About this file
This is a Sample Proposal document from the Oklahoma Department of Transportation (ODOT) for a federal aid highway construction project in Blaine and Dewey Counties. The project involves grading, draining, and surfacing US-270 from 3.09 miles northwest of the SH-58 intersection, extending southeast near Watonga, for a total project length of 3.849 miles. The proposal (NHPP-017N(311)FP, JP No. 17671(42), Proposal 260129, Call Order 805) will be let on Thursday, May 14, 2026, at 10:30 a.m. with a contract time estimated at 365 calendar days with flexible start provisions allowing work to commence any time after notice to proceed but no later than October 5, 2026. Bidding documents will be available April 16, 2026, at a cost of $50.00 plus tax, with no proposals issued after May 13, 2026, at 10:30 a.m. The work includes extensive roadway construction items such as clearing and grubbing, excavation (203,399 cubic yards of unclassified excavation and 16,878 cubic yards of unclassified borrow), grading, sodding (425,160.240 square yards), superpave asphalt paving (approximately 106,225 tons across multiple types and grades), drainage structures (various reinforced concrete pipes, culverts, and inlets), traffic control measures, and permanent traffic striping and signage. Bids must be submitted electronically via Bid Express using AASHTOware Project Bids or by sealed written proposal, with all proposals requiring a 5% proposal guaranty and an unsworn statement under penalty of perjury.
The project is subject to Buy America and Build America, Buy America requirements with various material compliance provisions detailed in Special Provision 106-5. A Disadvantaged Business Enterprise (DBE) goal of zero percent applies to this project. Railroad involvement with Grainbelt Corporation (Farmrail Corporation) requires contractor compliance with railroad flagging provisions at $1,300 per eight-hour day (100% reimbursement), railroad protective liability insurance of $2,000,000 per occurrence and $6,000,000 aggregate, and execution of a contractor release and indemnification form. Prevailing wage requirements apply per Oklahoma General Decision Number OK20260021, with wage rates varying by county and classification for various labor categories including carpenters, cement masons, laborers, power equipment operators, and truck drivers. Liquidated damages are assessed daily based on contract amount, ranging from $300 to $1,800 per day depending on the contract value. The project includes provisions for fuel price adjustments for diesel fuel used in earthwork items, payment to subcontractors monitored through AASHTOWare Project Civil Rights & Labor software, and a requirement that the contractor perform at least 30% of the contract work using its own organization. Questions regarding the bid opening are accepted until April 24, 2026, through ODOT-Prebid.Question@odot.org, with responses posted to the ODOT Contracts & Proposals webpage.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis‐Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health‐related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health‐related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government‐contracts.
Note: Executive Order 13658 generally applies to contracts subject to the Davis‐Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis‐Bacon Related Acts regardless of when they were awarded.
If a contract is subject to Executive Order 13658, the
PAGE 17 OF 157PROPOSAL ID : 260129
contractor must pay all covered workers at least $13.30 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in 2025. The applicable Executive Order minimum wage rate will be adjusted annually. Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four‐letter identifier beginning with characters other than ""SU"", ""UAVG"", "SA", or "SC" denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198‐005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for
PAGE 18 OF 157PROPOSAL ID : 260129
the classifications reflected union rates. EXAMPLE:
UAVG‐OH‐0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
Survey Rate Identifiers
The ""SU"" identifier indicates that either a single non‐union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SUFL2022‐007 6/27/2024. SU indicates the rate is a single non‐union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
"SU" wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)‐(h). Example: SAME2023‐007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the "SA" identifier took effect under state law in the state from which the rates were adopted.

SPECIAL PROVISIONS
FOR
RAILROAD FLAGGING (100% REINBURSEMENT)
NHPP-017N(311)FP, JP NO. 17671(42), BLAINE AND DEWEY COUNTIES
These Special Provisions revise, amend, and where in conflict, supersede applicable sections of the 2019 Standard Specifications for Highway Construction.
104.18 RAILROAD FLAGGING (Add the following:)
Execute and return the right of entry agreement (if required by the railroad) with the contract to the Department within the time period provided for contract execution. Reimburse Grainbelt Corporation Railroad Company, hereinafter referred to as the Railway Company, directly for the cost of all railroad flagging required by the Railway Company due to construction on their property.
The Railway Company’s requirements for flagging and right of entry may vary significantly from those implied by other contract documents. Therefore, be informed of the individual Railway Company’s requirements for flagging and right of entry.
For the purpose of bidding, the following information is furnished by the Railway Company covering the estimated flagging schedule and the estimated cost thereof:
A. Flagging Services
Flagging services will be required:
(1) In the event it is necessary for the Contractor to operate his crane or other heavy machinery in the vicinity of the track, as defined by the Railway Company, which may endanger railroad operations.
