About this file

This document is a Change Order Notice from the Illinois Department of Natural Resources (IDNR) regarding contract ENG121027 with O'Brien Civil Works, Inc. for the DNR Lowden - Renovate Eternal Indian Plaza project. The change order is being requested to add additional work to the original contract, which includes correcting an issue with the survey that led to the need for additional grading and extending an ADA accessible path to connect to an existing non-ADA path. Additionally, a retaining wall at the base of the historic 'Eternal Indian' sculpture was not long enough, requiring additional work to correct the steep grades and potential erosion issues. The change order will add $11,690.00 to the original contract value.

The change order is being issued pursuant to Section 33E-9 of the Criminal Code, which requires posting of renegotiated contracts and change orders that increase the cost of a contract by more than $10,000 or the time of completion by a total of 30 days or more. The change order is considered germane to the original contract as signed.

Change Order Notice Chief Procurement Office General Services v.20.1

44 Ill. Adm. Code 1.1525(h) requires notice of renegotiated contracts and change orders that increase the cost of a contract by more than $10,000 or the time of completion by a total of 30 days or more to be posted on the Bulletin/BidBuy for 14 days.

This Change Order Notice provides detail as to why the change order is needed and, pursuant to Section 33E-9 of the Criminal Code, that the circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed or the change is germane to the original contract as signed. Change orders are defined by Section 1-15.12 of the Procurement Code and Section 1.2067 of the CPO-GS' Administrative Rules.

ProcurementTitle: DNR Lowden - Renovate Eternal Indian Plaza
DropDownList1: DNR - Natural Resources
thedetails: The Illinois Department of Natural Resources (IDNR) requests a change order to a contract (ENG121027) with O’ Brien Civil Works, Inc., to add additional work to the original contract. 2 separate issues have been discovered during construction of an additional cost of $11,690.00. An in the field discovery that the survey was incorrect has lead to the conclusion that additional grading is required and an ADA accessible path was extended to connect to an existing non-ADA path. The revised ramp has a drop-off that can be addressed through the extension of a historic landscape wall. This will reduce the risk to our visitors accidentally stepping off the path but will also improve the aesthetics of the plaza connection to the existing non-ADA path. As the project was nearing completion, it was discovered that due to an error with the survey a retaining wall at the base of the historic 'Eternal Indian' sculpture was not long enough to resolve grades. As currently installed, the grades are very steep and prone to erosion and wear. Furthermore, there is an opportunity to fine grade a swale to redirect stormwater sheet draining down the newly installed ADA path and redirect it away from the Plaza. These updates require additional work by the vendor to correct these issues.
