ADDENDA TO FAR 52.212-2:
BASIS OF AWARD
1. This is a competitive acquisition in accordance with FAR Part 12 and Part 13. The Government will submit an offer in the form of a contract to the Quoter that represents the best value to the Government. All quotes submitted will be reviewed for completeness. Quotes that are incomplete or missing information may be considered non-responsive and excluded from the evaluation. The Government will select the awardee that represents the best value based on price, technical, and past performance.
a. Price Evaluation: The Government will rank all offers by Total Evaluated Price (TEP).
The TEP will be calculated by multiplying the unit price by quantity to confirm the extended amount quoted for the CLIN. All pricing shall be rounded to the nearest dollar.
The total proposed price will be evaluated for fairness and reasonableness IAW FAR 13.106-3(a). If there is a conflict between the quoted unit price and the extended amount, the unit price shall be used to determine the TEP. The lowest price quote may not necessarily be selected.
b. Technical Evaluation: The quote with the lowest Total Evaluated Price (TEP) will be evaluated for Technical Acceptability and assigned a rating of "Acceptable" or "Unacceptable," based on the evaluation team’s review of the proposed product’s salient characteristics compared to the requirements identified in this solicitation.
If a quote DOES NOT clearly demonstrate that it meets all mandatory minimum salient characteristics and requirements of this solicitation, the quote will be rated "Unacceptable."
Unacceptable quotes will no longer be considered for award, and evaluation for that Quoter will stop. If the quote is rated as "Acceptable," the quote will next be evaluated for Past Performance.
c. Past Performance Evaluation: Past performance information will be based on information gathered using the Offeror's Unique Entity Identifier (UEI) code, obtained through the System for Award Management (SAM) at sam.gov, and in accordance with DFARS 252.204-7024, Notice on the Use of Supplier Performance Risk System (SPRS) (Mar 2023). The Government reserves the right to utilize any source to verify past performance.
The Quoter's past performance will be rated as either "Acceptable," "Unacceptable," or "Neutral" based on the following criteria:
• Acceptable: The Offeror's SPRS record reflects a generally positive performance history, demonstrating a consistent record of successful contract completion, on-time delivery, and adherence to quality standards. To receive an "Acceptable" rating, the Offeror's SPRS record should, at a minimum, show no instances of significant negative performance (e.g., major quality defects, termination for default) within the past three years.
• Unacceptable: The Offeror's SPRS record reflects a history of unsatisfactory performance, late deliveries, poor quality, failure to meet contractual requirements, or significant negative performance indicators within the past three years. This includes Formal Cure Notices or Show Cause Letters related to performance, Termination for Default or Cause, significant quality defects requiring extensive rework, late deliveries that significantly impacted project schedules, and unresolved disputes or claims.
• Neutral: If the Offeror does not have a record of past performance in SPRS under the Product Service Code (PSC) of the items being purchased, or if the available past performance data is not relevant to the scope and complexity of this procurement, the Offeror will receive a "Neutral" rating. A neutral rating will not be evaluated favorably or unfavorably. Offerors with a neutral rating will not be penalized. A neutral rating does not guarantee award.
The Government reserves the right to use any past performance history source for verification, including but not limited to: interviews with past customers, Contractor Performance Assessment Reporting System (CPARS), and other publicly available information. In cases where information from SPRS conflicts with other sources, the Government will consider all available information to determine the most accurate assessment of the Offeror's past performance. The government has the final authority to make a determination.
2. If the lowest-priced-technically acceptable quote is judged to have an “Acceptable” past performance assessment rating and is determined to be responsible, that quote represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that Quoter without further consideration of any other quotes.
3. The Government reserves the right to award on an "All, Some, or None" basis.
4. Discussions. The Government intends to award a purchase order without discussions with respective Quoters. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
The clause at FAR 52.212-4, Contract Terms and Conditions—Commercial Items (Dec 2022), and the addenda listed below applies to this acquisition:
ADDENDA TO FAR 52.212-4