(2) At any time the Contractor is within 25 feet of the track.
(3) As specified in the right of entry agreement (if required).
(4) At any other time deemed appropriate by the Railway Company.
(5) In the event it is necessary for the Contractor to operate his crane or other heavy machinery in the vicinity of the track, as defined by the Railroad Company, which may endanger railroad operations.
(6) When, upon inspection by Railroad Company’s Representative, other conditions warrant.
(7) When any excavation is performed below the bottom of the elevation, if, in the opinion of the
Railroad Company’s Representative, track or other railroad facilities may be subject to movement or settlement.
(8) When work in any way interferes with the safe operation of trains at timetable speeds.
(9) When any hazard is presented to Railroad Company’s track, communications, signal, electrical, or other facilities either due to persons, material, equipment or blasting in the vicinity.
(10) Special permission must be obtained from the Railroad Company before moving heavy or cumbersome objects or equipment which might result in making the track impassable.
B. Flaggers
The total cost for one flagger, supervisory personnel, vacation allowances, and retirement and unemployment insurance is $1,300 per eight hour day. This rate is based on current wage scales for an eight hour basic day, including any additional pay for overtime, rest days and holidays, and is subject to any increases which may result from railroad employees-railroad management negotiations, or which may be authorized by Federal authorities. No additional payment will be made for increases in the above rate if such increases should occur.
PAGE 25 OF 157PROPOSAL ID : 260129
104-6(b-b) 19 1-30-24
Furthermore, the Contractor's final estimate will not be paid until satisfactory evidence that the Railway Company has been fully reimbursed for their flagging services is provided.
C. Utilities
Fiber optic, communications, control systems, and other types of cables may be buried on Railway Company property. Contact Call Okie at 1-800-522-6544 to assist in determining if cable systems are buried on Railway Company property to be used before beginning work. Contact the appropriate personnel to have cables located, and make arrangements with the owner of the facility to ascertain the protective measures that must be adhered to prior to the commencement of any work on the Railway Company’s property.
D. Railroad Operations
Normal train operations over the crossing consists of four (4) trains daily. Details regarding train operations required or desired may be obtained by consulting the Railway Company’s office located at Kelly Rippetoe, Farmrail Corporation, PO 1750, Clinton, OK 73601, Phone 580-323-1234. Email:
Kellyrippetoe@farmrail.com.
E. Measurement of Railroad Flagging
The Engineer will measure Railroad Flagging (Non-Biddable) as billed by the Railway Company prorated to an eight hour day, as a single operation, regardless of the actual number of railroad personnel needed. For example, if the Contractor is billed by the Railway Company for twelve hours of flagging, this will constitute 1.5 days of Railroad Flagging.
For progressive payment to be made, the Contractor will present an original, notarized confirmation that the Railway Company has been reimbursed for the number of eight hour flagging days billed.
F. Payment for Railroad Flagging
Approved Railroad Flagging, as described above, will be paid for at the contract unit price as follows:
Pay Item: Pay Unit:
RAILROAD FLAGGING (NON-BIDDABLE) Day
Payment for Railroad Flagging (Non-Biddable) is considered full compensation for furnishing all materials, equipment, labor, and incidentals to complete the work as specified. Any additional costs incurred for railroad flagging will be included in other items bid in the Contract.
It is the intent of this provision that the Contractor be reimbursed by the Department at a rate of $1,300 per eight hour day (approximately 100% of the rate specified in Subsection 104.18.B above).

OKLAHOMA DEPARTMENT OF TRANSPORTATION
SPECIAL PROVISIONS
FOR
BUY AMERICA AND BUILD AMERICA, BUY AMERICA
These Special Provisions revise, amend, and where in conflict, supersede applicable sections of the 2019 Standard Specifications for Highway Construction.
106.01 SOURCE OF SUPPLY AND QUALITY REQUIREMENTS (Replace with the following :)
B. Buy America and Build America, Buy America
Buy America (BA) and Build America, Buy America (BABA) requirements are in effect only on projects with federal aid risk, as identified in the contract documents. The Contractor is responsible for submitting completed Material Data Testing (MDT-1) form in accordance with Section 106.01(B)(1) regardless of the BA/BABA requirements.
An article, material, or supply should only be classified into one of the following categories: (1) iron or steel products, (2) construction material, (3) manufactured products, or (4) excluded material. An article, material, or supply should not be considered to fall into multiple categories, except as otherwise provided in Subsection 106.01.B(4)(b)(2). A material is solely classified based on its status at the time it is brought to the worksite.
