About this file

This is a sample proposal document for a state-let construction contract issued by the Oklahoma Department of Transportation (ODOT) for bridge and approach rehabilitation work on US-69 in Bryan County. The project involves replacing and rehabilitating bridges and approaches over Arkansas Street, Kiamichi Railroad, and Main Street, located 1.8 miles north of the US-70 Interchange in Durant, Oklahoma. The project spans 0.988 miles and is designated as Federal Aid Project NHPP-013N(249)PM with JP Number 33871(04). The bid opening is scheduled for Thursday, May 7, 2026, at 10:30 a.m., with bidding proposals available beginning April 16, 2026. No proposals will be issued after May 6, 2026, at 10:30 a.m. The estimated contract time is 500 calendar days with a flexible start date. The scope includes roadway work, four bridge structures (Bridges A, B, C, and D), traffic signing and striping, cable barrier installation, traffic lighting and signals, traffic control, and construction staking. Detailed line items encompass excavation, concrete work, structural steel, pavement, drainage systems, pile driving, and extensive traffic control measures.

Bids must be submitted through Bid Express (BIDX) using AASHTOware Project Bids, with each proposal costing $50.00 plus tax. A proposal guaranty equal to 5 percent of the bid total is required unless otherwise specified. The project has a Disadvantaged Business Enterprise (DBE) goal of zero. Buy America and Build America requirements apply, with waivers available under Special Provision 106-5. The contract includes railroad flagging costs on a 100 percent reimbursement basis and lane rental provisions. Non-biddable items include railroad flagging at $1,400 per day (150 days totaling $210,000) and traffic surveillance through the Oklahoma Highway Patrol at $77 per hour (2,500 hours totaling $192,500). Upon contract award, the successful bidder must execute and return the contract within ten working days, with ODOT completing its execution within fourteen working days. Questions and comments are accepted until April 24, 2026, through the ODOT pre-bid email address. The project is subject to federal requirements including Title VI non-discrimination provisions, affirmative action requirements, and Davis-Bacon wage standards (OK20260020 wage decision applies).

1 Performance specifications assume optimal conditions, including dual-frequency GPS, precise ephemerides, low ionospheric activity, approved antenna calibration, unobstructed visibility above 10°, and ≥3-hour observation durations (dependent on baseline length).

2 Specifications are derived from field and lab testing.

Accuracy and convergence may vary with hardware, GNSS geometry (PDOP), and site conditions.

3 Performance may degrade under high ionospheric activity, severe multipath, or dense vegetation. Adherence to GNSS best practices is recommended for optimal results.

4 Applicable to baselines <40 km.
5 Operating time varies by communication method.

/ REA i EST/\ 1 F / ACCES~,IN<; PfWPE f~ l Y p

Any entry or construction activities on railroad right of way must be authorized by the railroad in writing. Written authorization is obtained through a Right of Entry Permit or Contractor

Occupancy/Access Agreement. The application is accessible via the link provided below.

The applicant must submit the completed application to the Real Estate Department including a check or money order, to cover the non-refundable fee of $1,750 made payable to the Railroad. The application must include latitude and longitude with aerial map of proposed worksite, and complete scope of work. If any of these items on the application are incomplete, the application will be immediately rejected.

The standard term for a Right of Entry Permit or Contractor Occupancy/Access Agreement is sixty

Upon approval of the application, the Real Estate Department will draft an agreement and forward to the applicant for signature. Application does not guarantee approval. The applicant must then return the signed document to the Real Estate Department along with the pertinent certificate of insurance outlined in the agreement. At this time we are unable to expedite requests for the installation of new private grade crossings, industrial track agreements, and track leases. The process for these requests varies somewhat from the review and approval process for new utilities and takes a little longer to secure all required approvals.

Entering or working on the railroad right of way or any other railroad property without the permission of the railroad is trespassing and illegal. Violators risk the possibility of serious, even fatal injury and will be prosecuted.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis‐Bacon Act for which the contract is awarded (and any

PAGE 36 OF 211PROPOSAL ID : 260124

solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health‐related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health‐related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government‐contracts.

Note: Executive Order 13658 generally applies to contracts subject to the Davis‐Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis‐Bacon Related Acts regardless of when they were awarded.

If a contract is subject to Executive Order 13658, the contractor must pay all covered workers at least $13.30 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in 2025. The applicable Executive Order minimum wage rate will be adjusted annually. Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

PAGE 37 OF 211PROPOSAL ID : 260124

A four‐letter identifier beginning with characters other than ""SU"", ""UAVG"", "SA", or "SC" denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198‐005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination.
