About this file

This document is an Acquisition Alert detailing Executive Order 14173, "Ending Illegal Discrimination and Restoring Merit-Based Opportunity" issued in February 2025. The Executive Order revokes previous diversity, equity, and inclusion (DEI) initiatives, including EO 11246 on Equal Employment Opportunity, and requires federal contractors to certify compliance with federal anti-discrimination laws.

The alert mandates that all contractors must complete a certification form affirming: 1) they are in full compliance with federal anti-discrimination laws, and 2) they do not operate any DEI programs that potentially violate these laws. The certification is considered material to government payment decisions and is subject to the False Claims Act. Contractors must sign and submit this certification, acknowledging that false statements could result in legal consequences under 31 U.S.C. 3729(b)(4).
