Combined Synopsis/Solicitation
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The Request for Quotation (RFQ) number FA481420TF166 shall be used to reference any written quote provided under this RFQ.
The RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-07; Effective 31 August 2020.
This is a small business set aside..
This is a Brand Name or Equal requirement.
The North American Industry Classification System (NAICS) code for this project is 336413 with a size standard of
1,250 EMP.
The purpose of this combined synopsis and solicitations for the purchase and delivery of Bauer Torque Machine OR EQUAL in accordance with the attached Statement of Need (SON). The bid schedule and contract CLIN structure are below:

The Government reserves the right to cancel this RFQ, either before or after the closing date. In the event the Government cancels this RFQ, the Government has no obligation to reimburse a vendor for any costs. *****
BASIS FOR AWARD:
This solicitation has been designated as Brand Name or Equal IAW FAR 52.211-6. A technical advisor will compare an offerors proposed equipment list and technical solution against the brand names salient physical, functional, or performance characteristics to determine technical acceptance. “Equal” products will be evaluated by a technical advisor for compatibility/functionality review and rated IAW Table A-1 (as provided below).
Documents submitted in response to this solicitation must be fully responsive to and consistent with the following: Proposed equipment list and technical solutions will be evaluated to ensure they are complete Solutions and the technical capability of the items offered meet the intended need conveyed in the Statement of Work.
Table A-1. Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Quote offers product/s that are brand name or equal as defined in FAR 52.211-6 and meet the intended need conveyed in the Statement of Need.

*FAR Provision 52.212-1, Instructions to Offerors – Commercial Items (Jun 2020) applies to this acquisition and the following addendum applies:
The following words stating “offer”, “offeror”, and “proposal” are replaced with “quotation”, “vendor”, and “quote”.
Paragraph (a) first sentence revised as follows: “The NAICS code and small business size standard for this acquisition appear above.”
Paragraph (c) first sentence revised as follows: “The vendor agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the quote.”

All companies must be registered in the System for Award Management at https://www.sam.gov/portal/public/SAM/ to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instruction shall be provided at time of award.
FAR Provision *52.212-2, Evaluation -- Commercial Items (Oct 2014), applies to this acquisition and the following evaluation is applicable:
(a) The Government will award a contract resulting from this RFQ to the responsible vendor whose quote conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
Price: Award will be made to the lowest priced technically acceptable vendor.
An equipment list and technical solution, which meet the RFQ requirements, when combined, are equally important when compared to price.
(b) (b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Price and Technical, when combined, are equal.
(b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

5352.223-9001 Health and Safety on Government Installations As prescribed in AFFARS 5323.9001, insert the following clause in solicitations and contracts:
HEALTH AND SAFETY ON GOVERNMENT INSTALLATIONS (OCT 2019)
(a) In performing work under this contract on a Government installation, the contractor shall:
(1) Take all reasonable steps and precautions to prevent accidents and preserve the health and safety of contractor and Government personnel performing or in any way coming in contact with the performance of this contract; and
(2) Take such additional immediate precautions as the contracting officer may reasonably require for health and safety purposes.
(b) The contracting officer may, by written order, direct Air Force Occupational Safety and Health (AFOSH) Standards and/or health/safety standards as may be required in the performance of this contract and any adjustments resulting from such direction will be in accordance with the Changes clause of this contract.
(c) Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds for termination of this contract in accordance with the Default clause of this contract.