Except as otherwise provided in Subsection 106.01.B(4)(b)(2) of this special provision, an article, material, or supply shall not be considered to fall into multiple categories. In some cases, an article, material, or supply may not fall under any of the above-listed categories. The classification of an article, material, or supply as falling into one of the categories listed in this paragraph must be made based on its status at the time it is brought to the work site for incorporation into an infrastructure project. In general, the work site is the location of the infrastructure project at which the iron or steel product or manufactured product will be incorporated.
(1) Iron and/or Steel Products
Comply with the Buy America provisions of 23 CFR 635.410 which states that all manufacturing processes, including the application of a coating, for all steel or iron products permanently incorporated into the project shall have occurred in the United States (U.S.).
“All manufacturing processes” are defined as any process required to change the raw ore or scrap metal into the finished steel or iron product (e.g. smelting, rolling, extruding, bending, etc.).
“Coating” is defined as any process which protects or enhances the value of the steel or iron product to which the coating is applied (e.g. epoxy, galvanizing, painting, etc.).
The Contractor is responsible for submitting completed Material Testing Data (MDT-1) for the iron and steel in following items for all projects, regardless of the BA/BABA requirements:
• Precast box culverts
• Reinforced concrete pipe and precast end sections
• Precast inlets and catch basins
• Precast manholes
• Structural steel (girders, diaphragms, anchor bolts, high-strength bolts, sealed expansion joints, etc.)
• Reinforcing steel (all types)
• Welded wire fabric
• Steel spiral wire (drilled shaft cages, bridge rail, etc.)
• Steel piling
PAGE 27 OF 157PROPOSAL ID : 260129
106-5(b-e) 19
• Drill shaft casing (permanent)
• Dowel bars and baskets for paving
• Steel sheet piling (permanent)
• Bridge bearing assemblies (fixed and expansion)
• Post-tensioning steel (strands, wedges, anchor plates, etc.)
• Steel monotube structures
• Galvanized steel supports for overhead and cantilevered sign structures
• Sign posts and bases (all sizes)
• Guardrail, guardrail posts, end sections, terminals, impact attenuators
• Intelligent transportation system or other electronic hardware system cabinets
(2) Waiver for Iron and Steel Raw Materials
The BA/BABA requirements for the following raw materials are waived in accordance with the FHWA nationwide waiver (dated March 24, 1995) for pig iron and processed, pelletized, and reduced iron ore, unless processed or refined to include substantial amounts of steel or iron material, and may be used regardless of source in the domestic manufacturing process for steel or iron material:
• Raw materials (iron ore or alloys)
• Scrap
• Pig iron
• Processed, pelletized, and reduced iron ore material
For recycled steel, only the manufacturing processes to produce steel products must occur domestically, beginning at the point where the recycled steel is melted.
(3) Minimal Use Request for Steel and Iron
Federal regulations allow a minimal use of foreign steel or iron if the cost of the steel and iron products as they are delivered to the project does not exceed 0.1 percent of the total Contract amount, or $2,500, whichever is greater. This threshold applies to the cumulative amount of all foreign steel and iron used on the project. The Contractor must track the amount of incorporated foreign steel and iron throughout the life of a project to ensure the minimal use threshold amount is not exceeded.
(4) Construction Materials
Comply with the Build America, Buy America (BABA) Act of 2 CFR 184. The following construction materials as defined in 2 CFR 184.3 must be manufactured in the United States of America. This means that all manufacturing processes for the construction material occurred in the United States of America.

For plastic and polymer-based products, certification requires all manufacturing processes, from initial combination of constituent plastic or polymer-based inputs, or, where applicable, constituent composite materials, until the item is in its final form, occurred in the United States.
For glass, certification requires all manufacturing processes, from initial batching and melting of raw materials through annealing, cooling, and cutting, occurred in the United States.
For fiber optic cable (including drop cable), certification requires all manufacturing processes, from the initial ribboning (if applicable), through buffering, fiber stranding and jacketing, occurred in the United States. All manufacturing processes also include the standards for glass and optical fiber, but not for non-ferrous metals, plastic and polymer-based products, or any others.
For optical fiber, certification requires all manufacturing processes, from the initial preform fabrication stage through the completion of the draw, occurred in the United States.
For lumber, certification requires all manufacturing processes, from initial debarking through treatment and planning, occurred in the United States.
For engineered wood, certification requires all manufacturing processes from the initial combination of constituent materials until the wood product is in its final form, occurred in the United States.
For drywall, certification requires all manufacturing processes, from initial blending of mined or synthetic gypsum plaster and additives through cutting and drying of sandwiched panels, occurred in the United States.
