DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND WASHINGTON

1314 HARWOOD STREET SE

WASHINGTON NAVY YARD DC 20374-5018

IN REPLY REFER TO

ANNEX 1 - JUSTIFICATION AND APPROVAL

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. Naval Facilities Engineering Command Washington.

2. Description of the Action Being Approved.

Pursuant to FAR 6.302-1, approval is required to include an item peculiar to one manufacturer in the contract specifications for the construction solicitation for the Naval Research Laboratory (NRL) large volume fire research facility at the Chesapeake Bay Detachment (CBD), Chesapeake Bay, MD. This J&A covers only the portion of the acquisition which is brand name.

3. Description of Supplies/Services.

The item peculiar to one manufacturer that meets the Government’s requirement is Super Padgenite HD. The brand name product is provided by WHP Trainingtowers. The item peculiar to one manufacturer is a one-inch insulation panel, which is required to withstand temperatures up to 2,000 degrees Fahrenheit. The system withstands repeated exposure to heat and the application of water to heated surfaces without the breakdown of insulation properties.

The Estimated Dollar Value of the an item peculiar to one manufacturer totals $448,363.00 for this project.

4. Statutory Authority Permitting Other Than Full and Open Competition.

Pursuant to 10 U.S.C. 2304(c)(1), One source or limited sources, meet the Government’s requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The purpose of the fire research facility is to provide a space that researchers can start fires and extinguish them. The building must be built to withstand tremendous temperatures. The item peculiar to one manufacturer is the only product that can withstand temperatures that would deform steel, avoid collapse, and provide a safe environment for fire research. The Architect & Engineering (A/E) firm identified the required ceiling product at the 15% and 35% design submissions, as the only product that withstands repeated exposure to heat and the application of water to heated surfaces without the breakdown of insulation properties. The designer examined significant fire modeling to simulate the temperatures experienced on the walls and ceiling. The A/E discovered the temperatures were so extreme, that there were no other materials that could withstand the heat, and span the length of the building. The product identified is ceiling panel to protect the steel that spans the 50’ length at the roof from collapsing while conducting fire modeling.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The A/E identified the ceiling panel peculiar to one manufacturer at the 15% design, as the only product capable of meeting the fire research requirements. The A/E conducted market research to identify alternatives and searched for products that have similar attributes and salient characteristics. The project is still in the design phase. No other sources have been identified.

Prior to issuing the solicitation for the construction contract, a synopsis of the proposed procurement will be published via the Government Point of Entry (GPE) at SAM.gov.

The A/E’s market research indicates that there is only one manufacturer and this product cannot be custom fabricated. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVAC has no plans at this time to compete future contacts for the types of item peculiar to one manufacturer covered by this document. If another potential source emerges, NAVAC will assess whether competition for future requirements is feasible.
