About this file

This is a project manual and specification document for a state and local construction contract opportunity issued by Clare Gladwin Regional Education Service District (CGRESD) in Michigan for the design and construction of a new storage building and greenhouse facility. The project, identified as TDF #2020-18, was designed by The Design Forum Inc. and includes both a pole-frame storage building and a prefabricated greenhouse structure. Sealed bids were due on Wednesday, March 10, 2020, at 2:30 PM local time at the Office of the Superintendent in Clare, Michigan. The project involves construction of a clear-span pole building with metal siding and roofing, a concrete foundation and floor slab, overhead and pass-through doors, and a complete greenhouse package (High Garden Grower model) pre-priced at $26,127.00 plus optional installation at $16,610.00. Construction is sequenced in two phases: greenhouse completion by July 1, 2020, with sitework and pole building construction beginning August 14, 2020, coordinating with student labor from the district's Construction Trades Classes, who will perform carpentry, concrete, metal installation, and door work at no cost to the contractor under licensed instructor supervision.

Bid security of five percent of the bid amount is required, with successful bidders obligated to provide 100% performance and labor-material bonds within ten days of award. The contract is awarded on a lump-sum basis for all general construction trades including mechanical and electrical work, with the greenhouse package cost and optional installation costs specified as line items. The school district determined that prevailing wages are not required on this project. Contractor responsibilities include all permits, inspections, county building permits with associated costs to be included in the bid, site preparation, utility connections, temporary facilities, quality control testing, and final cleanup. The contractor must submit a detailed cost breakdown within ten days of contract acceptance and maintain a full-time superintendent on site. The project specifies compliance with AIA Document A201 (2017 General Conditions), Michigan Building Code, and applicable OSHA and environmental regulations, with a one-year warranty required on all work from the date of substantial completion. Bidders were required to submit three notarized affidavits addressing familial relationships with school board members, school safety initiative compliance, and Iran Economic Sanctions Act compliance at the time of bid submission.

INTERPRETATION OF DOCUMENTS

If the true meaning, spirit, and intent of the Drawings, Project Manual or any part of the proposed contract documents are in doubt, a bidder may request for interpretation thereof, provided the request is received by the Architect in sufficient time to issue an Addendum. ANY INTERPRETATION OF BIDDING

DOCUMENTS, if made, WILL BE BY ADDENDUM ONLY, duly issued to each bidder receiving a copy of said documents. The Owner and Architect are not responsible for any other explanations or interpretations made prior to closing time for receipt of bids. NO EXPLANATIONS OR INTERPRETATIONS MADE

ORALLY WILL BE CONSIDERED BINDING.

BIDDERS OBLIGATIONS

Before submitting bids, carefully examine the Drawings, Project Manual, and proposed Contract Documents, including Addenda. Visit the proposed site of work to assess all conditions which can affect the work or cost thereof. Report to the Architect errors, inconsistencies or ambiguities discovered.

Use complete sets of Bidding Documents in preparing Bids; neither the Owner nor Architect assumes responsibility for errors or misinterpretations resulting from the use of incomplete sets of Bidding Documents by bidders or sub-bidders, suppliers, etc.

Each Bidder is responsible for calling to the attention of the Architect any ambiguities, inconsistencies, discrepancies, errors, or omissions which occur in the Contract Documents for his part of the Work. Failing to request clarification, the Bidder will be expected to overcome such conditions without additions to his bid prices.

Should conflicts, errors, or discrepancies remain unresolved within the final seven days before bids are due, estimate on and furnish the greater quantity or better quality unless resolution is received in writing from the

Architect.

Clare Gladwin RESD Division 00 9

Fill in all blanks in the bid forms. Mark non-applicable portions with NA or line out. Incomplete bid forms may be grounds for disqualification of the bid at the discretion of the Owner or Architect.

The bidder is responsible to divide the Work identified in the Drawings and Specifications among the various trades, subtrades, vendors, and his/her own work force. The Work appears in the Drawings and these specifications in an arbitrary arrangement of drawing titles and specification sections. It is not intended to define the work of each trade, subtrade, or vendor by means of this arrangement. It will be assumed that

Work not assigned to a trade, subtrade, or vendor will be responsibility of the Contractor and is included in the bid. No exceptions will be considered unless clearly written on a separate sheet attached to the Bid Form at the time of bid.

