About this file
This is a Civil Litigation History Certification form required by the City of Pasadena for the Design-Build Services for a Hydrogen Fueling Station project in California. Bidders and proposers must disclose any civil litigation arising from the performance of construction contracts within California during the five to ten years preceding bid submission. The certification requires identification of the bidder/proposer, any officers, managers, or ownership interests, and the qualifying licensed person responsible for the work. The mandatory pre-proposal meeting is scheduled for April 23, 2026, at 10:00 AM, with questions due by May 22, 2026, at 2:00 PM, and proposals due June 8, 2026, at 2:00 PM. The design phase is estimated to commence in July 2026 for six months, construction will begin in February 2027 and last approximately 20 months, with substantial completion required by September 2028 and full commissioning by December 2028. Bidders must either provide a complete certification of no civil litigation history or provide detailed information on all cases, including case name, court case identification number, jurisdiction, and outcome.
Failure to provide the civil litigation certification or information may result in a determination that the bidder is non-responsive, while incomplete or inaccurate disclosure may result in a determination of non-responsibility. Litigation limited solely to enforcement of mechanics' liens or stop notices should not be included. The certification must be executed under penalty of perjury by the owner, officer, manager, or licensee responsible for submission of the bid/proposal. This requirement applies to all named plaintiffs or defendants in lawsuits brought by or against the project owner and is a mandatory submission component of the proposal package for the estimated $16,000,000 hydrogen fueling station project.
