About this file
This is a Change Order Notice issued by the Chief Procurement Office for General Services in Illinois for a Department of Corrections waste hauling contract (Reference No. 24-426 DOC-WESTE-P-67830). The change order addresses a waste hauling contract that requires modification due to significant tonnage underestimation and increased actual waste generation at the facility. The original contract budgeted 98 tons annually, but Year 1 actual tonnage reached 751.14 tons and Year 2 actual tonnage was 741.99 tons. The contract term spans multiple years with anticipated increases in both tonnage and cost per ton for Year 3, necessitating additional funding to continue service payments including tonnage and hauling fees.
The original Year 1 budget of $4,900 resulted in actual costs of $37,557, while Year 2's budgeted amount of $5,292 resulted in actual expenditures of $40,067.46. The substantial variance between projected and actual costs has depleted available funds for Year 3 services. The Chief Engineer anticipates further tonnage increases and rising per-ton costs for the facility in Year 3. This change order notice, which increases contract costs by more than $25,000, was required to be posted on the Bulletin/BidBuy for 14 days pursuant to procurement regulations governing renegotiated contracts and change orders.

This Change Order Notice provides detail as to why the change order is needed and, pursuant to Section 33E-9 of the Criminal Code, that the circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed or the change is germane to the original contract as signed. Change orders are defined by Section 1-15.12 of the Procurement Code and Section 1.2067 of the CPO-GS' Administrative Rules.

| thedetails: Increase to waste hauling contract due to underestimating tonnage and an increase in actual tonnage. For year 1 of the contract, ninety-eight tons of trash was budgeted for the year, actual tonnage at the end of the year was 751.14 tons. The original budget for year 1 for tonnage was $4,900, but the actual amount was $37,557. In year 2, ninety-eight tons was budgeted for the year, but actual tonnage was 741.99 tons. The budget for tonnage for year 2 was $5,292, but actual cost was $40,067.46. Because of the miscalculations, we do not have enough funds to start paying for services in year 3, which include the tonnage and hauling fees. The cost per ton is increasing for year 3 and our Chief Engineer is anticipating an increase in tonnage for the facility. |
