RFO 52.212-2 Evaluation—Commercial Products and Commercial Services.

(a) Evaluation Factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered. The following factors will be used to evaluate offers: Factor 1 - Technical Capability; Factor 2 - Past Performance; and Factor 3 - Price.

Relationship of Factors: Technical Capability (Factor 1) is evaluated on a pass/fail

(Acceptable/Unacceptable) basis. For those offerors determined to be Technically Acceptable, Past

Performance (Factor 2) is significantly more important than Price (Factor 3). The Government reserves the right to award to a higher-priced offeror if that offeror's Past Performance record justifies the price premium.

(1) Factor 1 - Technical Capability:

The Offeror's technical quote will be evaluated to determine whether the proposed approach demonstrates a comprehensive understanding of, and capability to meet, the requirements defined in the Performance Work Statement (PWS). To be determined Technically Acceptable, the Offeror must submit the following documentation with their quote:

• OEM Authorization: A current, signed letter of authorization from the Original

Equipment Manufacturer (Dräger) certifying the Offeror is an authorized service provider.

• Technician Certifications: Documentation proving that the specific service technicians assigned hold active Dräger factory-training certifications for the equipment listed in the

PWS.

• Software Competency: Demonstrates verifiable legal access to the OEM service keys and software platforms required to satisfy PWS Paragraph 2.10.

• Response Feasibility: The proposed Emergency Response & Logistics Plan provides a highly feasible, low-risk approach to arriving onsite at NMRTC Beaufort within 2 hours of an emergency notification.

• Vaporizer Calibration: The proposed approach confirms the use of OEM-authorized calibration procedures and genuine OEM PM parts for all Vaporizer units listed in the

PWS.

Technical Ratings:

Acceptable: The Offeror meets all PWS requirements and has submitted all required OEM documentation meeting the standard set forth in the solicitation.

Unacceptable: The Offeror fails to meet any PWS requirement, fails to comply in submitting requested OEM documentation, or the documentation fails to meet the standard. Unacceptable proposals are ineligible for award.

(2) Factor 2 - Past Performance:

The Government will evaluate the offeror’s recent and relevant past performance to assess the

Government's confidence in the offeror's ability to successfully perform the required effort.

Submittal Requirement: Offerors shall submit up to three (3) references for contracts performed for the Federal Government or commercial hospitals.

Recency: Contracts must have been ongoing or completed within the last three (3) years from the solicitation closing date.

Relevancy: Contracts must be similar in size, scope, and complexity (e.g., maintenance of life-safety medical equipment or anesthesia workstations).

Evaluation Method: The Government will review the submitted references and may utilize other databases (e.g., CPARS) to determine an overall Performance Confidence Assessment. Offerors without a record of relevant past performance will not be evaluated favorably or unfavorably and will receive a "Neutral Confidence" rating.

(3) Factor 3 - Price:

Offerors shall complete a Pricing Sheet with best and final pricing. The proposed price will be evaluated for fairness and reasonableness in relation to the solicitation requirements.

(4) Evaluation Process:

Proposals will be evaluated initially for Technical Acceptability (Factor 1). Only proposals rated

"Acceptable" will advance to the Best Value trade-off analysis. The Government will make a final determination by comparing the Past Performance (Factor 2) and Price (Factor 3) of all Acceptable offerors. The Government intends to award without discussions but reserves the right to request further information if necessary.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful

Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
