporting Document) within 15 calendar days after the transport is completed and documentation is submitted. In the event of original BL is known to have been lost, rendered unusable, or destroyed after the original BL is issued, a Certificate in Lieu of Lost Bill of Lading (USFJ Form 376EJ) shall be used to document the shipment. The ordering officer will typically describe the characteristics of the order in in the remarks section of the Bill of Lading:

- specific terms and conditions

- size and type of truck or container

- specific route ordered

- any applicable accessorial services or unique circumstances associated 4 Special Requirements

DEFAULT TEXT:

This section describes the special requirements for this effort. The following sub-sections provide details of various considerations on this effort.

4.1 Security

< This section contained symbol(s) that did not export. > Installation Base Passes: For access to US Installations, the US Government will issue all required Gate Passes/Vehicle Passes to Contractor personnel at no cost to the Contractor. To obtain passes, the Contractor is required to submit documents in accordance with each installation instruction. The prime Contractor shall be responsible for all passes issued to his/her own or his/her subcontractors employees under this contract. The Contractor shall return all applicable passes upon termination of employment or completion of this contract to the Installation Pass Office.

Gate Passes: In order to obtain Gate Passes, the Contractor may be required to:

- complete application forms (forms may vary depending on each installation)

- make appointments at the Installation Pass Offices

- submit certificate(s) of residence, abstract(s) of family registers, and photo ID(s) Vehicle Passes: In order to obtain Vehicle Passes, the Contractor shall submit the proof of valid liability insurance that must cover the automobile liability insurance in the types and minimum amounts of

(i) Bodily Injury - ?30,000,000 per person per occurrence, in addition to the Japanese Compulsory Insurance (JCI)

(ii) Property Damage - ?3,000,000 per occurrence.

4.2 Transition

The contractor shall follow the transition plan submitted as part of the proposal and keep the Government fully informed of status throughout the transition period. Throughout the phase-I and phase-out periods, it is essential that attention be given to minimize interruptions or delays to work in progress that would impact the mission. The contractor must plan for the transfer of work control, delineating the method for processing and assigning tasks during the phase-in/phase-out periods.

4.5 Applicable Directives

The contractor shall comply with all documents listed below as mandatory and referenced under paragraph 3.0, Performance Requirements. Compliance with documents listed as non-mandatory is the contractors' option.

4.6 Quality Assurance Surveillance Plan (QASP)

The Government shall monitor the Contractor's performance under this contract in accordance with the Government's QASP.

4.7 Prefectural Clearance for Hazardous Freight

< This section contained symbol(s) that did not export. > Prior to transporting Hazardous Freight, the Contractor shall obtain a GOJ clearance from the Prefectural Public Safety Commission responsible for the area from which the explosives are shipped, and it must be carried when the explosives are being transported. In addition, the Government shall provide special (safety) instructions including truck inspection to the Contractors driver(s) prior to releasing the truck loaded with explosives. Written instruction and inspection shall be in English and Japanese to ensure driver(s) fully understand its contents. As defined in the GOJ Explosives Control Law, the following Items shall not require the GOJ clearance based on net explosive weight (NEW) or quantities specified below.

4.7.1 Exemption from Prefectural Clearance for Hazardous Freight As defined in the GOJ Explosives Control Law, the following Items shall not require the GOJ clearance based on net explosive weight (NEW) or quantities specified below:

- Low explosives: NEW of 200 kilograms or less.

- High explosives: NEW of 100 kilograms or less.

- Blasting caps, electric and non-electric: 40,000 each or less.

- Small arms primer: 400,000 each or less.

- Detonating cord: 6 kilometers length or less.

- Live or blank small arms ammunition (SAA) NEW of 0.5 grams or less per round: 400,000 each or less.

- Live or blank SAA NEW of over 0.5 grams per round: 200,000 each or less.

- Other explosive materials not listed above: NEW of 100 kilograms or less.

Items exempted from Prefectural Clearance for Hazardous Freight shall be described as Sensitive Freight. However, the Contractor shall still follow procedures in accordance with the laws and ordinances related to Hazardous Freight.

4.7.1.1 Transporting multiple items on the exemption list for Prefectural Clearance for Hazardous Freight In circumstances where the allowable percentage across multiple items on the exemption list exceed 100% on a single truck, GOJ Prefectural Clearance must be obtained prior to transport and the items shall be identified as the Hazardous Freight.

4.8 Special Requirement for Government Security Guards

The Government reserves the right to furnish security guards or military police escorts for any or all vehicles while the vehicles are engaged in the performance of services under this contract. The Contactor shall, if required by the ordering officer, to permit one (1) security guard or escort to ride on any or all of the vehicles, at no additional charge. In the event a security guard is used, the Contractor is not required to return him/her to the loading point. In the case of Dual Driver Protective Service, the Government will provide transportation for the alternate driver.

