SPECIFICATIONS

Adjustment of Quantities:

The quantities shown are to be considered as approximate only and may be amended to include additional quantities or additional items, or to decrease quantities or to exclude items of work. This listing of quantities and pay items is only an estimate as to the type of work and approximate quantities involved. The list of streets shown should be considered preliminary and may be amended to include additional streets or to decrease as dictated by project funding.

Unforeseen issues may arise during the course of the project that could also require changes to the project. The subtotals and totals included in this packet are for estimation purposes only.

The actual payout of each item will be on a unit-cost basis at the unit costs included by the Contractor in this bid packet. The Contractor will submit for payment based on actual measured units in the field or on weight tickets. The measurements and tickets must be included with each invoice. The units will be verified by the City Engineer prior to payment. All tickets must be submitted to the City at the end of each working day.

Qualification/Disqualification:

It is the intent that all bidders be responsible, competent, and qualified to complete the work.

No proposal will be considered unless it is accompanied by satisfactory evidence that the Bidder holds either a Georgia State Contractor's License, Georgia State Utility Contractor's License, or qualifications with the Georgia Department of Transportation for similar work, in compliance with Act. O.C.G.A. 43-14 and 43-41. Failure to provide the bidder's license or qualification number on the outside of the sealed proposal will result in rejection of the bid. Before the City executes the contract, the Contractor shall provide the following: (1) Proof of proper Workers Compensation Insurance as required per State law and (2) Proof of General Liability Insurance of $1 million per incident and $2 million aggregate. The City may at its discretion before executing contract, request proof of automobile insurance for all company vehicles used on this project.

Each bidder that has not performed similar work for the City within the last three years will provide, with the bid package, three references and a list of the three most recent projects of similar size and scope. Each reference should include the name of the individual, title, place of employment, phone number, and email address. Selected projects should be those that have been completed within the last three years and include the project name, location, owner, and a brief description.

Traffic Control:

Traffic Control is the responsibility of the Contractor. All traffic control items needed to ensure safe traffic movements during construction such as signs, barricades, barrels, pilot vehicles, etc., must be provided/operated by the Contractor as necessary. A formal written traffic control plan must be developed by the Contractor for all work within this contract and must be submitted to the City Engineer after the bid is awarded at least one week prior to the pre-construction conference for review. Traffic control measures may be inspected by the City Engineer on a daily basis prior to commencement of work. The City Engineer reserves the right to cease operations during construction in the event adequate or previously approved traffic control measures are not implemented or if conditions arise that warrant additional or revised traffic control measures. All traffic control will comply with Section 150 (Special Provision) of the

GDOT Standard Specifications and the current revised edition of the Manual on Uniform Traffic Control Devices. All barricades, warning signs, lights, temporary signs, and other protective devices shall conform to the MUTCD.

The length of work zones requiring pilot vehicles will be kept to a minimum and will not exceed

0.5 miles in total length unless approved by the City Engineer.

All intersections and adjoining streets within the work zone must, at a minimum, include the use of flagmen during the construction of the work.

Traffic control signage will be installed prior to beginning work, inspected, and approved by the City Engineer, covered with wood or plastic prior to starting work, uncovered during work, and remain, as needed, on the project until final payment for the project is issued by the City.

All costs associated with traffic control shall be bid as a lump sum. Partial payments, if requested, will be prorated based on the number of streets invoiced compared to the total number of streets in the project.

Pavement Cleaning:

It is the Contractor’s responsibility to ensure pavement is cleaned of unnecessary or excessive debris prior to and after construction or prior to and after different phases of work.

It is the intent that, if determined necessary by the City Engineer, the edge of paving will be clipped prior to the commencement of work by Contractor.

Patching:

Bid costs for patching will include cutting or planing asphalt to a depth of 2 inches or 4 inches below the existing surface, as directed, and removing and disposing of buildup materials.

Removal of materials to a greater depth may be required by the City Engineer if conditions warrant. The asphalt patch must be placed in lifts at a rate not to exceed 220 pounds per square yard.

Patching and Leveling Locations:

Patching and leveling locations will be marked on the street by the City Engineer prior to commencement of work. If planing is required, the Contractor will broom excessive dust and debris from the existing streetway surface in order for the City Engineer to adequately evaluate and mark areas to be patched.

