Definitions Commercial Item Per the Federal Acquisition Regulations, “Commercial Item” means any item, other than real property, that is of a type customarily used by the general public or by non-governmental entities for purposes other than governmental purposes, and has been sold, leased, or licensed to the general public; or has been offered for sale, lease, or license to the general public;

any item that evolved from an item described in paragraph a. of this definition through advances in technology or performance and that is not yet available in the commercial marketplace, but will be available in the commercial marketplace in time to satisfy the delivery requirements under a Government solicitation;

any item that would satisfy a criterion expressed in paragraphs a or b of this definition, but for

1. modifications of a type customarily available in the commercial marketplace; or minor modifications of a type not customarily available in the commercial marketplace made to meet Federal Government requirements. Minor Modifications means modifications that do not significantly alter the non-governmental function or essential physical characteristics of an item or component, or change the purpose of a process. Factors to be considered in determining whether a modification is minor include the value and size of the modification and the comparative value and size of the final product. Dollar values and percentages may be used as guideposts, but are not conclusive evidence that a modification is minor;

any combination of items meeting the requirements of paragraphs a, b, c, or e of this definition that are of a type customarily combined and sold in combination to the general public;

installation services, maintenance services, repair services, training services, and other services if

1. such services are procured for support of an item referred to in paragraphs a, b, c, or d of this definition, regardless of whether such services are provided by the same source or at the same time as the item; and the source of such services provides similar services contemporaneously to the general public under terms and conditions similar to those offered to the Federal Government;

services of a type offered and sold competitively in substantial quantities in the commercial marketplace based on established catalog or market prices for specific tasks performed or specific outcomes to be achieved and under standard commercial terms and conditions. For purposes of these services

1. “Catalog price” means a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or vendor, is either published or otherwise available for inspection by customers, and states prices at which sales are currently, or were last, made to a significant number of buyers constituting the general public; and “Market prices” means current prices that are established in the course of ordinary trade between buyers and sellers free to bargain and that can be substantiated through competition or from sources independent of the offerors;

any item, combination of items, or service referred to in paragraphs a. through f. of this definition, notwithstanding the fact that the item, combination of items, or service is transferred between or among separate divisions, subsidiaries, or affiliates of a contractor; or an NDI, if the procuring agency determines the item was developed exclusively at private expense and sold in substantial quantities, on a competitive basis, to multiple State and local governments.

Commercially Available Off-the-Shelf (COTS) Item Per the Federal Acquisition Regulations, FAR 2.101 “COTS”

1. means any item of supply (including construction material) that is

1. a commercial item (as defined in paragraph (a) of 3.2.1 in the definitions section);

sold in substantial quantities in the commercial marketplace; and offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

1. does not include bulk cargo, as defined in 46 USC 40102(4), such as agricultural products and petroleum products.

Computational System A computational system is one or more computational subsystems, their peripheral devices, and network equipment working synergistically to satisfy a set of requirements.

Computational Subsystem A computational subsystem, also referred to as a computer or subsystem is a programmable electronic device that can store, retrieve, and perform prescribed mathematical and logical operations.

Days All "days" identified in this SOW and CDRL items are "business" days, which are defined as Monday thru Friday, unless otherwise noted.

Defects A defect can consist of DRs, STR, and SNCRs noticed during any inspection event. Reference NAVAIR M-3905.1 for definitions.

Deficiency Report (DR) Categories DRs will be categorized as Part I through Part III. During Joint Inspection events and Configuration Audits, the Government will assign DR categories as deemed appropriate. The following are the definitions of the DR categories:

Part I Deficiency Reports (DRs) A Part I deficiency indicates a severe deficiency, the correction of which is necessary because it adversely affects accomplishment of an operational or mission essential training objective, or jeopardizes safety, security, life cycle support, or other critical training system requirements. Part I deficiencies occur in the following situations:

1. There is a deviation that exceeds acceptable tolerances in the training device characteristics, response, or functionality when compared to the system being simulated.

1. The training system causes a negative transfer of skills or the development of habit patterns that would result in an unsafe condition if conducted in the operational environment.

The training system or its subsystems do not provide adequate capability, functionality, or fidelity to accomplish required training objectives.

External and environmental simulations (such as radar, threats, and High Level Architecture) are insufficient to accomplish required training objectives.

The level of performance in the training device consistently exceeds that of the simulated system, or a task workload is excessively low compared to the simulated system.

The reliability, availability, and/or maintainability of the training system are insufficient to support operational readiness.

Excessive instructor or simulator operator compensation is required in order to meet training objectives.

A severe hazard to personnel and/or equipment exists (as defined in OPNAVINST 3750.6S).

Part I Deficiency Report (DR) Resolution Timing Part I deficiencies may employ the use of "Stars" (asterisks (*)) to designate a specific recommended time for accomplishment of corrective action. While stars will, by association, be a reflection of the relative seriousness of the deficiency, the focus of stars should remain on the timing recommendation.

1. Double Star Part I (Part **I) - Safety critical deficiencies or deficiencies that would preclude or degrade accomplishment of primary or alternate mission(s) to such a degree as to preclude further inspection of the system will be assigned a Part **I with recommended correction prior to further inspect or next inspection phase.

1. Single Star Part I (Part *I) - Deficiencies with recommended correction prior to Ready for Training (RFT) of the training system.

Part II Deficiency Report (DR) A Part II deficiency indicates a deficiency of lesser severity than a Part I that does not degrade the training system to a state precluding accomplishment of the training objectives, but correction will result in significant improvement in the training system. Part II deficiencies occur in the following situations:

1. A deviation from the real system’s characteristics or functionality is apparent, but does not substantially degrade task performance or prevent achieving training objectives.

1. A deviation from the real system’s characteristics or functionality is not apparent and, therefore, requires training evolutions be interrupted in order to describe the correct system functionality and meet required training objectives (instructor or operator compensation or intervention).

The training device causes a negative transfer of skills or the development of habit patterns that would adversely affect effectiveness in the operational environment.

A routine safety hazard to personnel and/or equipment exists (as defined in OPNAVINST 3750.6S).

Part III Deficiency Report (DR) A Part III DR indicates a deficiency that is annoying or requires minimal compensation to overcome. The system fidelity could be improved, but can be tolerated with little or no impact to training objectives. The training device deviates from the real system’s characteristics, fidelity, or functionality in a way that is not readily or routinely apparent during training. The training system meets training objectives and builds the skill sets required for training tasks, but the human-system interface or experience differs from the real system.

System Trouble Report (STR) STRs identify problems related to verification that the training system is specification compliant. During Hardware/Software Integration and contractor tests, the contractor will utilize a STR system. The contractor's defined STR process will be submitted to the Government Production T&E IPT for approval or modification prior to deficiency reporting during H/SI. During Joint Test events and Configuration Audits, the Government will assign STR categories as deemed appropriate. The following definitions of the STR categories are defined (Reference IEEE 12207.2-1997, Figure J.2).

Priority 1 Priority “1” STR prevents the accomplishment of essential training capability specified by baseline requirements, creates a safety hazard or jeopardizes a critical requirement.

Priority 2 Priority “2” STR adversely affects accomplishment of essential training capability or Reliability,…
