87’ PATROL BOATS MTU DIESEL ENGINE OVERHAULS
NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time- consuming litigation.
OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum.
Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.
Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).
Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.
Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.
The Ombudsman Hotline telephone number is 202.372.3695.

The Government intends to award a contract based on the initial offers and without discussions, although clarifications (as defined in FAR 15.306(a) may be needed). A Pre-award Site Survey may be required prior to award.
In evaluating Contractors past performance, general trends in a Contractor’s performance will also be considered. Contractors may provide information on problems encountered during the performance of any contract/order and any corrective actions the contractor made. In the case of a contractor without a record of relevant past performance or for whom information on past performance is not available, the contractor may not be evaluated favorably or unfavorably on past performance.
A. If discussions are held, the Government will conduct discussions with all companies that have been found to be technically acceptable and request final proposal revisions.
B. The Government will award contracts resulting from this solicitation to the responsible offerors whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Factor 1 – Technical
Subfactor A - Technical Approach: Demonstrated Clear Understanding/Prior Experience Subfactor B - Management Approach: Project Planning, Warranty Response and Technical Services Support Subfactor C - Key Personnel Resumes Subfactor D - Employee MTU Training Certificates Subfactor E - Valid MTU Distributor Agreement
(ii) Factor 2 – Past Performance CPARS for Relevant Work References Other than CPARS
(iii) Factor 3 – Price
Order of Importance – The technical and past performance factors are significantly more important than price and the Government may award to other than the lowest priced quote based on the technical and past performance ratings.
C. Evaluation of Offers.
Factor 1 Technical
a. Written Technical Plan The offeror shall submit a fifteen (15) page maximum written technical plan.
i. Technical Approach: Demonstrate a clear understanding of the RFP and the Statement of
Work. The offeror shall describe their prior experience with a relevant size and scope overhaul project.
ii. Management Approach: Describe the offeror’s approach to unplanned issues, Project Planning, Warranty Response and Technical Services support.
b. Technical Documentation Support: Offeror shall submit the following documents to be rated technically acceptable. Failure to submit these documents will result in a rating of technically unacceptable. These documents do not count against the fifteen (15) page limitation for the written technical plan required above.
i. Key Personnel resumes of the Project Manager and Alternate Project Manager. The offeror shall limit each resume to three pages submitted as a PDF. Resumes shall detail key personnel experience managing a similar project in size and complexity. Minimum requirement: Key Personnel have a minimum of one (1) year supervisory experience of a large marine diesel engine project.
ii. Proof that at least two current employees are MTU trained and certified to the level of MTU standards meeting CM3/CE3.
iii. A letter on MTU or Rolls-Royce Power Systems (RRPS) AG letterhead, signed by an MTU or RRPS representative validating the offeror is a distributor authorized to sell and service the 8V396 TE 94 MDE. The letter must include the MTU or RRPS representative’s printed name, title, phone number, email and signature. The letter shall provide a date indicating how long the distributor agreement is valid or when the distributor agreement expires.
The evaluation Factor 1 will be done holistically with a rating scale of “high confidence,” “some confidence,” and “low confidence,” representing the Government’s confidence that the Offeror understands the requirement and will be successful in performing the work based on the fifteen (15) page submission. Written technical plans that extend beyond fifteen (15) page will not be considered.
Technical Rating Definitions:
Factor 2: Past Performance
a. CPARS for relevant work: The offeror shall submit up to two (2) CPARS past performance assessments for recent, relevant work performed within the past three (3) years from the solicitation closing date will be used to evaluate a contractor’s past performance. The contractor must identify the most recent and relevant CPARS assessments and submit copies of those assessments with their proposal.
b. If an offeror does not have any CPARS assessments for relevant work performed within the past three (3) years from the solicitation closing date, they shall identify two (2) references with contracts or delivery/purchase orders for performing this type of requirement and have their references complete Appendix C past performance questionnaire. The offeror’s past performance references must e-mail the past performance questionnaire directly to the Contract Specialist by the closing date and time of the solicitation. Offerors who do not have any past performance history or whose past performance is not available may not be evaluated favorably or unfavorably.
Past performance will be considered relevant if it is for performing overhaul of large diesel engines for the USCG, federal, state or local government or private contracts. In evaluating past performance, general trends in performance will also be considered. References other than those provided by the offeror may be used by the Government to obtain additional information that will be used in the evaluation of the offeror’s past performance such as government databases and internal organization resources.
Past Performance shall be rated as Substantial Confidence, Satisfactory Confidence, Limited Confidence, and No Confidence. In the case for which there is no information on past performance or where past performance information is not available, the offeror may not be evaluated favorably or unfavorably. In this case, a performance confidence rating of "Neutral" will be assigned. For this requirement a "Substantial Confidence" or “Satisfactory Confidence" past performance rating is worth more than a "Neutral" past performance rating.
Past Performance Rating Definitions:
Factor 3: Price
It is anticipated that pricing and award of this acquisition will be determined fair and reasonable based on adequate price competition. Completion of Schedule of Supplies and Prices Attachment 3 is necessary for a full evaluation of an Offeror’s proposal. While certified cost and pricing data is not required, other than certified cost and pricing data or detailed prices breakdowns may be necessary in order for the Government to determine price reasonableness. Proposals failing to meet or comply with the price proposal instructions may be deemed noncompliant. The Government will evaluate offers for award purposes by adding the total price for all ordering periods to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the ordering period prices are significantly unbalanced.
Travel costs will not be evaluated, however the Contractor shall be required to travel to support the contract. Travel costs will be reimbursed for Technical Support and Failure Analysis CLINS. All preventative maintenance will be FFP, accomplished at cutter homeports, and travel will not be reimbursed. When applicable, Contractor’s travel shall be reimbursed in accordance with FAR 31.205-
46. The Contractor shall, to the maximum extent practicable, minimize overall travel costs by taking advantage of discounted airfare rates available through advance purchase. Charges associated with itinerary changes and cancellation under nonrefundable airline tickets are reimbursable as long as the changes are driven by the work requirement. Travel performed for personal convenience or daily travel to and from the contractor’s normal work site shall not be reimbursable. The Contractor shall be responsible for obtaining COR approval (electronic mail is acceptable) for all reimbursable travel in advance of each travel event.
D. Evaluation Methodology
The Government will award a requirements contract to the offeror determined to provide the best value on the basis of all non-price and price related factors. The evaluation of proposals submitted in response to this solicitation shall be conducted utilizing the tradeoff process to obtain the best value to the Government.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
X. FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL
