Mortgage Performance Data

MORTGAGE PERFORMANCE DATA FOR THE CONSUMER FINANCIAL

PROTECTION AGENCY, OFFICE OF RESEARCH, MARKETS, AND

REGULATIONS, WASHINGTON, DC

COMBINED SYNOPSIS/SOLICITATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is being issued as a Request for Proposal (RFP) under CFP-17-R-00014. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-95.

The NAICS Code for this procurement is 519190 – All Other Information Services

1.0 PRICING TABLE – Total Evaluated Price

The Consumer Financial Protection Bureau (CFPB or Bureau) is seeking the right to use mortgage origination, performance, and modification data for a 12-month base period and for up to four 12-month government option periods, and the right to use and maintain an archive of the acquired data to support “Work Product” and “Existing Work Product” (as defined in 2.9) for a period of five years after the base period or the last exercised option year (if exercised), whichever is later. Please see 2.9, below, for the full extent of Government Use Rights required under this solicitation.

Proposals shall include a price for the base year and each option period: Please complete the below Pricing Table by providing a Firm Fixed Price for the Base Period, Option Period 1, Option Period 2, Option Period 3 and Option Period 4; these figures will be totaled to arrive at each vendor’s/offeror’s Total Evaluated Price.

2.0 DESCRIPTION OF REQUIREMENTS

2.1 Background

The Consumer Financial Protection Bureau (CFPB or Bureau) actively conducts research in support of the Bureau’s mission to protect consumers. To better assist in those efforts, the Research, Markets, and Regulations (RMR) Division seeks to acquire the right to use mortgage origination, performance, and modification data for a period to include the base period and up to four additional government option periods, and the right to use and maintain an archive of data acquired by the Bureau during all base and executed option periods (if exercised) that can provide a more comprehensive picture of the mortgage market than what is currently available from public sources. See 2.9, below, for the full extent of the Government’s Use Rights that the Government requires under this solicitation.

ALL REQUIREMENTS HEREIN ARE MINIMUM UNLESS NOTED OTHERWISE.

2.2 Data Format

Datasets will be made available in standard formats (e.g. csv, tab-delimited text, XML) that are natively compatible for loading into SAS Server, PostgreSQL, and MS SQL Server environments. Datasets will be made available to CFPB via common file transfer protocols (e.g., SFTP).

2.3 Data Set/Data Coverage

The data shall meet the below requirements, and contain substantial coverage of the entire US mortgage market including loans eligible for mortgage backed securities (MBS) created by Government National Mortgage Association (GNMA or Ginnie Mae), Federal National Mortgage (FNMA or Fannie Mae), and Federal Home Loan Mortgage Corp (collectively, agency eligible loans) and loans that are not eligible for agency-created MBSs (collectively, non-agency loans).

The data shall contain loan-level mortgage data covering the following segments with the following minimum loan amounts in each segment:

• Loans sold to Fannie Mae and Freddie Mac, 50 million loans

• Loans held in lenders’ portfolios, 2.5 million

• Loans sold to private-label MBS trusts

• FHA loans, 15 million

• VA loans, 5 million

• FSA/RHS loans, 400,000

The data shall contain information on loans of the following types:

• Prime loans

• Sub-prime loans

• Alt-A loans

• Conforming loans

• Jumbo loans

• First liens

• Second liens

• Home Equity Lines of Credit

• Reverse mortgages

2.4 Timeframe

Monthly loan performance and modification data beginning January 1999, with associated loan origination data.

2.5 Required Data Fields

Data fields refer to the name and label of specific data contained in the vendor’s data set.

In order to evaluate the proposal the Bureau must receive a list of all data fields contained in the data set, which must, at minimum, include the following fields:

Origination data:

• Origination date

• Original term

• Maturity date

• Original balance

• Loan purpose (e.g. purchase, refinance, home improvement)

• Market segment (see above)

• Initial interest rate

• DTI

• Original LTV

• Prepayment penalty

• Loan rate type (e.g. fixed rate, ARM, balloon) and associated characteristics (e.g. negative amortization, ARM index, ARM conversion, interest-only ARM) o For loans with a balloon payment, the date of the payment o For loans with a rate or payment that is not fixed over the life of the loan, the date of the first change, the frequency of subsequent rate changes, any caps and floors on per-period changes and caps and floors on lifetime changes.

• Loan type (e.g. conventional, VA, FHA)

• GSE eligibility (e.g. conforming, non-conforming, jumbo conforming)

• Lien position

• Property type (e.g. single family, multi-family, condominium, co-operative, commercial, manufacturing housing etc.)Occupancy status

• Number of units (e.g. 1 unit, 2-4 units, 5+units)

• Property zip code

• Prepayment penalty status and associated characteristics

• Documentation type

2.6 Data Quality and Documentation

Information detailing the vendor’s data collection and data compilation methodology shall be provided by the vendor at the time of proposal to verify the requirements of 2.5 and after each change in data collection or compilation methodology during the award period. Data dictionaries describing the contents, format, and structure of the data and relationship between its elements for the data shall be provided by the vendor at the time of proposal to verify the requirements of 2.5 and after each data dictionary change during the award period. Fields or values that have been constructed, estimated, edited, inferred, or otherwise built or modified shall be identified in a data dictionary or similar document.