GREENHOUSE PACKAGE

The Greenhouse package has been pre-selected but not ordered. The cost of that package ($26,127.00) is to be included in the cost of the work and the delivery of the package is to be received by the Contractor. This price includes shipping but does not include installation. Installation is to be by the Contractor. If desired, bidders may contract with the Greenhouse Provder (Greenhouse Megastore) for the installation. The cost of that work as quoted by the provider is $16,610.00. Gas, water, drain and electrical connections to each piece of equipment are to be provided by the Contractor. Coordinate the location of those feeds with the

Greenhouse installation. Floor slab, concrete stoops, sitework, foundation and trench drain are to be provided by the Contractor and are not part of the Greenhouse Package.

STUDENT LABOR

It is the intent of The Owner to involve the Construction Trades Classes of the RESD in the construction of the pole building. Students will not be involved in the construction of the Greenhouse. The instructor of the class is a licensed home builder and will be present and responsible for the students when they are on site.

The Clare Gladwin RESD will cover all insurance for the students working on the project so there will be no cost to the Contractor. Students are capable of performing the following work: Rough and Finish Carpentry, installation of metal siding and roofing, installation of swing doors and hardware and forming and pouring concrete. They are not able to perform any electrical work, sitework or paving. The construction of this building will be their primary class involvement for the fall semester of 2020. The CGRESD would like to have them involved to the maximum extent possible. There is no charge for their services, however bidders should know that the timeframe of construction will be longer than normal due to the limits on the student availability, time of day, etc. To that extent, bidders should allow for ample supervision time to cover the extended construction period. The CGRESD has a fork lift, a skid steer and a tractor that are available for use on the project and the students will all have their own tools. The CGRESD requests that the bidders estimate the amount of student worker time that is incorporated in their bid and state that figure in the space provided on the bid form. All materials are to be furnished by the Contractor.

BID SUBMITTAL

Submit 3 copies of the bid on forms (or copies of forms) provided by the Architect. Deliver in sealed, opaque envelope bearing the following inscription:

Inspections will be carried out by the County and the cost of those inspections along with the cost of the permits are to be included in the bid.

FULL TIME SUPERINTENDENT

Clare Gladwin RESD Division 00 11

CONSTRUCTION SCHEDULE

The Bidder receiving a Contract shall prepare a proposed schedule of the Work within 7 days of notice of award of the Contract and prior to commencing Work at the site. The schedule shall conform with the time limits of the Contract. The Owner desires to have the Greenhouse ready for occupancy by July 1, 2020.

Construction on the Pole Building will not start until the beginning of the fall school semester in late August.

Sitework should be completed for that project during the summer so that the site is prepared and ready for construction of the Pole Building by August 14, 2020.

Within 10 days after the acceptance of any bid by the Owner, the successful bidder shall submit a cost breakdown on the continuation sheet of the Application and Certificate for Payment form, A.I.A. Document

G703. Enter all costs applicable to the contract broken down by trades and or subcontracts. Labor and Material Bond in the amount of 100% of the contract.

Evidence of Worker's Compensation Insurance as required by State of Michigan.

Evidence of Public Liability Insurance (including automobiles).

Evidence of Property Damage Insurance (including automobiles).

METHOD OF AWARD

The base bid quotation shall include all work indicated in the Bidding Documents unless specifically indicated as an Alternate. It shall not reflect acceptance of any alternates.

Selection of specified Alternates will be made by the Owner, acting upon the Architect's recommendations, for the best interest of the project commensurate with available funds. The Contract will be awarded with the combination of Base Bid plus any individual Alternate or combination of Alternates which the Owner may select.

Bidders may offer voluntary alternates by submittal in writing, along with supporting literature and other data, at the time the bid is submitted. Although they will be given consideration after award of the Contract, voluntary alternates will not be considered in the Owner's judgment about award of the Contract. Change in the Contract price proposed for the voluntary alternate(s) shall reflect all possible costs to be encountered should the voluntary alternate be accepted and incorporated in the work. Costs shall include: required changes to work of general, mechanical, electrical, or other trades and dimensional or structural changes.

The Owner reserves the right to let other contracts in connection with the work.