Asphalt Paving and Mix Design:

Asphalt paving will comply with the GDOT Standard Specifications for Construction of Transportation Systems, Latest Edition, unless otherwise specified. Bituminous tack coat shall be applied as necessary to be determined by the Contractor to maximize performance. GDOT Certification(s) of all mix designs for this project must be included with the bid submission.

Bituminous Surface Treatment:

All materials and work associated with the Bituminous Scrub Seal will comply with the GDOT Section 424—Bituminous Surface Treatment, with exceptions only as specifically discussed below. The City of Winder is using the surface treatment solely as a reflective crack inhibitor and, as such, it must be covered with asphaltic concrete as soon as practicable after placement of the surface treatment. The Contractor must plan and place the bituminous surface treatment in a manner so there will be no traffic, nor the need for any traffic (i.e. driveway/access needs), on the completed treatment prior to placement of the asphalt wearing surface and must be covered with asphalt by close of business each day. Under no circumstances shall the Surface Treatment be used as, or remain as, a wearing surface. The application rate of 89 rock should be reduced as necessary, to be determined by the Contractor, to ensure that adequate asphalt emulsion is available to act as a tack coat for the asphalt wearing surface. It is the City’s expectation that the Contractor, using experience and knowledge of the processes and materials involved, will adjust as necessary the surface treatment/asphalt overlay process such that the surface treatment and asphalt overlay adhere and act as a composite without ever exposing traffic to the surface treatment. Cleanup/removal of 89 aggregate from gutters must begin as soon as practicable after placement of the asphalt wearing surface. Complete removal of the aggregate from the gutters and driveways, as applicable, must be completed by the close of business each day.

Rolling Pattern:

It is the City’s intention to obtain maximum practically achievable density. If necessary, a “rolling pattern” will be established by the Contractor on all streets that measure greater than 1,000 feet along the centerline of the street. The “rolling pattern” will be established by measuring densities at a location to be approved by the City Engineer. To establish the “rolling pattern”, a density gauge should be used to determine the number of roller passes that correlate with the maximum density for that particular street. If street conditions are known to be or expected to be substantially different in different locations, more than one “rolling pattern” may be required for a given section of streetway.

Striping and Other Traffic Control Devices:

This section applies only to streets that are specified to receive striping, which must be provided by the Contractor. Temporary striping and other temporary traffic control devices, as required, must be installed for each project location prior to traffic being introduced back on the streetway. Temporary striping shall consist of paint and/or tape.

Layout of striping, markings, etc., will be the responsibility of the Contractor and comply with GDOT Standard Specifications for Construction of Transportation Systems, Latest Edition, GDOT design specifications, and the MUTCD, as applicable.

All locations receiving temporary and permanent traffic control striping, markings, etc., will be cleaned (either by broom or any other acceptable method) prior to striping or marking and will be the responsibility of the Contractor.

Temporary striping and other traffic control devices will generally include, at a minimum, stop bars, turn arrows, yield lines, lane lines, crosswalks, and centerlines unless indicated on the bid sheet.

All permanent traffic control devices including striping, markings, legends, and reflectors must be completed within 30 calendar days but no earlier than 15 calendar days of completion of the final paving operations.

Utility Manholes and Valves:

The Contractor must contact the City of Winder Utilities Department at least one week before paving operations begin to adjust the elevation of utility valves. City of Winder personnel will be solely responsible for the placement of appropriate risers, which will be provided by the City.

With regard to sanitary sewer manholes, Contractor shall pave over the existing lid. The location of the manhole shall be identified by exposing a small portion of the lid. Existing raised pavement markers for water appurtenances shall be replaced by City of Winder personnel.

City of Winder Utility Contacts:

Utility Manholes:

Tyler Black – Assistant Project Manager Phone: 770.868.0863

Utility Valves:

Ted Tillery – Construction/Maintenance Supervisor Phone: 678.764.1433

Tie-ins:

Adequate planing is required to ensure a smooth and seamless transition between new pavement and existing pavement to include side streets and driveways. Tie-ins should be made at the back of the radius of the side street that intersects the project street unless otherwise marked or noted within the street section summary. Any necessary planing and other costs not listed as separate bid items must be included in the presented bid items.

Safety:

All safety as related to the work outlined in this bid is the responsibility of the Contractor and will comply with all applicable local, state, and federal regulations and requirements.

