About this file

The document is a comprehensive project manual and contract opportunity for the Clayton Court Streetscape Project issued by the Town of Fraser, Colorado. The project involves a comprehensive streetscape renovation scheduled for September 2025, with a bid due date of November 10, 2025, and a mandatory pre-bid meeting on October 15, 2025. The work encompasses site controls, demolition, grading, asphalt paving, hardscaping, and electrical infrastructure improvements along Clayton Court. The project includes constructing new roadways, concrete paving, curbs, gutters, sidewalks, installing site furnishings, roadway signage, street striping, and electrical systems including streetlights and two EV charging stations.

The contract is structured with a base bid and two add alternate options for northwest and southwest sidewalk improvements. The total project involves approximately 2,850 square yards of asphalt paving, 1,770 linear feet of concrete curb and gutter, 6,965 square feet of concrete sidewalks, and seven light pole installations. The project requires a bid bond of 5% of the total bid amount, with the successful bidder required to provide performance and payment bonds equal to 100% of the contract price. The contract times are set at 90 calendar days for substantial completion and 125 calendar days for final completion, with liquidated damages of $1,000 per day for delays. Funding appears to be municipal, with the Town of Fraser appropriating funds for the project's completion.

Bidders will be required to fully inform the Engineer of their commitments to other work so that the Engineer may form an opinion as to their availability for prompt performance of this Contract. No Bid will be accepted from a Bidder who is engaged in work that would impair Bidder’s ability to perform or finance this Work.

5. Consider the information known to Bidder; information commonly known to contractors doing business in the locality of the Site; information and observations obtained from visits to the Site; the Bidding and Contract Documents; and the Site-related reports and drawings identified in the Bidding and Contract Documents, with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding and Contract Documents; and (3) Bidder’s safety precautions and programs;

and

9. Determine that the Bidding and Contract Documents are generally sufficient to indicate and convey understanding of terms and conditions for the performance of the Work.

B. The submission of a Bid will constitute an incontrovertible representation by Bidder that Bidder has complied with every requirement of this Article 4, that without exception the Bid is premised upon performing and furnishing the Work required by the Bidding and Contract Documents and applying specific means, methods, techniques, sequences, and procedures of construction that may be shown or indicated or expressly required by the Bidding and Contract Documents, that Bidder has given Engineer written notice of conflicts, errors, ambiguities, and discrepancies that Bidder has discovered in the Bidding and Contract Documents and the written resolutions thereof by Engineer are acceptable to Bidder, and that the Bidding and Contract Documents are generally sufficient to indicate and convey understanding of terms and conditions for performing and furnishing the Work.

Instructions to Bidders 00 21 13 – 5 of 12

1.06. CHANGES

A. The right is reserved by the Owner to revise or to amend any one of the stated parts of the Contract Documents prior to the date set for opening Bids. Such revisions and amendments, if any, will be announced by addendum, copies of which will be furnished to each Bidder obtaining a set of Contract Documents as provided for in the Invitation for Bids. If the revisions and amendments are of a nature which may require substantial changes in quantities or prices or both, the date set for opening bids may be postponed by such length of time as in the opinion of the Engineer will enable Bidders to revise their Bids. In such cases, the addendum will include an announcement of the new time for opening Bids.

1.07. TIME FOR COMPLETION

A. Time required for completion of the work is a basic consideration of the Contract as set forth in the Agreement and further described in the Special Provisions. The Contractor’s proposed construction schedule will be taken into consideration in the award of the Contract. Prior to the award of the Contract, the Bidder may be required to satisfy the Owner of its ability to complete the work within the time stated.

1.08. WARRANTY

A. The warranty period shall be two (2) years from the date of Substantial Completion.

1.09. SUBMISSION OF BID

A. Bids must be submitted at the location stated in the Advertisement for Bids before the bid expiration time.

1.10. MODIFICATION AND WITHDRAWAL OF BID

A. A Bid may be modified or withdrawn by an appropriate document duly executed in the same manner that a Bid must be executed and delivered to the place where Bids are to be submitted prior to the date and time for the opening of Bids.

