FAR 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV
2021) (Addendum)
The Government will award a Firm Fixed Price, Indefinite Quantity contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Technical
2. Price
The evaluation of factors will establish the requirements of acceptability. Technical is equal to price.
The contract award will be based on the lowest evaluated price of proposals meeting the acceptability standards for the technical factor. To receive consideration for award, a rating of “Acceptable” must be achieved for the Technical factor. A rating of “Unacceptable” of the Technical factor will not be considered for award. For each quote with an overall “Acceptable” rating for Technical, the lowest Price will become the determining factor for making the award.
The Government shall evaluate the each quote on a pass/fail basis, assigning ratings of acceptable or unacceptable using the ratings and descriptions outlined as follows:
Rating Description
Acceptable Quote meets the minimum requirements of the solicitation.
Unacceptable Quote does not meet the minimum requirements of the solicitation.
The Technical rating will be based on an “Acceptable” / “Unacceptable” basis. Technically Acceptable is defined as:
Factor 1: Technical
The Contractor shall provide a plan or capabilities statement that addresses all the aspects identified in Submission Document #2. Quotes that fail to address any aspects or the proposed solution is not compatible with the scope requirements will be found unacceptable. Quotes that fail to provide a technical approach or capabilities consistent to satisfy the reporting requirements as defined in the statement of work will be found unacceptable.
Factor 2: Price The total evaluated price shall be the sum of all Contract Line Item Numbers (CLINs). Quotes will be evaluated to determine whether it is fair and reasonable as per FAR 13.106-3.
As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8) by adding six (6) months of the offeror's final option period price to the offeror's total price. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the potential six month extension of services period.
The Government reserves the right to conduct a price realism analysis of prices considered to be unrealistically low.
The Government may consider offeror(s) understanding of the items or ability to deliver the items in this analysis and risk assessment. An unrealistically low price may result in the offeror’s proposed price rejected and ineligible for award.
(End of Provision)
Offeror Representations and Certifications-Commercial Items In accordance with 52.212-3 Offeror Representations and Certifications-Commercial Items (May 2022), the contractor shall ensure that the business has completed the online Representations and Certifications at the System and Awards Management (SAM) website which may be found at https://www.sam.gov/portal/public/SAM/. It is the contractor’s responsibility to ensure that the information provided in each certification/representation is completed truthfully and completely. Failure to complete the online certification/representations prior to the close of the Solicitation (to include listing of the applicable NAICS code, “active status”, or applicable size standards) will deem the contractor non-responsive and eliminated from consideration of the award.
Minimum Guarantee The minimum guarantee for this contract is $2,500 or the value of the first task order, whichever is greater.
