FAR 52.212-2, Evaluation-Commercial Products and Commercial Services (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation requirements will be most advantageous to the Government, namely price and other factors. The following factors shall be used to evaluate offers:
Award will be made from the Offeror who is determined acceptable in both the technical and past performance factors as well as the lowest total evaluated price. The following approach shall be used to evaluate offers:
STEP 1: Rank all quotes by price
STEP 2: Evaluate for technical acceptability ascendingly (evaluated in line from lowest priced to highest priced quotes). Bid shall be evaluated on acceptability by being able to meet the requirements within the Product Description, and Delivery Table attached within 10 days of award. Bidders will provide two examples of past performance of awarded contracts.
STEP 3: Assess performance confidence for the lowest priced technically acceptable offeror with conforming past performance.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Failure to strictly adhere to the instructions could result in its proposal being deemed unacceptable and therefore may result in the elimination of the proposal from further consideration