Information on the data collection and data compilation methodology may be sufficiently described for each field in the data dictionary; however, the vendor may also provide each document separately. Data shall be provided within 45 calendar days of each month’s end. Data shall be de-identified such that the CFPB cannot identify or re-identify any individual or entity, including borrower, lender, servicer, or investor.

2.7 Deliverables

The following deliverables are required and shall be submitted to the Contracting Officer’s Representative (COR). The Contractor shall ensure all deliverables are clear, concise, technically accurate, well-organized, properly referenced, and complete by the appropriate due dates.

2.8 Analytical, Technical, and Administrative Support Requirements

Support for users of the dataset shall be provided throughout the course of the contract.

The contractor shall provide a single point of contact for technical and administrative questions (e.g. relating to the transfer of data). The contractor shall provide a single point of contact for analytical questions (e.g. relating to the representativeness of a segment of loans). This point of contact may be the same as the technical point of contact provided that that person is qualified to handle both types of issues. The contractor shall provide, at a minimum, a response time of two business days or less.

2.9 The following Government Use Rights must be provided by the vendor at a minimum:

2.9.1 Full right to publish Work Product (i.e. research; reports; and internal bureau products such as memos, internal drafts, and other work to support Bureau functions) based on these data

2.9.2 No advance notice, advance review of, or permission for publication is required

2.9.3 Right to reference use of the dataset in publications and other public communications using the data is provided during the time period of the contract and for a period of five years after the base period or last exercised option year, whichever is later;

2.9.4 Right to archive and continue using the data for any Work Product that existed at the time of the expiration of the contract. (“Existing Work Product”), for a period of five years after the base period or last exercised option year, whichever is later. The Existing Work Product includes Work Product that, by the conclusion of the base year or last exercised option year:

i. Has appeared in public, including: submitted to a conference, submitted to a journal, appeared on the Bureau’s own website, published on the SSRN, including CFPB office of research working paper series OR

ii. Had been drafted for internal memo, data report to CFPB executives, other internal CFPB publication, or entered the Bureau’s internal review process for external and internal publication

2.9.5 Right to merge the data with all other datasets without affecting any CFPB usage or publication rights is provided

2.9.6 “Government,” for purposes of Government Use, includes the CFPB, CFPB employees, and CFPB contractors with a business need to access the data in order to perform necessary analysis.

3.0 PERIOD OF PERFORMANCE.

4.0 PLACE OF PERFORMANCE

The work shall be performed at the Contractor’s facilities.

5.0 FAR 52.212- 1 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS (JAN

2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition is 519190 – All Other Information Services.

(b) Submission of offers. Offerors must submit their proposal via email to catherine.palmer@cfpb.gov no later than 12:00 p.m. EST on 14 July 2017. Offers may be submitted on letterhead stationery, or as otherwise specified in the solicitation. As a minimum, proposals must show --

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A description of the offeror’s ability to meet the minimum Government requirements to include:

• Total number of loans in each market segment - minimum loan amounts in each segment (See 2.3, above);

• Total number of Fannie Mae, Ginnie Mae, and Federal Home Loan Mortgage Corp loans and loans that are not Fannie Mae, Ginnie Mae, and Federal Home Loan Mortgage Corp - minimum loan amounts in each segment See 2.3, above);

• Data dictionary (See 2.6 requirements)

• Data Methodology (See 2.6 requirements) - Information on the data collection and data compilation methodology may be sufficiently described for each field in the data dictionary; however, the vendor may also provide each document separately.

• List of data fields provided (See 2.5 minimum requirements);

• Government Use Rights that include, at a minimum, the requirements specified at 2.9;

• Acknowledgement that it meets all other minimum requirements of the solicitation.

(5) Price in accordance with Paragraph 1.0;

(6) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(7) Acknowledgment of Solicitation Amendments;

(8) Include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(e) Contract award. The Government intends to evaluate offers and award a contract to the Low Price Technically Acceptable (LPTA) offeror without discussions. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting

Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(f) Unique entity identifier. The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(g) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

(h) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The overall evaluated price of the successful and debriefed offeror.

(2) A summary of rationale for award;

(3) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

6.0 FAR 52.212-2 EVALUATION -- COMMERCIAL ITEMS (OCT 2014)

(a) LPTA Procedures: The Government intends to award a Firm Fixed Price contract to the responsible vendor whose proposal, while conforming to the solicitation, is most advantageous to the Government using Lowest Price Technically Acceptable (LPTA) competitive procedures. The determination of “most advantageous” will be based on the technically acceptable proposal that offers the lowest price among those proposals submitted, and offers a fair and reasonable price.

