About this file
This is a Construction Manager at Risk (CMAR) Preconstruction Services Agreement executed by the Trustees of The California State University for a public works project under California Public Contract Code 10700 et seq. The agreement establishes the terms under which a Construction Manager will provide preconstruction services necessary to support the specified project. The term of the agreement begins upon receipt of a fully executed agreement and written authorization to proceed from the Trustees and continues for a defined period, with work elements initiated during the contract term continuing through completion and acceptance. The Construction Manager is required to report to a designated supervisor and must not perform services exceeding the authorized agreement amount without prior written authorization from the Trustees.
The total contract amount is subject to budgeted funds availability as certified by the Accounting Officer and must comply with California State University contract law requirements as verified by the Executive Vice Chancellor and General Counsel. Payment shall be made according to the schedule outlined in Exhibit A. The Construction Manager must hold appropriate California licensure (B or C-10 license) and comply with prevailing wage rate requirements monitored by the California Department of Industrial Relations. Related task order construction agreements under the CSU MEA framework establish a three-year maximum budgeted cost of $960,000 for all projects, with individual projects capped at $200,000, and require a minimum three percent subcontracting allocation to Disabled Veteran Business Enterprises. Both the General Contractor and Architect must be prequalified with the CSU Capital Planning, Design and Construction Department.
