About this file
This is a Statement of Work for the procurement of medical malpractice insurance data to support CMS's Medicare payment update processes. The Centers for Medicare and Medicaid Services (CMS), specifically the National Health Statistics Group within the Office of the Actuary, requires 12-month access to the AM Best State Rate Filings database beginning July 28, 2026, and continuing through July 27, 2027. The contractor shall provide unlimited user access to a comprehensive online database containing complete rate filings for all 50 states and Washington D.C. dating back to 2008, along with descriptive filing summaries, exclusive market share and rank information organized by lines of business, export capabilities to Microsoft Excel and PDF formats, and customized alert functionality for email notifications of filing changes. The data will be used to update and expand CMS's physician and hospital professional liability insurance premium indexes for Medicare Market Baskets, with potential expansion to create indexes for nursing care facilities and allied health professionals.
The contractor must deliver database access to the COR, Jill Cooper at CMS's Office of the Actuary in Baltimore, Maryland by July 28, 2026. Quality assurance will be conducted by the Contracting Officer's Representative and technical lead within 30 days of receipt. The period of performance extends for 12 months from the original access date. CMS has noted that Section 508 accessibility compliance is not applicable to this online-only subscription. The only deliverable is unrestricted access to the AM Best State Rate Filings database as described in the Statement of Work reporting requirements.

STATEMENT OF WORK
(Medical Malpractice Data) 5/27/2026
I. SCOPE
Data is needed to update and expand the medical professional liability indexes that CMS produces for use in the CMS market baskets.
A. Background
The AM BEST State Rate Filing Database allows users to compare companies and monitor property/casualty filing information. AM Best's State Rate Filings gives you access to policy rate, rule and form changes, loss cost information and new programs for thousands of P/C insurers -- with complete filings included at no additional cost. This data is currently only available through the State Insurance Commissioners and we would have to go to every state in person and manually pull the data from files in order to collect this information.
The AM Best's State Rate Filings provide convenient online access to rate filings, now in one comprehensive archive. The redesigned site features enhanced search options and streamlined search results for complete filings and notable filings with descriptive summaries.
B. Purpose
For purposes of developing the physician and hospital professional liability insurance premium indexes for the Medicare Market Baskets used by CMS to annually update provider Medicare payments. The National Health Statistics Group (NHSG) in the Office of the Actuary (OACT) would like to purchase access to the state rate filings data from AM Best which would provide access to any approved rate increases over time for every company providing medical malpractice insurance, for all 50 states and Washington D.C.
We will use this data to expand the coverage and investigate the possibility of revising the methodology for constructing a hospital malpractice index and the possibility of creating other types of medical malpractice indexes, such as for nursing care facilities, and allied health professionals.
