The emergency generator must meet Tier 2-, Tier 3-, or Tier 4- Environmental Protection Agency emission standards.

ALL contracting actions require a Determination of Responsibility of the prospective contractor. Please see FAR 9.104-1 for the general standards for a prospective contractor to be determined responsible.

1. All work shall be in accordance with the Product Description, attachments, and all other terms and conditions herein.

2. Quotes shall be submitted per the following:

Quotes must set forth full, accurate and complete information, as required by this RFQ.

3. State and Local Taxes

The U.S. Army Corps of Engineers is exempt from paying state and local taxes per Title 4 United States Code 104-107. The U.S. Army Corps of Engineers Tax ID Number is 62-1642142.

Contractors performing services for the U.S. Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors. It is the contractor’s responsibility to investigate applicable federal, state, and local taxes, along with any specific exemptions that may exist.

This includes any applicable Value-Added Taxes (VAT), sales, use,and excise taxes.

The U.S. Army Corps of Engineers will not accept any invoice with a separate tax line. If there are any appropriate taxes, the contractor should considerer that tax as the cost of doing business and incorporate that cost within the cost of the item or job.

4. Delivery: This is F.O. B. Destination. All shipping/freight costs must be incorporated into the unit price. See the purchase description for delivery address.

5. PROSPECTIVE OFFERORS: Contractors shall be registered in the System for Awards Management (SAM) prior to award of a contract or agreement resulting from solicitations.

“Registered in the System for Award Management (SAM) database” means that –

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certification, and Points of contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process.

(4) The Government has marked the record “Active”.

This rule more efficiently implements the Debt Collection Improvement Act of 1996, as it requires contractors to be registered in SAM for consideration of future solicitations, awards, and payment.

Registration is required prior to award of any contract, basic agreement, basic ordering agreement, or blanket purchase agreement from a solicitation. LACK OF REGISTRATION IN THE SAM DATABASE WILL MAKE AN OFFER INELIGIBLE FOR AWARD. The web site may be accessed at www.sam.gov.

6. ELECTRONIC FUNDS TRANSFER (EFT): Effective 99 Jun 01, the Government will make all payments by EFT (unless the Government VISA credit card is accepted). The only exceptions are: 1) Foreign Vendors, 2) Government Agencies, and 3) One time payments.

The USACE Finance Center (UFC) has altered their process for obtaining electronic funds transfer (EFT) banking information utilized for vendor contract payment and will no longer accept UFC Form 23 to update EFT banking information for vendors. Banking information for all vendors will be retrieved from SAM.gov and entered into CEFMS II. There are no exceptions to this policy change. All contractors must notify the UFC via e-mail at: cefc-fc-eft@usace.army.mil when banking information has been updated in SAM.gov. Compliance with this requirement will help ensure timely payment to the correct bank account.

7. All questions resulting from this RFQ shall be submitted two (2) days prior to the closing date.

8. Award will be made to the lowest priced, responsible, quoter whose quote conforms to the requirements of the solicitation.

IAW FAR 12.205(b), offerors may propose more than one product (as determined by the Contracting Officer) that will meet a Government need in response to solicitation(s) for commercial items. Standby Emergency Diesel Generator Bridgeport, WA.

GENERAL INFORMATION:

The U.S. Army Corps of Engineers requires One (1) Standby Emergency Diesel Generator to be delivered to Chief Joseph Dam Bridgeport, Washington. The generator is to be fully enclosed for sound and weather, with integral fuel tank base, integrated load bank and mounted on a step deck trailer.

SPECIFICATIONS:

The Standby Emergency Diesel Generator and trailer shall meet or exceed this requirement as specified and shall have the following minimum salient characteristics:

FUNCTIONAL:

Standby Mobile Diesel Generator should be based on existing proven platform with all features and accessories for a reliable standby setup.

Control, Monitoring, and Alarm Console– compatible with 12- or 24-volt engine electrical systems, fully equipped with all necessary engine gauges, AC meters, and warnings, providing expanded generator set protection and monitoring

Standard Temp rise: 125/130 Deg C Meet the National Fire Protection Association requirement of NFPA-99 and NFPA-110 The emergency generator can meet Tier 2, Tier 3, or Tier 4- Environmental Protection Agency emission standards.

SUBMITTALS:

Descriptive Materials (brochures, illustrations, drawings, data sheets, etc.) must be submitted which will allow the Contracting Officer to determine, without discussion with the offeror, whether the products being offered meets all of the required specifications. Submittals shall include copies of catalog cut sheet, specification sheets.

OPERATION AND MAINTENANCE MANUALS:

Two complete copies of the Operation and Maintenance Manual will be required for the Standby

Emergency Diesel Generator. The manuals shall include instructions on the installation, operation, maintenance, repair, troubleshooting, and warranty. They shall also include diagrams listing all system components, part numbers, and a list of recommended spare parts.

Also included shall be the name, phone and fax numbers, and email address of the contractor, manufacturer, and a distributor where spare parts can be purchased.

ACCEPTANCE OF MATERIALS:

Materials will be inspected at the delivery point prior to acceptance. Contractor shall be responsible for maintaining the product’s condition as specified until the point of acceptance. New equipment only; no remanufactured or “gray market” items.

DELIVERY SCHEDULE:

The successful offeror shall be required to deliver the Standby Emergency Diesel Generator to Chief Joseph Dam within 120 days, partial delivery is acceptable. All deliveries must take place during CJD business hours of Monday through Thursday 7:00 am – 4:00 pm, excluding Federal holidays.

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (AUG 2020)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Commercial and Government Entity (CAGE) code means--

52.222-18 CERTIFICATION REGARDING KNOWLEDGE OF CHILD LABOR FOR LISTED END

PRODUCTS (FEB 2021)

(a) Definition.

Forced or indentured child labor means all work or service--

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

(b) Listed end products. The following end product(s) being acquired under this solicitation is (are) included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, identified by their country of origin. There is a reasonable basis to believe that listed end products from the listed countries of origin may have been mined, produced, or manufactured by forced or indentured child labor.

(c) Certification. The Government will not make award to an offeror unless the offeror, by checking the appropriate block, certifies to either paragraph (c)(1) or paragraph (c)(2) of this provision.

( ) (1) The offeror will not supply any end product listed in paragraph (b) of this provision that was mined, produced, or manufactured in a corresponding country as listed for that end product.

( ) (2) The offeror may supply an end product listed in paragraph (b) of this provision that was mined, produced, or manufactured in the corresponding country as listed for that product. The offeror certifies that it has made a good faith effort to determine whether forced or indentured child labor was used to mine, produce, or manufacture such end product. On the basis of those efforts, the offeror certifies that it is not aware of any such use of child labor.

52.223-22 PUBLIC DISCLOSURE OF GREENHOUSE GAS EMISSIONS AND REDUCTION GOALS--

REPRESENTATION (DEC 2016)

(a) This representation shall be completed if the Offeror received $7.5 million or more in Federal contract awards in the prior Federal fiscal year. The representation is optional if the Offeror received less than $7.5 million in Federal contract awards in the prior Federal fiscal year.
