This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

proposals are being requested and a separate written solicitation will not be issued.

The 159th Fighter Wing requests a quote of the item/service below in accordance with (IAW) Statement of Work. All pricing shall include delivery costs. This acquisition is being procured utilizing PSC 2330 Trailers and NAICS 336212 Truck Trailer Manufacturing. A single award will be made as a result of evaluation of quotes received. This requirement is being set-aside for small business IAW FAR 19.501.

INSTRUCTIONS TO OFFERORS: ADDENDUM TO FAR 52.212-1

1. Quote Preparation:

1.1. To assure timely and equitable evaluation of quotes, Offerors must follow the instructions contained herein. Failure to meet a requirement of these instructions may result in a quote being determined to be non-conforming to the solicitation and may be determined unresponsive. By submission of its quote, the Offeror agrees to hold the prices firm for 90 days from receipt of offer.

1.2. Quotes shall be submitted using this solicitation document and are encouraged to include an attachment for contracting officer to determine if offer complies with specifications found in this document and the statement of work (SOW). Attachments shall be no more than 10 pages in total. All proposals at a minimum shall include the following information.

• Dated and signed by an official with the authority to bind your company

• The solicitation number

• The time specified in the solicitation for receipt of quotes

• The name, address, and telephone number of the vendor

• CAGE code, UEI number,

• A description demonstrating a detailed understanding of the items/service being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. To ensure that sufficient information is available for evaluation, the offeror shall furnish descriptive material (technical information, brochures, drawings, or other information) necessary for the contracting officer to determine whether the product/service offered meets the salient characteristics of the requirement. Offerors are encouraged to provide photos of quoted items. Offerors non-conforming to the salient characteristics of the solicitation may be determined unresponsive

• Acknowledgement of solicitation amendments if applicable

1.3. Failure to include all information listed in 1.3 above may render a vendor’s quote as unresponsive or non-conforming to the solicitation and may not be considered for evaluation.

1.4. Offerors shall not include separate shipping or transportation fees. Unless explicitly requested otherwise, all shipping will be Free-on-Board (FOB) Destination. Inclusion of separate shipping or transportation fees may render a vendor’s quote as unresponsive or nonconforming to the solicitation and may not be considered for evaluation.

2. Submission Requirements:

Addendum 52.212-2 Evaluation—Commercial Products and Commercial Services.

1. The Government intends to award a contract resulting from this solicitation in accordance with the procedures in Federal Acquisition Regulation (FAR) Part 12 and Part 13 to the responsible vendor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors may be used to evaluate offers: price and delivery schedule. The Government may conduct clarifications with one, some, none or all vendors at its discretion.

2. The U.S. Government has an urgent need for these items and will consider delivery schedules as an evaluation factor for this solicitation. However, Offerors shall provide only delivery schedules they can meet as all delivery schedules will be scrutinized for realism prior to award being made. Failure of awardee to meet proposed delivery schedule will result in consideration being sought by the U.S. Government and may result in contract termination.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
