About this file

Summary

This is a Notice of Proposed Sole Source Purchase from the Mississippi Forensic Laboratory (MSFL) seeking to procure CMI, Inc. Intoxilyzer 9000 breath alcohol testing equipment and accessories. The Intoxilyzer 9000 is an evidentiary breath testing instrument that detects the presence or absence of alcohol in individuals suspected of driving under the influence. The procurement includes 15 complete Intoxilyzer 9000 assemblies with one-year warranties at $9,095.00 each, along with numerous accessories and replacement parts including keyboards, mouthpieces, gas systems, barcode scanners, printers, cables, various assemblies, o-rings, batteries, and shipping. The total estimated purchase amount is $249,099.85. Interested parties must submit written objections to the sole source justification no later than Thursday, November 20, 2025, at 5:00 pm local time to Sonya Williams or Britney Wesley in the Procurement Department, 4th Floor, Room 402, Jackson, MS 39216.

MSFL asserts that CMI, Inc. is the sole manufacturer and distributor of Intoxilyzer 9000 equipment and that this is the only breath alcohol instrument utilizing four different infrared wavelengths for deep lung air sample detection. The agency notes that its existing program is approximately twenty years old and instruments are nearing end-of-life, making timely replacement critical to highway safety operations. MSFL states that all options to obtain the best possible price have been exhausted and that the amount is within expected price ranges for the requested items. Any objecting party must demonstrate that comparable equipment exists, explain how it meets agency needs, provide procurement sources, and include written authorization from CMI, Inc. if claiming the equipment is available from other distributors. If MSFL determines that alternative sources exist, the sole source request will be withdrawn and the procurement will proceed through an advertised competitive bid process. If MSFL determines only one source exists, the agency will appeal the determination to the Public Procurement Review Board (PPRB).