Clare Gladwin RESD Division 00 12

Bidders shall also comply with applicable statutes, regulations, etc. The contract documents, when executed, shall be deemed to include the entire agreement between the parties thereto, and contractors shall not claim any modification thereof resulting from any representation or promise made at any time by any officer, agent, or employee of the Owner or by any other person.

Executive Directive l975-76 for "Civil Rights Compliance in State and Federal Contracts" and in particular the following paragraphs of that Directive: "In any program or activity funded in whole or in part with State funds, a recipient or contractor may not (directly or indirectly through contractual arrangements) subject any individual to unlawful discrimination on the basis of race, religion, color, national origin, age, or sex in its employment practices. These practices include recruitment, recruitment advertising, hiring, layoff, termination, upgrading, demotion, transfer, rates of pay or other forms of compensation, use of facilities, and all other terms and conditions of employment.

1.3 EMPLOYEE SELECTION PROCEDURES - The Michigan Department of Civil Rights in carrying out its responsibilities under the Michigan Constitution and Public Act 251, has adopted and promulgated the Guidelines on Employee Selection Procedures as published by the U.S. Equal Employment Opportunity Commission (EEOC), to assist in establishing and maintaining equal employment opportunities. Among other things, these Guidelines forbid the use of employee selection practices, procedures, and devices (e.g., tests, minimum educational levels, experience) which disqualify a disproportionate number of minority individuals or women for employment and which are not related to job performance.

1.4 SEX DISCRIMINATION

A. The Michigan Department of Civil Rights has adopted and promulgated Guidelines on

Sex Discriminations as published by the EEOC. Among special requirements related to equal opportunity for women are:

1. There can be no distinction based upon sex in employment opportunities, wages, hours, the granting of fringe benefits, leave, mandatory or optional retirement age, and other terms and conditions of employment.

2. Medically verifiable disabilities caused or contributed to by pregnancy, miscarriage, abortion, childbirth, and recovery therefrom are for all job related purposes, temporary disabilities and shall be treated as such under any health or temporary disability insurance policies or sick leave plans available in connection with employment.

3. Written and unwritten employment policies and practices involving matters such as the commencement and duration of leave, the availability of extensions, the accrual of seniority and other benefits and privileges, reinstatement, and payment under any health or temporary disability insurance policies or sick leave plans, formal or informal shall be applied to disability due to pregnancy or childbirth on the same terms and conditions as they are applied to other temporary disabilities.

B. Advertisements for employment in newspapers and other media must not express a sex preference. The placement of an advertisement in columns "Male" or "Female" will be considered to be discriminatory limitation.

C. Nothing in these procedures shall prohibit the hiring of employees of one sex, provided sex is an established bona fide occupational qualification. A bona fide occupational qualification will be interpreted narrowly; e.g., the assumption that women are not aggressive or that co- workers or customers prefer one sex or the other does not establish a bona fide occupational qualification.

1.5 RELIGIOUS DISCRIMINATION - The Michigan Department of Civil Rights has adopted the promulgated Guidelines on Religious Discrimination, requiring in part that employers make "reasonable" accommodations to the religious needs of employees and applicants for employment. These procedures shall not apply to a religious corporation, association, or society with respect to the employment of an individual of the same religion to perform work connected with carrying on its religious activities.

1.6 NATIONAL ORIGIN - The Michigan Department of Civil Rights has adopted and promulgated guidelines on National Origin Discrimination. In addition to the protection guaranteed to all minorities, requiring proficiency in the English language where it is not a requirement for satisfactory performance on the job is prohibited.

1.7 AGE - Any recipient/contractor shall not refuse to hire, or otherwise discriminate against, a person with respect to employment because an individual is between the ages of 18 and 60.

It shall not be an unfair employment practice to refuse to select an individual over the age of 35 because of that individual's age for an apprenticeship or on-the-job training program intended to have a duration of more than four (4) months.

1.8 REPORTING REQUIREMENTS

A. Department of State recipients/contractors subject to these procedures are required to submit a Statement of Equal Opportunity in the provision of Services, Activities and

Programs (Par. IV-C), and employment reports covering their present and projected work force to the Contracting or Administering Department and the Michigan

Department of Civil Rights (Par VII). Department of State prime recipients/contractors are further required to secure the above Affirmation and

Minority-Female Status Report from subcontractors and/or subrecipients. Such forms are to be forwarded to the Contracting/Administering Agency and the Michigan

Department of Civil Rights attached to the prime contractor's reports.