Clean Up:

All work being performed shall be performed in a manner to ensure that unnecessary spillage, trash, debris, etc., does not remain on the project. The project will be cleaned of excess materials and debris on a daily basis. The City Engineer reserves the right to control the timeliness of cleanup work at each project location, and, if necessary, stop production of payable items until cleanup is completed.

Driveways, parking lots, access streets, intersecting streetways, or any other areas on which materials might accumulate will be swept clean of any loose materials, spillage, trash, aggregate, debris, etc., to the satisfaction of the City Engineer.

Responsibility for Claims:

Contractor shall comply with Section 107, Legal Relations and Responsibility to Public, among others of the GDOT Standard Specifications for Construction of Transportation Systems, Latest Edition.

Contractor shall indemnify and save harmless the City of Winder, its officers, employees, and consultants from all suits, actions, claims of any character brought because of any injuries or damages received or sustained by any person, persons, or property due to the operations of the Contractor; or because of or in consequence of any neglect in safeguarding the work; or through use of unacceptable materials in constructing the work; or because of any act or omission, neglect or misconduct of the Contractor; or because of any claims or amounts arising recovered under the “Workmen’s Compensation Act” or any other law, ordinance, order, or decree; and so much of the money due the Contractor under and by virtue of his contract as may be considered necessary by the City for such purpose, may be retained for the use of the City; or, in case no money is due, his surety will be held liable until such suit or suits, action or actions, claim or claims for injuries or damages as aforesaid shall have been settled and suitable evidence to that effect furnished to the City; except that money due the Contractor will not be withheld when the Contractor produces satisfactory evidence that he is adequately protected by public liability and property damage insurance (Section 107.15(e), GDOT Standard Specifications for Construction of Transportation Systems).

Performance Bond/Warranty:

All bids shall be accompanied by a bid bond for five percent (5%) of the total bid (no personal or company checks are accepted). A performance bond and a payment bond equal to 100 percent (100%) of the awarded bid price must be submitted for review and approval after the contract is awarded and no later than the preconstruction conference. All bonds must meet qualifications acceptable to the City of Winder and shall be secured from bonding companies licensed to do business in the State of Georgia. Contractor Warrants and Guarantees workmanship and materials for which the Contractor is responsible to be free from defects for a period of one year following final approval of the project.

Invoices/Pay Applications:

Pay applications may be submitted to the City’s Engineering Department monthly, and must include a breakdown of each pay item, the total billing for the current pay period including quantity and cost, and the total billing to date for the project including quantity and cost. Pay applications that do not include this information may be returned to the Contractor and resubmitted to the City upon correction of the application. All payments will be made on a Net 30-day basis. A 5% retainage fee will be withheld on partial payments as discussed below. The purchase order number for this project must be indicated on each invoice.

Preconstruction Conference:

No pre-bid meeting will be held for this bid. However, a mandatory preconstruction conference will be scheduled after the bid is awarded, with the date to be determined later. It is the City’s intention to issue the Notice to Proceed on the same day as the preconstruction conference.

Proof of insurances, payment and performance bonds, traffic control plan, schedule of operations, subcontractor list, and GDOT certification of all mix designs must be submitted for review and approval after the contract is awarded and no later than the preconstruction conference.

Retainage:

Retainage will be withheld at the rate of five (5) percent of the monetary value of the work completed until the project has reached Fifty (50) percent complete. At that time the retainage may be reduced to two and one half (2 ½) percent if the status of the work is satisfactory and approved by the Director. Retainage will not accrue interest. Final Payment of the amounts withheld will not be made until the project has been satisfactorily completed and accepted by the City of Winder.

Any deviations to these timelines must be approved in advance by the City Engineer.

Failure to complete the work within the number of days stipulated in the signed Contract Documents, including extensions granted thereto, shall entitle the City of Winder to retain from compensation otherwise due to be paid to the Contractor, or otherwise recover by all remedies of law an amount equal to $500.00 for each and every calendar day that the work is not completed. It is agreed by and between the City of Winder and the Contractor that this sum has been established, not as a penalty, but as liquidated damages and that it is reasonable and acceptable, as the City provides services necessary for the health and welfare of the public and due to the impracticability and extreme difficulty of fixing and ascertaining the actual damages assessed for each consecutive calendar day of delay in the completion date.

7. Submission of Bids: Bids shall be submitted at the time and place indicated in the Invitation.
