The Contractor shall be responsible for determining exact acreages, minimum/maximum number of mowings, and time allowed to complete required services and conditions affecting performance of work. Many areas consist of slopes, rocky terrain and wooded areas, and may require an extensive amount of trimming and hand mowing where larger mowers cannot maneuver satisfactorily. Trimming shall include the removal of sprouts and heavily weeded growth. Prospective bidders are encouraged to visit and fully inspect all areas, accesses, locations, terrain, etc. prior to bidding. The Government shall not be held accountable for conditions at the site which were not taken into account by prospective bidders. All mowing and trimming shall be completed in an area prior to moving to another area.
1.2. Background: Park mowing & trimming procurements utilized by the Pomme de Terre Lake Project, Kansas City District, encompass mowing and trimming services necessary to maintain the west side section of parks as specified. The procurement includes limited amounts of cutting by hand where obstructions or steepness prevent access by machinery. Trimming around signs and buildings, trees, campsites, and park equipment will be required.
1.3. Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four
(4) 12-month option years. Actual mowing and trimming services shall be performed from 1 April through 30 September in accordance with contract schedules during the periods listed below:

1.4. General Information
1.4.1. Quality Control: Quality Control is the Contractor’s responsibility. The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The Contractor shall submit a copy of their quality control plan (QC Plan) to the Contracting Officer’s Representative (COR), for approval prior to the start of work. See Attachment 10 Quality Control Plan Template/Example. After acceptance of the quality control plan the Contractor shall receive the COR’s acceptance in writing of any proposed change to his QC system.
1.4.2. Quality Assurance: The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the maximum acceptable defect rate(s).
1.4.3. Unsatisfactory Performance: If any of the services do not conform to contract requirements, the
Government may request the Contractor to perform the services again, where appropriate, in conformity with contract requirements, at no increase in contract amount. The Contractor will have 24 hours from the time of notification of the deficiency to make the correction. When the defects in services cannot be corrected by re-performance, the Government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements, and (2) reduce the contract price to reflect the reduced value of the services performed.
1.4.4. Recognized Holidays: The Contractor will not be required to work on the following Federal
Holidays.
New Year’s Day Labor Day Martin Luther King Jr.’s Birthday Columbus Day Presidents’ Day Veterans Day
Memorial Day Thanksgiving Day Juneteenth Christmas Day
Independence Day
1.4.5. Hours of Operation: The Contractor is responsible for conducting these services, between the hours of 7:00 AM and 8:00 PM CST, except no service shall be performed beyond park entrance booths before 8:00 AM nor after 6:00 PM CST, Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Work will not be permitted on Saturdays, Sundays, or holidays unless this restriction is specifically waived in writing by the COR. The Contractor must always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.4.6. Inclement Weather Schedule: In cases of severe weather, heavy rain, or park closure, the Contracting Officer of the Contracting Officer’s Representative (COR) may authorize exceptions.
When exceptions are granted, all mowings shall be performed within 24 hours after the severe weather or park closure has terminated and/or when ground conditions are once again suitable for mowing activity as determined by the COR, unless the Contracting Officer or the COR authorizes additional time. It is the Contractor’s responsibility to notify the Contracting Officer when they are not able to perform services due to inclement weather.
1.4.6.1. This is a flood control project. Occasional retention of floodwaters may inundate portions of the public use areas, other areas, or access roads thereto, being serviced by this contract. In the event that inundation materially affects the scope of work, the Contractor will be requested to submit a pricing proposal covering the unserviceable or affected portion of work in order that an equitable adjustment to contract price can be negotiated and an adjustment made in accordance with the appropriate contract clause entitled “Changes.” Payment for services not performed as a result of conditions stated above will be initially withheld until execution of an equitable adjustment can be made by contract modification.
1.4.7. Access Across Project Highway Bridges: The roadway over various highway bridges on Pomme de
Terre Lake may be closed from time to time during the life of this contract. Closures could sometimes last several months under certain construction or maintenance circumstances. The
Contractor should be prepared to take an alternate route during these times at no additional cost to the Government.
1.4.8. Security Requirements: The Contractor performing work under this contract must comply with the requirements of the Antiterrorism/Operations Security Requirements (AT/OPSEC). See Attachment 3 of this PWS.
1.4.8.1. Physical Security: The Contractor shall be responsible for safeguarding all Government equipment, information and property provided for Contractor use.
1.4.8.2. Key Control: The Contractor shall establish and implement methods of making sure all keys issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.
1.4.8.2.1. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks;
however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
1.4.8.2.2. The Contractor shall prohibit the use of Government issued keys by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.
1.4.9. Required Insurance: Contractors shall obtain and maintain all appropriate commercial liability and workman’s compensation insurance as required in accordance with Federal and State requirements.
Reference FAR clauses included in this contract for further guidance on insurance requirements.
1.4.10. Post Award Orientation/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officer’s Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the COR will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
1.4.11. Documents and Correspondence: After award, all documents and related correspondence shall be routed to the Contracting Officer; or through the Contracting Officer’s Representative (COR) at the Project Office to the Contracting Officer. Day to day contact and telephone communication with Government personnel shall normally provide adequate information exchange. The Government reserves the right to schedule meetings at the Project Office as necessary to ensure strict compliance with the terms of this contract. Such meetings shall be scheduled, to the extent possible, at mutually convenient times. However, upon notice, the Contractor shall attend meetings regarding matters affecting this contract, and the time spent in such meetings shall be at no additional charge to the Government.
1.4.12. Key Personnel: The Contractor shall provide a contract manager who shall be responsible for the performance of the work. This person may be the Contractor themselves or someone that they choose to designate. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing in the QC Plan to the Contracting Officer. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract.

Pomme de Terre Lake Project Office. The contractor shall commence mowing on the date and time specified in the written order. Orders will not be placed less than 72 hours prior to the date that mowing services are ordered. It is anticipated that orders will likely be issued for accomplishment of services to be completed prior to the Memorial Day, Independence Day and Labor Day holidays/holiday weekends.
