COMBINED SYNOPSIS/SOLICITATION

(8/25/2023)

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(ii) The Request for Quotation (RFQ) number FA445223Q0035 shall be used to reference any written quote provided under this RFQ.

(iii) The RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-04; Effective 6/2/2023.

(iv) This is a 100% set-aside for Small Businesses (SB). The North American Industry Classification System (NAICS) code for this project is 449121 with a size standard of $8M.

(v) The purpose of this combined synopsis and solicitation is for Fitness and Aquatic Training Facility Floor Replacement and Installation as described in the Statement of Work (SOW). The Quote and Contract CLIN Schedule are attached.

(vi) Description of the requirement: The description of the requirement is provided in the attached SOW. The period of performance to complete the project is 90-days after contract award.

(vii) Place of Performance: Pope AAF, NC

(viii) FAR Provision 52.212-1, Instructions to Offerors – Commercial Products and Commercial Services (Mar 2023) applies to this acquisition and the following addendum applies:

The following words stating “offer”, “offeror”, and “proposal” are replaced with “quotation”, “vendor”, and “quote.”

Paragraph (b)(4) is revised as follows:

The Vendor shall submit a Relevant Experience document, limited to no more than a 3-pages, on their relevant experience providing flooring installation services that are the same or similar to those required in the SOW.

Relevant experience can either be at federal, state, or local government levels, or within the private sector. When documenting relevant experience, include: 1) name of the Government agency or company to which services were provided to; 2) Government contract number (if applicable); 3) POC with contact information at the agency or company where services were provided; 4) narrative detailing how the previous experience is relevant to SOW requirements.

Paragraph (b)(6) is revised as follows:

The Vendor shall submit the attached Quote and Contract CLIN Schedule with their quote submission.

Paragraph (b)(12) is added as follows: Additional information required:

All companies must be registered in the System for Award Management at https://sam.gov/content/home to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instruction shall be provided at time of award.

(ix) Pursuant to FAR 12.602, contract award will be made using Simplified Acquisition Procedures in accordance with FAR 13.106. Vendor’s submissions will be evaluated based upon the following:

Basis for Award

1. Price will be evaluated to determine if it is fair and reasonable in accordance with FAR 13.106-3.

2. Relevant Experience will be evaluated and assigned one of three available Confidence Ratings:

High Confidence The Government has high confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements with little or no Government intervention.

Some Confidence The Government has some confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements with some Government intervention.

Low Confidence The Government has low confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements even with Government intervention.

Award will be made on a best value basis considering price and relevant experience.

(x) FAR Provision 52.212-3, Offeror Representations and Certifications – Commercial Products and Commercial Services (Dec 2022) Alternate I (Oct 2014) applies to this acquisition. All vendors must be registered in System for Award Management at https://sam.gov/content/home at the time of Quote submittal. Provisions applicable to this RFQ will be reviewed and verified in SAM.gov, vendors are responsible for updating all applicable provisions prior to submission of their quote.

(xi) FAR clause at 52.212-4, Contract Terms and Conditions – Commercial Products and Commercial Services (Dec 2022), applies to this acquisition with the following Addendum:

Paragraph (c) of this clause is tailored as follows:

Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.

Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

The following AFFARS Clause is applicable to this acquisition:

5352.201-9101 AFICC-WP Ombudsman 10/1/2019

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Mr.