B. The recipient/contractor is required to keep employment and other records used in preparation of the reports, to permit Administering Agency, the Michigan Department of Civil Rights, or other authorized persons as may be necessary to ascertain compliance with Executive Directive l975-6.

1.1 INCLUDED PROVISIONS - The General Conditions and Supplementary Conditions apply to this work.

1.2 INTENT

A. Imperative language: This project manual is written with sentences in the imperative and abbreviated form. This imperative language is directed at the Contractor unless specifically noted otherwise. The word “all” shall be implied by inference unless specifically limited. Incomplete sentences shall be completed by inserting "shall", "shall be" and similar mandatory phrases by inference. Except as worded to the contrary, fulfill (provide, install, and/or perform) indicated requirements whether stated in the imperative or otherwise.

B. Division of the Work: The scope of Work appears in the Drawings and these

Specifications in an arbitrary arrangement of drawing titles and specification sections.

It is not intended to define the work of each trade, subtrade, and vendor by means of this arrangement. It is the Contractor's obligation to perform the Work regardless of where it appears in the Drawings and Specifications. The Contractor is obligated to divide the Work among his/her own work force, the trades, subtrades, and vendors.

1.3 WORK COVERED BY CONTRACT DOCUMENTS

A. Construction of a new Storage Building and Greenhouse. Close cooperation and coordination of student work on the Storage Building will be required and should be included in the scope of work for which this bidder is submitting this proposal. All work shall be in accordance with the requirements of the Bidding Requirements, Contract Forms, General Conditions, Specifications, and Drawings. The limits of construction are described on the Drawings.

1.4 WORK SEQUENCE

A. The Greenhouse Package is desired to be usable by July 1, 2020. Sitework for the

Storage Building can be done any time during the summer but must be completed by

August 14, 2020. The actual installation of the Storage Building is not to commence until school starts and student labor is available.

1.5 CONTRACTS

A. This project shall be executed under one combined Contract: General Construction, including General, Mechanical, and Electrical trades.

1.6 DIAGRAMMATIC DRAWINGS - In certain cases drawings are by necessity diagrammatic and do not specifically show installation dimensions. The work covered in this manner shall be installed in close cooperation with the Architect and the trades involved in the project in order to avoid interface problems or interferences. Careful investigation of structural and finish conditions is mandatory. Anticipatory planning and attentive consideration for the collective work of all trades is a part of acceptable performance.

Clare Gladwin RESD Division 01 2

1.7 CONDITIONS, DIMENSIONS AND MEASUREMENTS - Refer to General Conditions, Article 3, and;

A. Site and Job Information: Preliminary investigations, such as the survey, location of utilities, existing structures, and existing grades may appear as information and/or drawings in the contract documents. While such data has been collected with reasonable care, there is no expressed or implied guarantee that conditions so indicated are entirely representative of those actually existing or that unforeseen developments may not occur. Each trade must interpret the results of such investigations and be satisfied as to materials upon which that trade's work may be placed. Such information is based on available records but is not guaranteed to be complete or correct; it is merely given to assist each contractor.

B. Data Verification: Verify grades, lines, levels, locations, and dimensions. Errors due to failure to field verify grades, lines, levels, locations, and dimensions shall be corrected at the expense of the responsible trade or supplier.

B. Installation Conditions: Examine conditions of installation including substrates and related environmental requirements prior to commencing work. Report necessary corrections in writing to the Project Superintendent and/or manager and copy the

Architect. Commencing work implies acceptance.

Conduct operations in such manner that no jurisdictional disputes arise regarding loading, unloading, handling, installations, and connections of the various items of the several trades involved.

B. It may be necessary to temporarily omit certain portions of the work in order to install certain materials or finishes. The trade whose work is involved shall omit such parts of their work as is necessary until other said work and/or materials have been installed.

This trade shall then return and install such omitted parts of the work as part of this

Contract and without additional cost to the Owner.

C. Sleeves and inserts shall be furnished by the trade requiring them unless noted otherwise.

D. The concrete trade shall place sleeves and inserts correctly for pipes, conduits, and similar items in forms, walls, ceilings, roofs, and floors in ample time so as not to delay concreting operations.
