About this file
This is a Class Justification and Approval (CJ&A) document for a sole source procurement by the Naval Surface Warfare Center, Crane Division (NSWC-Crane), Department of the Navy.
The contracting activity seeks to award a Firm Fixed Price Blanket Purchase Agreement (BPA) on a sole source basis to General Dynamics, Dedham, MA (CAGE 04655) for the procurement of Multi-Platform Encryptor (KG-204) products, including repairs and spares. The estimated requirement is valued at a maximum amount over five years, with authority to act under this CJ&A expiring on September 30, 2030. The supplies required include the ProtecD@R® Multi-Platform Encryptor (KG-204) to prevent unauthorized access to information, along with associated repair/rework and maintenance support services. The government's minimum needs have been verified by certifying technical and requirements personnel.
The justification for sole source procurement centers on General Dynamics being the only manufacturer of the NSA-approved KG-204 encryptor. NAVAIR estimates it would require at least seven years for an alternate source to design, develop, build, test, and qualify a competing Multi-Platform Encryptor for operational flight status, resulting in unacceptable schedule delays. Cost analysis identified approximately $17 million in estimated duplication costs to the government, including re-tooling production lines, reverse engineering, acceptance test procedures, first article testing, flight certification, electrical and stress analysis, and documentation revisions. No additional market research was conducted. The Contracting Officer has determined the anticipated cost will be fair and reasonable. NSWC Crane has no current plans to compete future contracts for these supplies/services but will assess feasibility if another potential source emerges. Kelly Kapanzhi, Contracting Officer, approved this procurement on the basis of 41 U.S.C. 1901 statutory authority.

5. Rationale Justifying Use of Cited Statutory Authority.
The is a Department of Defense Acquisition that received approval from the Under Secretary of Defense for Acquisition, Technology and Logistics to enter System Development and Demonstration in April 2008. As part of the effort, had NSWC Crane develop the and used on The current approved configuration of the and uses the Multi-Platform Encryptor (KG-204) as its National Security Agency (NSA) approved Encryptor. Currently General Dynamics is the only manufacturer of KG-204. NAVAIR estimates, based on the time it took General Dynamics to develop the KG-204, that it would take at least seven (7) years for an alternate source to design, develop, build, test, and qualify another
-Platform Encryptor for operational flight status. This would result in unacceptable delays and failure to meet schedule requirements. General Dynamics is the only source that will be able to produce an NSA approved Multi-Platform Encryptor to continue to meet the deadline and any competitive procurement would result in unacceptable delays and substantial duplicative costs in fulfilling the requirements.
To assess the impact that would result if another system were procured, the following cost factors were analyzed to arrive at an estimated duplication of cost to the Government: re-tooling the production line, reverse engineering, generation of acceptance test procedures, performance of first article testing, acquiring flight certification, performing electrical load analysis and stress analysis, and revising publications and documentation for part number changes to the master drawing package. The cost factors and their respective estimates were driven by previous program office efforts to certify similar aircraft communications equipment for flight. The estimated cost would exceed $17M for , which is a substantial duplication of cost to the Government that is not expected to be recovered through competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
No additional market research was conducted due to the rationale above.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government of the supplies and services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible.