“Technical Acceptability” will be determined solely based on the vendor’s ability to satisfy all of the Government requirements. Proposals that do not meet all of the requirements specified will not be considered for award.

The following technical factors shall be used to evaluate offers:

1. Ability of the vendor to meet the Government’s minimum requirements – The Government will evaluate the information provided under Paragraph 5.0 (b)(4) of this solicitation to determine if it meets the Government requirements.

• Total number of loans in each market segment - Meets the minimum requirements identified in Section 2.3 of the solicitation;

• Total number of Fannie Mae, Ginnie Mae, and Federal Home Loan Mortgage Corp loans and loans that are not Fannie Mae, Ginnie Mae, and Federal Home Loan Mortgage Corp - Meets the minimum requirements identified in Section 2.3 of the solicitation;

• List of data fields – Meets the minimum requirements identified in Section 2.5 of the solicitation

• Data dictionary – Meets the requirements of 2.6

• Data Methodology – Meets the requirements of 2.6 (Information on the data collection and data compilation methodology may be sufficiently described for each field in the data dictionary; however, the vendor may also provide each document separately.)

• Government Use Rights – Meets the minimum requirements identified in Section 2.9 of the solicitation.

• Acknowledgement that it meets all other minimum requirements of the solicitation – Meets the minimum requirements identified in the solicitation.

2. Price - To be considered for award, the Offeror must provide completed Rate Tables in accordance with Paragraph 1.0 of this solicitation. The Lowest priced offeror will be determined based upon the Total Evaluated Price as provided in the completed Rate Table at 1.0. The Total Evaluated Price, consisting of the total proposed in the base and each option year, will be evaluated for realism and reasonableness.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

7.0 TECHNICAL EVALUATION RATING SCALE.

The Government will assess each of the proposals against the solicitation using the following ratings:

Acceptable The proposal meets all requirements of the solicitation.

Unacceptable The proposal fails to meet one or more of the minimum requirements identified in the solicitation. Proposals with an unacceptable rating will not be considered for award.

Proposals must meet all solicitation requirements in order to earn an “acceptable” rating. Only those proposals determined acceptable will be considered for award.

8.0 FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS --

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. 10.0 FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days.

11.0 FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR

2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 365 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 15 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years and six (6) months.

13.0 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (APR 2015)

(a) Definitions. As used in this clause—

(1) “Payment request” means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Payment documentation and process" and the applicable Payment clause included in this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Invoice Processing Platform (IPP). Information regarding IPP is available on the Internet at www.ipp.gov. Assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone

(c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing.

13.2 OVERPAYMENTS

13.2.1 In accordance with FAR 52.212-4, section (i)5, overpayments: Accounts Receivable Conversion of Check Payments to EFT: If the Contractor sends the Government a check to remedy duplicate contract financing or an overpayment by https://www.ipp.gov/ the government, it will be converted into an electronic funds transfer (EFT). This means the Government will copy the check and use the account information on it to electronically debit the Contractor’s account for the amount of the check. The debit from the Contractor’s account will usually occur within twenty-four hours and will be shown on the regular account statement.

13.2.2 The Contractor will not receive the original check back. The Government will destroy the Contractor’s original check, but will keep a copy of it. If the EFT cannot be processed for technical reasons, the Contractor authorizes the Government to process the copy in place of the original check.

If, in the opinion of the Contractor, any direction of the COR, or his/her designee, falls within the limitations in (c), above, the Contractor shall immediately notify the Contracting Officer.

f. Failure of the Contractor and the Contracting Officer to agree that technical direction is within the scope of the contract shall be subject to the terms of Federal Acquisition Regulation (FAR) Clause 52.212-4(d), “Disputes.”

All information submitted to the Contracting Officer (CO) and/or the COR shall clearly indicate the Contract number for which the information is being submitted. Additionally, all documents submitted and reports produced by the Contractor shall be suitably marked to indicate and appropriately disclose Contractor participation.

17.0 INSPECTION AND ACCEPTANCE.

Inspection and acceptance of all work performed shall be by the COR. Deliverables shall be reviewed for accuracy, clarity, completeness, and timeliness within ten (10) working days after receipt. The CFPB will provide any concerns and comments to the Contractor, who shall ensure completion of each deliverable in a manner acceptable to the COR within five (5) working days of such CFPB notice. The Contractor shall deliver all copies of completed deliverables to the

COR.

18.0 PUBLIC RELEASE OF CONTRACT (APR 2015)

CFPB is dedicated to transparency and plans to make the award document available to the public after award. If selected, the Contractor agrees to electronically submit to the
