The United States Department of Agriculture (USDA), National Institute of Food and Agriculture (NIFA), Institute of Youth, Family and Community (IYFC), Division of Youth and 4-H, (DY4-H), has the need to acquire Flag Stands in support of the National 4-H conference.
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The reference number for this acquisition is #1232SA24Q0063 and it is being issued as a Request for Quotes (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-03 (effective 23 Feb 2024).
Please prepare a quote to include the Business Name, Business POC (name, e-mail & phone number), Unique Entity Identifier (UEI), and CAGE code.

3. Brief Description of Supply: The United States Department of Agriculture (USDA), National Institute of Food and Agriculture (NIFA), Institute of Youth, Family and Community (IYFC), Division of Youth and 4-H is looking to replace the current wooden flag stands that with aluminum floor stands that have a wooden overlay with a dark cherry stain to blend in with the stage. They will be displayed for the duration of the conference; the new stands will last for years to come and be of a sturdier material than the current wooden stands.
4. Type of Contract: The contracting activity intends on awarding a single award, firm fixed price, purchase order
(PO) under FAR part 13 Simplified Acquisition Procedures.
5. Commercial Supplies: The supplies specified in this order have been determined to be commercial (FAR 12 Acquisition of Commercial Products & Commercial Services).
6. Contracting Officer: The Contracting Officer (CO) has the overall responsibility for the administration of this contract. The CO alone, without delegation, is authorized to take actions on behalf of the Government to amend, modify or deviate from the contract terms, conditions, requirements, specifications, details and/or delivery schedules; issue task orders against the contract; make final decisions on disputed deductions from contract payments for nonperformance, or unsatisfactory performance; terminate the contract for convenience or default; and issue final decisions regarding contract questions or matters under dispute.

9. Non-Excepted Activity: Work under this contract has been determined NOT TO BE an Excepted Activity in the absence of an appropriation or CR. Activities under this contract do not support the preservation and protection of life and property and do not support law enforcement, health and safety functions. In the event of shutdown, you will be notified by the cognizant contracting officer (CO) of the Government status and directed to suspend performance/stop work under this contract. For details on the procedures, see Federal Acquisition Regulation (FAR) Clause 52.242-14, Suspension of Work or FAR Clause 52.242-15, Stop Work Order, as included in this contract.
10. Invoices: To invoice, a vendor must first enroll in the Invoice Processing Platform (IPP) by visiting https://www.ipp.gov/vendors/index.htm. Once enrolled, all invoices must be submitted electronically through IPP. The IPP is a government-wide secure web-based payment information service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service
(FMS).
Invoicing & Payment – Government will make payments to the vendor when invoice is received and accepted by the Contracting Officer or designated Contracting Officer’s Representative (COR).
E-mail notifications of payments are sent when a payment is distributed to your bank account and will include all pertinent payment information. The IPP Customer Support Desk is available to assist users Monday through Friday (excluding bank holidays) from 8:00AM - 6:00PM ET, including answering any questions related to accessing IPP or completing the registration process. Invoice Preparation
In accordance with FAR 52.212-4(g)(1), the contractor shall submit an electronic invoice to the address designated in the contract to receive invoices. The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). The contractor must follow the instructions on how to register and submit invoices via IPP as prescribed. All invoices are to be submitted via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm. Please make sure that your company has registered at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account.
The Contractor shall submit invoices for the work under the contract in accordance with the information below.
The Contractor shall, at a minimum, include the following information to comply with the proper invoice submission procedures identified in FAR 52.212-4:
1. Name and address of Contractor;
2. Invoice date and number;
3. Contract number.
4. Description and cost of items delivered.
5. Shipping number and date of shipment or dates the services were provided;
6. Terms of any discount for prompt payment offered;
7. Name and address of official to whom payment is to be sent (VID number);
8. Name, title, and phone number of person to notify in event of defective invoice;
9. Taxpayer Identification Number (TIN) (if required elsewhere in contract). Electronic funds transfer (EFT) banking information – Vendor Express Payment (VXP) number.

(d) COMPTROLLER GENERAL EXAMINATION OF RECORD. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

This memorandum approves a class deviation from the Federal Acquisition Regulation (FAR) to implement the threshold increase at 13 CFR 124.104(c)(2).
Authority: This class deviation is issued under the authority of FAR 1.404 and through consultation with the Chair of the Civilian Agency Acquisition Council (CAAC) via the CAAC Letter 2023-02.
Background: This class deviation implements the Small Business Administration’s (SBA) interim final rule published on November 17, 2022 at 87 FR 69118, effective December 19, 2022, which increased the net worth threshold from $750,000 to $850,000 for an individual to be eligible as an economically disadvantaged small business concern.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services— Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. (a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

(a) Definitions. As used in this provision—
Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
Federal contracts and grants with total value greater than $10,000,000 means—
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

STATEMENT OF NEED/SPECIFICATIONS
NIFA 4-H Flag Display Stands
1.0 BACKGROUND
The United States Department of Agriculture (USDA), National Institute of Food and Agriculture (NIFA), Institute of Youth, Family and Community (IYFC), Division of Youth and 4-H, (DY4-H), located at 1400 Independence Avenue, SW, Washington, DC, 20250, is the liaison for USDA to the National 4-H Program and is a sponsor of the National 4-H conference each year. During the conference various flags are displayed on the presentation stage for the duration of the event. This includes the American flag, the USDA flag, the National 4-H flag, 56 flags of the United States, its Territories and the District of Columbia, the six branches of the US Military (Army, Navy, Air Force, Marines, Space Force, Coast Guard) and various Native American Tribal Nation flags.
2.0 GENERAL SCOPE
IYFC, DY4-H is looking to replace the current wooden flag stands that have been patched and repaired numerous times. The new flag stands are to be constructed in a light weight and durable material. 80 flags in total are to be displayed in a single line at the rear of the stage.
3.0 PRODUCT SPECIFICATIONS
This supply procurement will include (equipment purchase only):
Specifications:
o Quantity: 8 flag stands.
o Each flag stand should display 10 flags in a single linear row.
o The holes should accommodate flag poles of 1 1/8", and 1 1/4" diameter.
o The material of the flag stands can be solid wood, metal, or metal with a wood overlay.
o Color: If Solid Wood (Walnut)/Wood Overlay (Walnut) and if Metal (Black).
o Dimensional Restriction: Length not to exceed five feet (60 inches).
o The stands should be easy to store and transport by cargo van.

No incidental services are included.
6.0 DELIVERY AND INSTALLATION
The Contractor shall provide delivery to USDA offices in Washington, DC by April 15, 2024.
Installation and set-up of equipment are not needed. Bases will be delivered to the receiving dock at the USDA Headquarters by either freight company or Contractor delivery.
