About this file

This is a Fines and Penalties Chart approved by the Board of Aldermen (BOA) for the City of New Haven, Connecticut, outlining compliance violations and associated penalties under Ordinance No. 17-201(15) for the FY 2024-2025 budget period. The document establishes monetary sanctions for various construction-related compliance failures, including failures to hold pre-award conferences with subcontractors ($3,000 per violation or 2% of construction contract amount), late submission of certified or living wage weekly payroll reports ($1,000 per week or 1% of construction contract amount per week), missing or incorrectly filled daily employee reports ($750 per violation), and violations of diversity participation goals for minority, female, and resident participation ($2,000 per week or 1% of construction contract amount, whichever is greater). Penalties escalate for repeated violations, such as when a sixth site visit reveals continued reporting deficiencies or when payroll reports remain overdue for eight weeks or more. The chart was adopted by Mayor Justin Elicker and enforced by the Commission on Equal Opportunities.

These penalties apply to subcontractors and all tiers of hiring contractors up to and including the general contractor, creating tiered accountability throughout the construction supply chain. The fines structure utilizes both flat-rate and percentage-based penalties to scale consequences according to contract size, ensuring consistent enforcement across projects of varying scope and budget. The penalties are charged against the responsible contractor or subcontractor's company and are designed to ensure compliance with prevailing wage requirements, diversity hiring goals, and administrative reporting obligations on city construction projects.