4.9 Dual Driver Protective Service (DDP)

< This section contained symbol(s) that did not export. > Any truck transporting sensitive or hazardous freight shall be manned by two (2) drivers possessing applicable drivers licenses. The truck loaded with the sensitive or hazardous freight shall be attended by at least one of the two drivers in the cab of the truck and not in a sleeper berth or within 25 feet of truck at all the time during brief stops when required. If security clearance is not attainable, the contractor shall coordinate with the ordering officer and they will provide a security escort vehicle or have an escort in the transportation truck. In conjunction with DDP, both drivers are required to sign DD Form 1907 when they assume responsibility for the shipment.

4.9.1 Hazardous or Dangerous Freight to or from Hokkaido

For transportation of JFRC 5-ton container stuffed with hazardous or dangerous freight to or from Hokkaido, the Contractor shall furnish trucking service between JFRC Higashi-Aomori station, Aomori Prefecture and JFRC Hakodate Kamotsu station, Hokkaido, via ferry between Aomori Port and Hakodate Port.

4.10 Special Requirements for Temperature-controlled Freight

In the case a mixed loading shipment is ordered, the Contractor shall confirm that an endorsed shipping document (e.g., DD Form 1384: Transportation Control and Movement Document/Supporting Document) specifies the cargo unit temperature to maintain. Failure to do so may cause a deficiency in maintaining required temperature.

4.11 Special Requirements for Multimodal Transportation

Rail: For JFRC Container shipments utilizing multimodal transportation, contractors shall perform loading and off-loading operations at JFRC container handling stations. JFRC container handling stations shall be any JFRC stations such as rail stations and off rail stations which are available for JFRC 5-ton container handling services. In addition, the Contractor shall stop at other Government installations located in the vicinity of the origin or destination Government installations for partial stuffing or unstuffing when required by the ordering officer.

Ferry: For freight transport by Ferry, there may be instances where the size and type of freight limits available ferry routes. In these cases, the Contractor shall inform the ordering officer of any changes from the route that was order prior to making adjustments to the transport route.

4.12 Special Requirements for Container Transportation

When transporting containers, the Contractor may be required to transport filled or empty containers from origin point to destination point and return the filled or empty container to the origin point as designated by the ordering officer. The Government will maintain liability for costs until the container chassis is detached from a truck-tractor at loading or unloading points, as required by the ordering officer.

4.13 Japanese Tax Exemption

< This section contained symbol(s) that did not export. > The basis whereby US Armed Forces obtain exemption from Japanese taxes are prescribed in paragraph 3, Article XII of the Status of Forces Agreement under Article VI of the Treaty of Mutual Cooperation and Security between the U.S. and Japan.

The Contractor must submit requests for issuance of tax exemption certificates in a timely manner to the Tax Exemption Certifying Officer not later than 365 calendar days after receipt of an original Bill of Lading. The Contractor shall also submit a certified statement to the Tax Exemption Certifying Officer for claiming deadhead distances for each ordered service during the performance period. The Contractor shall not include deadhead distance for trucks that are owned or used by a third party as this service is not considered for official use for fuel tax exemption purposes. The Tax Exemption Certifying Officer will review the accuracy of the Contractors figures on fuel consumption prior to issuance of appropriate tax exemption certificate.

The Contractor shall be responsible for submission of the following documents to the Tax Exemption Certifying Officer; mailing address is 252-8511 Kanagawa-ken, Zama-shi, Camp Zama, ATTN: ASKO-LCZ-TRM (Movements Management Branch, Transportation Division, LRC Honshu, 403rd AFSB) for verification and issuance of fuel tax exemption certificates under this contract.

- Fuel consumption ratios of truck or unit by size.

- Accurate lists of all trucks to be used under this contract with copies of vehicle inspection certificates, and other information if required.

4.13.1 Transport for Non-Appropriated Funds Offices

When the transportation services are performed for ordering officers utilizing Non-Appropriated Funds, consumption tax is not exempted under the Status of Forces Agreement (SOFA).

4.14 Special Requirements for Non-conforming Transport

If the Contractor furnishes a larger truck size than what was ordered due to non-availability of the ordered size, payment will be made on the basis of ordered size of truck.

4.15 Special Requirements for Loan of Contractor-owned Container Chassis The ordering officer may request 20ft or 40ft container chassis be delivered by the Contractor for the Government to place a Government-owned/controlled ISO container/MILVAN at the designated Government installation in advance of actual transport for up to thirty-five (35) calendar days.

4.16 Special Requirements for Forklift or Truck-Mounted Crane Services The Contractor may be required to provide forklifts or truck-mounted cranes with operator(s) and slinging work crew as ordered by the ordering officer to assist with loading freight

4.17 Special Requirements for Retention of Transport

When specifically scheduled by the ordering officer, the Contractor may be required to leave loaded or stuffed freight at a designated Government installation for any length of period between 04:45 PM and 08:00 AM hours.

4.18 Special Requirements for Repetitive Orders on Previously Undetermined Routes < This section contained symbol(s) that did not export. > When repetitive orders are required for a specific service under unestablished routes, upon written request of either the Contractor or the Government, the route shall be incorporated into the "point to point pricing schedule by way of a supplemental agreement to the contract.

5 Deliverables
