About this file
This document is a Permits, License User Fee Update and Fines/Penalties Chart for Fiscal Year 2024-2025, approved by the Mayor and Board of Aldermen (BOA) for the City of New Haven, Connecticut. The chart establishes enforcement penalties and fines administered by the Commission on Equal Opportunities for compliance violations related to construction contracts under ordinance 17-201(15). The penalties apply to contractors and subcontractors across all project tiers and address various compliance failures including failure to attend pre-award conferences, late submission of certified or living wage payroll reports, incomplete daily employee attendance and hours documentation, and violations of diversity participation goals for minority, female, and resident workers.
The fines range from $750 to $4,000 per violation for single occurrences, with escalating penalties for repeated violations. For example, late payroll reports incur $1,000 per week or 1% of the construction contract amount, whichever is greater, while violations of "maximum effort" diversity requirements are assessed at $2,000 per week or 1% of the contract amount. Repeated violations of documentation requirements at the sixth site visit increase penalties to $750 and are charged against all tiers of hiring contractors. These penalties are charged against the responsible (sub)contractor, and in cases of repeated violations, penalties extend to all hiring contractors up to and including the general contractor, creating tiered accountability throughout the construction workforce.
