About this file

This document is a sole source justification for a Charmilles EDM preventative and remedial maintenance contract opportunity. The Air Force Sustainment Center at Tinker Air Force Base seeks to award a firm fixed price contract to GF Machining Solutions for maintenance of Charmilles electrical discharge machines. The incumbent contractor will provide preventative maintenance twice annually and remedial maintenance once annually for each of fourteen machines over a five year period from July 2020 to January 2026. As the original equipment manufacturer, only GF Machining Solutions possesses the proprietary data and authorization required to service this equipment without voiding warranties or impacting performance. The Air Force determined the anticipated cost to be fair and reasonable based on independent estimates and historical pricing under previous contracts. Market research found no other authorized sources capable of meeting requirements.

IV. Statutory authority permitting other than full and opencompetition.

AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor'sunique qualifications or nature of the acquisition requires the use of the authority cited above (applicability ofauthority).

The existing wire EDMs have been maintained by the GF Machining Solutions (OEM) under Contract FA8125-12-M-0002, FA8101-06-M-0250 & FA8125-15-C-0014. The OEM owns all proprietary data and there are currently no authorized vendors who can operate on Government machinery without impacting warranty.

The Government does not have appropriate data use rights to provide copies to contractors to repair and maintain the equipment.

The Government does not have the use rights to the source code data such as machine parameters and machine original specifications. The OEM has denied Government’s request to purchase data rights to the machinery.

Numerical Control (NC) is the automation of machine tools that are operated by precisely programmed commands encoded on a storage medium, as opposed to controlled manually via hand wheels or levers or mechanically automated via cams alone. Most NC today is computer numerical control (CNC) in which computers play an integral part of the control.

Electrical Discharge Machining (EDM) is a manufacturing process whereby a desired shape is obtained using electrical discharges (sparks). Material is removed from the workpiece by a series of rapidly recurring current discharges between 2 electrodes, seperated by a dieelectric liquid and subject to an electric voltage.

Award to any unauthorized source could result in inadequete performance and could potentially lead to unacceptable delays in fulfilling the requirements of the Air Force. Additionally, a non OEM source would need to subcontract to the OEM to get data rights which could lead to duplication of efforts and potential increased subcontracting costs and delays.

VI. Description of efforts made to ensure that offers are solicited from asmany potential sourcesaspracticable.

The Government made several attempts to identify vendors capable of meeting this requirement. The Government utilized the Small Business Administration's (SBA) website and World Wide Web to search for vendors advertising their ability to work on OEM equipment.

A Sources Sought Synopsis (SSS) was posted in the past and no new sources were identified.

Additionally, in accordance with FAR 5.201, this requirement will be synopcized and publicized on beta.sam.gov website.

The only company capable is identified below:

1) GF Machining Solutions (Original Equipment Manufacturer)

560 Bond St, Lincolnshire IL 60069 | Cage Code: 72112 | Large Business

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will utilize price analysis techniques IAW FAR 13.106-3(a)(2), to ensure the price is fair and reasonable.

Specifically, the Contracting Officer will compare the proposed price to the Independent Government Estimate as well as historical prices paid under contracts FA8125-12-M-0002, FA8101-06-M-0250 & FA8125-15-C-0014.

The Contracting Officer will ensure that the services described herein are negotiated at a fair and reasonable price to the Government. The Contractor may be required to provide other than certified cost and pricing data to supplement our comparison with historical pricing and Government estimates.

VIII. Description of the market researchconducted and the results, or a statement of the reasonsmarket research was not conducted.

Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items

FOR OFFICIAL USE ONLY Page of11 Mar 20

The Government conducted market research through March 2020 for this acquisition by searching the World Wide Web and Small Business Administration website for vendors certified to work on OEM machinery. Currently there are no OEM authorized repair centers.

Based on market research it was determined by the Government that only the OEM is currently capable of providing Preventive Maintenance and Remedial Maintenance services as noted in the PWS.

The results of MR provide a high level of confidence that no other qualified sources exist.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None

X. List of any sources that expressed, in writing, an interest in the acquisition.

1) GF Machining Solutions (Original Equipment Manufacturer)

560 Bond St, Lincolnshire IL 60069 | Cage Code: 72112 | Large Business

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The Government will continue efforts to identify sources with authority to work on OEM machinery.

Per DFARS PGI 206.304(a)(S-70)- As indicated by signature on the Coordination and Approval Document, the previous J&A has been reviewed and the Approval Authority determines that all stated actions to remove barriers to competition have been accomplished.

XII. Certification by theContracting Officer.

Asevidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

XIII. Certification by the technical/requirements personnel.

Asevidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
