About this file
This document is a Change Order Notice issued by the Illinois Chief Procurement Office General Services related to a contract for the purchase of PM2.5 Federal Equivalency Monitors (FEM) for the Illinois Environmental Protection Agency (EPA). The change order is necessary because the Illinois EPA requires the ability to purchase up to 45 PM2.5 monitors and 15 monitoring shelters to comply with comprehensive ambient air monitoring and public reporting requirements specified in Federal law. The contract previously stated "indefinite quantity", so the change order increases the not-to-exceed (NTE) amount to $1,094,914.50 to accommodate the additional monitors and shelters needed.
The change order details that the requirement for the additional monitors and shelters was not reasonably foreseeable at the time the original contract was signed, but is germane to the original contract as the Illinois EPA operates close to 30 PM2.5 monitor sites and requires additional monitors for backup, rotation, and future needs. Failure to conduct the required air monitoring would constitute a failure to comply with the Federal Clean Air Act.

Change Order Notice Chief Procurement Office General Services v.21.1
44 Ill. Adm. Code 1.1525(h) requires notice of renegotiated contracts and change orders that increase the cost of a contract by more than $10,000 or the time of completion by a total of 30 days or more to be posted on the Bulletin/BidBuy for 14 days.
This Change Order Notice provides detail as to why the change order is needed and, pursuant to Section 33E-9 of the Criminal Code, that the circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed or the change is germane to the original contract as signed. Change orders are defined by Section 1-15.12 of the Procurement Code and Section 1.2067 of the CPO-GS' Administrative Rules.
