Solicitation CC-08-HQ-R-0021, Amendment 0001, Responses to RFP Questions

1. Can we receive a copy of the Plan Documents?

The OCC believes that the Summary Plan Document that was provided should be sufficient to prepare a response to the RFP. If there are specific concerns regarding the Plan Documents, please submit questions to which responses will be provided.

2. When does the NDA need to be signed?

The NDA needs to be signed and dated and submitted as part of the proposal. Please leave the “Contact No._____________” blank.

3. The Defined Contribution Plan Provider document within the description section states "Acquisition will be conducted on the basis of full and open competition for commercial services pursuant to FAR Parts 12 and 15". Are your expectations that the vendor will agree to the documents beginning with Contract Clauses A.1 52.212-4?

Yes, the expectation is that the clauses applicable to commercial services, beginning with A.1 52-212-4, will be accepted. Any exceptions to the terms and conditions must be specifically stated in the proposal submission.

4. On page 30 of the Contract Clauses, item A.23 states "If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (j) of this provision; however the documents does not contain (h), (i) and (j). Please provide these items.

The final paragraphs were inadvertently omitted. Please see the attached complete version of A.23, FAR 52.212-3, Offeror Representations and Certifications-Commercial Items.

5. Should each of the following be packaged separately: the SF 1449, Pricing, Evaluation Questionnaire, Offerors Representations and certificates, OCC Preliminary Third Party Service Provider Information Security Self-Assessment, Annual NIST 800-53 Security Self-Assessment, Section 508 Voluntary Product Accessibility Template, and the 52.212-3 Offeror Representations and Certifications - Commercial Items?

The items may be packaged separately or bundled in any manner that allows the various parts of the proposal to be easily separated for distribution to the evaluation team.

6. Please provide the assets, participants and investment option balances in the Roth 401(k).

7. Would you like to continue with the auto-enrollment feature? Will this be effective for new employees only or new employees and re-enrollment? What is your hiring/turnover rate?

Yes. This will be effective for both new employees and re-enrollments. The hiring/turnover rate information is as follows:

The CY-2007 turnover rate was 6.9% Total # of permanent separations = 201

The CY-2007 accession rate was 9.1% Total # of permanent hires = 268

8. What interests you about adding a post-tax feature beyond the Roth 401(k)?

a. Provides an additional plan investment resource for individuals that have reached plan and statutory limits for pre-tax contributions;

b. Makes the investment income protection of a qualified retirement plan available for an additional type of contribution;

c. Allows a participant to consolidate more of their retirement program in a single plan, instead of having to set up additional retirement funding vehicles like IRAs.

9. Will the vendor be responsible for the match calculation?

The OCC and its payroll provider, the National Finance Center, will calculate any match and provide the information in a specified file format to the 401(k) provider.

10. Can we receive a list of the ticker symbols/share classes for the investment options?

11. How many terminated (former) participants currently maintain balances in the plan?

12. Does the 2669 participant number include only folks who are deferring and not those who may receive some sort of an employer contribution? In other words, what is the total number of participant balances (both current and former employees) above $0.

The 2,669 includes all participants, those who are actively participating, as well as those who receive only the 2% automatic match. The total number of participant balances is 3,400.

13. How many annual enrollment meetings do you anticipate the "OCC" plan needing on an annual basis?

Approximately 10-15

14. How many payrolls are submitted on an annual basis? We are assuming your payroll system is centralized.

26 to 27 per year via a bi-weekly centralized system (National Finance Center).

15. Can you please provide the most recent report available that includes the current investment options, tickers, and current balances?

The current balances as of 3/3/08 are as follows. Please see the response to Question 10 for the other requested information.

18. Is advice currently offered? Is it required under this RFP, or is it an optional feature?

Advice is currently offered. Please refer to the Evaluation Questionnaire, C.1.7.h, which requests information on advice.

19. We understand that as a governmental agency, OCC is exempt from ERISA. Please describe the level of ERISA testing that currently takes place.

The OCC voluntary follows ERISA. We conduct 415 testing and IRS annual limits on benefits and compensation.

20. Please describe the current level of on-site education. Does OCC consider it to be adequate, or would they like to see it increased?

Information pertaining to the performance of the incumbent contractor can not be disclosed. Please refer to the Evaluation Questionnaire, C.1.7, Communication/Education, which requests information on education.

21. Please provide employee locations, and the number of employees at each location.

Please see the attached listing, “Locations.”

22. Do all employees work traditional office hours, or are there non-standard shifts?

The standard office hours are from 7:00 a.m. to 5:30 p.m. There are no non-standard shifts. Employees are in each of the standard time zones, Eastern, Central, Mountain, and Western.

23. Is there a preference for the number of investment funds in each asset identified in the Statement of Work?

At least 1 in each asset class.

24. Different companies use varying job titles to describe employee positions. To ensure that we are responsive to your expectations, please describe the job functions you would anticipate for the following Key Personnel as described on Page 2 of the Statement of Work;

a. Account Representative

b. Client Consultant

The job titles listed in the SOW are intended to be generic titles; specific duties are expected to vary from company to company. The following minimum functions are expected to be performed in accordance with position descriptions developed by each company:

Responsible for overall customer satisfaction/results

Develop strategy and goals with the customer

Coordinate account team

Serves as day-to-day contact on issues

Oversees ongoing administration and recordkeeping

Provides compliance updates and impacts

25. Is there a Stable Value Fund or Fixed Annuity? If so, please describe and quantify any Market Value Adjustment, Contingent Deferred Sales Charge, Surrender Charge, or any applicable impediment or restriction to liquidation.

Yes, the Guaranteed Income Fund; however, no additional information will be disclosed.

26. We are a benefits administration firm that provides recordkeeping, customer service, communication and education for defined contribution plans, but investment management and custody services are provided through affiliated companies – is arrangement acceptable to OCC?

Yes, however all such arrangements must be fully disclosed and will be evaluated by the OCC in determining the best value to the agency.

27. The Investments section of the Evaluation Questionnaire (Question 1.g – Page 22) requests that we list one recommended and four additional funds for each asset class, and that one of the funds should be an index fund offering. Does OCC have a preference for index or actively managed funds are the recommended fund? Do you anticipate offering multiple funds, or a single fund, in each asset class?

The recommendation of funds is a factor that will be evaluated for each company. We have no preference, would like a mixture of index and actively managed funds, and require at least one fund in each asset class. Multiple funds are acceptable.

28. Are we correct to assume that we will retain the revenue sharing from the investment funds, as long as it is fully disclosed?

Yes, that is a correct assumption.

29. Please describe the level of branding OCC desires for its Plan (e.g. all communications, website, and VRU fully branded to OCC with no mention of the plan provider, or branded to the plan provider, with the inclusion of OCC’s logo only?)

As this is an issue that may involve pricing considerations, it will be negotiated with each company on an individual basis. For proposal purposes, it would be beneficial to describe the level of branding that is available at no cost, at minimal cost, and at additional cost.

30. Does OCC currently use auto-enrollment, or anticipate implementing it?

Yes, it is currently used.

31. Please clarify whether we should assume a 5-year or a 1-year contract.

This is a one-year contract, with four additional one-year options to be exercised at the OCC’s discretion.
