Replace (f)(2)(i) with the following:

Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is

"late" and will not be considered unless it is received before award is made and the

Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. (Delete paragraphs A, B, C).

(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021)

(Provision)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Capability. Provide a Capability Statement of how the quoter plans to fulfill the requirement including relevant experience.

a. Technical experience must include:

i. Key Personnel

ii. Resources/Equipment

2. Past Performance. List of 2-3 relevant projects of similar size and scope in the past 3 years including contact information. Responsive quotes must include the Past Performance

Experience Questionnaire.

mailto:Scott.Remillard@USDA.GOV mailto:Scott.Remillard@USDA.Gov

Solicitation Number 127EAT22Q0044

3. Price.

Technical and past performance, when combined, are significantly more important than price. The selection official will base the award decision on a tradeoff between price and non-price factors, comparing the relative risk to the government of poor or non-performance posed by each of the offerors, and making a judgment as to whether or not reduced risk of performance is worth the additional cost.

(a) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
