About this file

This document is a Change Order Notice from the Illinois Department of Natural Resources (IDNR) regarding a contract (ENG419029A) with Linden & Company for the purchase and delivery of a 24" mobile pump for use at the Mississippi River State Fish and Wildlife Area. The IDNR is issuing a change order to extend the contract termination date to May 31, 2020 due to unforeseen conditions that have delayed the manufacture of the pump. These conditions include Hurricane Dorian forcing the factory to close, a redesign of the existing units to meet current diesel emission standards, and fabrication delays due to the company's press brake being out of service.

The change order will allow sufficient time for the pump to be manufactured, delivered, and tested on site during the Spring of 2020. The circumstances causing the delay were unforeseeable at the time the contract was executed, and the change is germane to the original contract.

The Illinois Department of Natural Resources (IDNR) requires a change order to a contract (ENG419029A) with Linden & Company to extend the contract termination date to May 31, 2020. The Agency requires the change order as defined in 30 ILCS 500/1-15.12 and 720 ILCS 5/33E.

The contract for the purchase and delivery of a 24” mobile pump for use at Mississippi River State Fish and Wildlife Area requires an extension due to unforeseen conditions delaying the manufacture of the pump. The following conditions were cause for delay:

1.) Hurricane Dorian forced the factory which manufactures this pump to close.

2.) The existing units required a redesign to meet current diesel emission standards.

3.) The company’s press brake was out of service causing fabrication delays.

Extending the contract term by five (5) months will allow sufficient time for the pump to be manufactured, delivered and tested on site during the Spring of 2020.

The circumstances were unforeseeable at the time the contract was executed and changes are germane to the original contract.
