About this file
This is a Budget and Fines Penalties Chart document from the City of New Haven, Connecticut for Fiscal Year 2024-2025, detailing compliance violations and associated penalties under the Commission on Equal Opportunities oversight. The document outlines mandatory penalties for various construction-related violations, including failures to conduct pre-award conferences, late submission of certified or living wage payroll reports, missing or incorrectly completed daily reports, and violations related to diversity participation goals for minority, female, and resident workers. Penalties are assessed against subcontractors and hiring contractors at all tiers, including general contractors, with violation charges ranging from $750 to $4,000 per incident, or percentage-based amounts calculated as a percentage of the construction contract value where applicable.
The penalty structure establishes clear financial consequences to ensure compliance with the City's labor and diversity requirements on public works projects. Penalties for late payroll reports begin at $1,000 per week or 1% of the construction contract amount weekly, whichever is greater, with escalated penalties of $1,000 per week starting in the ninth week of delinquency. Violations of maximum effort requirements to reach minority, female, and resident participation goals are charged at $2,000 per week or 1% of the respective construction contract amount, whichever is more, and can accumulate for the entire project work period. These penalties are designed to incentivize contractor compliance with prevailing wage, safety reporting, and diversity participation mandates established under Connecticut General Statutes Section 17-201(15).