B. If within 24 hours after Bids are opened a Bidder files a duly signed written notice with Owner and promptly thereafter demonstrates to the reasonable satisfaction of Owner that there was a material and substantial mistake in the preparation of its Bid, that Bidder may withdraw its Bid, and the Bid security will be returned. Thereafter, if the Work is rebid, that Bidder will be disqualified from further bidding on the Work.

1.11. EVALUATION OF BIDS AND AWARD OF CONTRACT

A. Promptly after the opening of the Bids, a compilation of them will be prepared and the certified checks submitted as Bid Guaranties by all Bidders, except the three lowest Bidders, will be returned. An abstract of the amount of the base Bids and major alternates, if any, will be made available to Bidders after the opening of Bids.

B. The certified checks of the three lowest Bidders for each Schedule will be returned as soon as the Bidder to whom the Contract has been awarded executes the Contract and furnishes the Performance Bond and Payment Bond with satisfactory Surety, but not later than (60) days after the date of the opening of Bids. The Contract will be

Instructions to Bidders 00 21 13 – 6 of 12 awarded within sixty (60) days after the opening of Bids unless all Bids are rejected, or unless the Bidder to whom the Contract was originally awarded fails to execute the Contract and furnish the required Performance Bond and Payment Bond.

C. Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, non-responsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder. Owner also reserves the right to waive informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder.

D. More than one Bid for the same Work from an individual or entity under the same or different names will not be considered. Reasonable grounds for believing that any Bidder has an interest in more than one Bid for the Work may be cause for disqualification of that Bidder and the rejection of Bids in which that Bidder has an interest.

E. In evaluating Bids, Owner will consider whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices and other data, as may be requested in the Bid Form or prior to the Notice of Award.

F. In evaluating Bidders, Owner will consider the qualifications of Bidders and may consider the qualifications and experience of Subcontractors, Suppliers, and other individuals or entities proposed for those portions of the Work for which the identity of Subcontractors, Suppliers, and other individuals or entities must be submitted as provided in the Supplementary Conditions.

G. Owner may conduct such investigations as Owner deems necessary to establish the responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, Suppliers, individuals, or entities proposed for those portions of the Work in accordance with the Contract Documents.

H. If the Contract is to be awarded, Owner will award the Contract to the Bidder whose Bid is in the best interests of the Project.

1.12. NOTIFICATIONS TO BIDDERS

A. In accordance with Section 24-103-908, Colorado Revised Statutes, notice is hereby provided that if any nonresident Bidders are from a state that provides a preference to Bidders from that state, then a comparable percentage disadvantage will be applied to the Bid of that nonresident Bidder.

B. Bidders shall have no right to any administrative, legal, or other protest, appeal, or challenge of any matter or grievance in connection with the solicitation or award of any contracts, including the evaluation of Bids and selection of a successful Bidder. In submitting a Bid, each Bidder acknowledges that it shall bear all costs associated with the preparation and submission of such Bid and that it shall under no circumstances have any right to recover the costs of such Bid preparation from the Owner or any other costs, expenses, or damages in the event such Bid is not accepted by the Owner.

Instructions to Bidders 00 21 13 – 7 of 12

C. The Owner reserves the right to confine its consideration of the Bids to the Base Bid or any requested alternate bids. The Owner reserves the right to reject any or all Bids, to waive inconsistencies, technicalities and informalities, or to advertise for new Bids if the Owner determines, in its sole discretion, that such actions are desired. The Owner further reserves the right to award the Contract on the basis of its own determination of which is the most responsive Bid which best serves the interest of the Owner and the public.

1.13. MISCELLANEOUS

A. Sales and Use Tax: The Owner is a political subdivision of the State of Colorado and is exempt from state sales and use tax on construction and building materials to contractors and subcontractors for use in construction of public works, in accordance with Sections 39-26-708(1) and 39-26-713(2)(d), Colorado Revised Statutes. This request will either be approved or denied by the Owner; however, the Owner will make a good-faith effort to accommodate all reasonable requests. The Bidder understands and agrees that, regardless of any position taken by the Owner or the Bidder, a court may order production of material deemed confidential, proprietary, or exempt from disclosure, and such a decision would be beyond the control of the Owner.
