About this file

This is a Construction Manager at Risk (CMAR) Preconstruction Services Agreement template executed by the Trustees of The California State University for public works projects. The agreement establishes the framework for hiring a construction manager to provide preconstruction services on a specified project located at an identified site. The CM is responsible for furnishing all labor, materials, and equipment necessary to complete the work in a skillful manner in accordance with the agreement's terms. The service term commences upon receipt of a fully executed agreement and written authorization to proceed from the Trustees and extends for a defined period, with work elements initiated during the term continuing through completion and acceptance. The CM reports to a designated Trustees representative and may not perform services exceeding the agreement amount without prior written authorization.

The total contract amount is not to exceed a specified maximum, with payment made according to the schedule outlined in Exhibit A. The related task order construction agreement for elevator repairs operates under a three-year contract with a Total Maximum Budgeted Cost of $2,400,000 across all projects, with individual projects capped at $400,000. The General Contractor must hold a California C-11 license, and the project architect must be licensed to practice architecture in California, with both entities requiring prequalification with the CSU Office of the Chancellor's Capital Planning, Design and Construction Department. All projects are subject to California prevailing wage rate laws, monitored by the California Department of Industrial Relations, and require subcontracting a minimum of three percent to Disabled Veteran Business Enterprises. The Trustees do not guarantee a minimum volume of task orders or construction agreements under this contract.
