About this file

This is a Fiscal Year 2024-2025 Budget Ordinance fines and penalties chart issued by the City of New Haven, Connecticut, detailing compliance violation sanctions for construction contractors overseen by the Commission on Equal Opportunities. The chart establishes monetary penalties for violations related to certified and living wage requirements, daily reporting compliance, workforce participation goals, and pre-award conference attendance. Penalties range from $750 for missing or incorrectly filled daily reports to $4,000 for multiple subcontractors failing to attend pre-award conferences. Late certified or living wage weekly payroll reports incur fines of $1,000 per week or 1% of the construction contract amount per week, whichever is greater, with escalated penalties for reports overdue more than eight weeks. Violations of "maximum effort" requirements to reach minority, female, and resident participation goals carry penalties of $2,000 or 1% of the respective construction contract amount per week of violation, charged cumulatively throughout the project work period. These penalties apply individually to subcontractors and collectively across all tiers of hiring contractors, including general contractors, reflecting the city's emphasis on workforce equity and contractual compliance in public construction projects.

The penalties outlined in this ordinance represent enforcement mechanisms for the City of New Haven's comprehensive labor and diversity requirements applicable to construction contracts subject to Section 17-201(15) regulations. The chart does not specify particular contract values or funding sources but establishes a standardized penalty structure to ensure contractor compliance with certified wage requirements, reporting obligations, and minority, female, and resident workforce participation goals. These fines and sanctions are assessed against individual violators at specified tier levels and may accumulate across multiple violations over the course of a project, creating substantial financial liability for non-compliant contractors and incentivizing adherence to the city's labor and equal opportunity standards.
