About this file

This is a Fines and Penalties Chart approved by the City of New Haven, Connecticut's Board of Aldermen (BOA) for the fiscal year 2024-2025, establishing enforcement mechanisms for construction contract compliance violations under Ordinance No. 17-201(15). The document outlines penalties applicable to contractors and subcontractors working on municipal construction projects, including the East Rock College Woods Improvements project. The penalties are structured to ensure compliance with prevailing wage requirements, workforce diversity goals, reporting obligations, and pre-award conference attendance.

The penalty schedule specifies escalating fines for various violations, ranging from $750 for missing or incorrectly filled daily employee reports to $4,000 for multiple subcontractors failing to attend pre-award conferences. Penalties for non-compliance with minority participation, female participation, and resident participation goals are set at $2,000 or 1 percent of the respective construction contract amount per week of violation, whichever is greater, with charges assessed against both the subcontractor and all tiers of hiring contractors up to the general contractor. Late or overdue certified and living wage weekly payroll reports incur penalties of $1,000 per week or 1 percent of the construction contract amount per week, with increased penalties after eight weeks of delinquency. These penalties are enforced by the Commission on Equal Opportunities and serve as compliance oversight mechanisms for all municipal construction contracts.
